1. Are Unemployment Benefits Available for Independent Contractors, Gig Workers, Self-Employed Individuals and Freelancers?

As part of the federal CARES Act, the new Pandemic Unemployment Assistance program helps unemployed Californians who are business owners, self-employed, independent contractors, have limited work history and others not usually eligible for regular state UI benefits who are out of business or whose services are significantly reduced as a direct result of the pandemic. The provisions of the program include:

  • Up to 39 weeks of benefits starting with weeks of unemployment beginning February 2, 2020, through the week ending December 26, 2020, depending on when you became directly impacted by the pandemic.
  • A new 13-week federal extension for those who run out of their regular state-provided UI benefits . File a PUA claim and you may be converted to the federal extension once it is available.

The PUA benefits are payable if you dont qualify for regular Unemployment Insurance benefits in California or another state, and also do not qualify for state Disability Insurance or Paid Family Leave benefits. This includes:

  • Business owners
  • Freelancers
  • Gig workers

You can also be eligible if you qualified for regular UI benefits, but have already collected all of those benefits.

What Is A Reasonable Severance Package

A severance package is severance pay plus other severance benefits. A severance package may address and discuss the following:

  • the specific amount of severance pay the employer will provide to the employee,
  • the stock options available to the employee ,
  • whether the employer will continue to provide health insurance ,
  • when the employer will make the severance payment ,
  • if the employer will offer any type of outplacement assistance ,
  • whether or not the terminated employee can file an unemployment insurance claim , and
  • how much the employee may get paid for any untaken vacation time.

This is just a sampling of unemployment benefits that a severance package may address. A specific employer may include others as well.

Note that severance packages and severance agreements are legally speaking contracts between the employer and the employee. As such, any legal issues that arise are resolved using California contract law.

Do You Meet The Minimum Earnings Requirement

Virtually all states look at your recent work history and earnings during a one-year base period to determine your eligibility for unemployment. In California, as in most states, the base period is usually the earliest four of the five complete calendar quarters before you filed your claim for benefits. For example, if you file your claim in July 2020, the base period would be from April 1, 2019, through March 31, 2020. However, if you didn’t earn enough during the regular base period, the EDD will use the most recent four quarters as an alternate base period.

During the base period, you must have earned at least:

  • $1,300 in your highest paid quarter, or
  • $900 in your highest paid quarter and, during the entire base period, at least 1.25 times your high-quarter earnings.

Request A 940 Certification

A 940 certification is completed by state unemployment insurance agencies upon request by an employer to certify the following to the IRS:

1) The taxable payroll reported by an employer for a specific calendar year,

2) The tax rate for the employer for the same calendar year,

3) Any taxes paid by the employer by the due date of Form 940 to the certifying state for the same calendar year,

4) Any taxes paid by the employer to the certifying state between February 1st and 10th for the same calendar year,

5) Any taxes paid by the employer to the certifying state after February 10th for the same calendar year.

To obtain a 940 certification, select the Operate a Business option from the Michigan Business One Stop web site and select the task IRS Certification of Accounts. Selecting this task will link you to the online services offered by UIA through the Michigan Web Account Manager . If you do not currently have a MiWAM account you can register for one and open the door to many online services offered by UIA.

Once on the Welcome page for MiWAM, select the account id. From the Tax Account Information page, select the Account Services tab and Account Maintenance. You will be able to IRS Certification of Account. A notification will be sent to your MiWAM Account when the certification of account has been processed.

Tax Implications Of Unemployment Benefits

Unlike workers’ compensation benefits, unemployment insurance benefits are taxed as income. Because the benefit amounts paid are often below the taxable annual earning level, however, many states will not take the automatic step of deducting any taxes from your unemployment benefit check.

Normally, you must conduct a reasonable search for work, and certify that you have done so. You should keep records of the employers you have contacted, the dates you made contact, and the outcome. The EDD may ask you to provide this information.

Why Did I Receive A $0 Determination

Ineligible claimants receive an Unemployment Claim Determination of $0. You may be ineligible if one of these are true:

  • You worked less than 680 hours in your base year.
  • We dont have a record of your hours and wages, most commonly because an employer did not provide information in their normal reporting.
  • You do not meet the requalification requirements after previously receiving benefits. To requalify, you must have returned to work and earned six times your weekly benefit amount from the date of separation that led you to open your previous claim.
  • Example: If you separated from an employer on July 1 and filed a claimon July 8, you would need to return to workand earn six times your WBA starting after July 1 to requalify.

Several scenarios may result in you receiving a Notice of Unemployment Insurance Award stating that you are entitled to $0 in benefits. Each scenario has a different recommended course of action:

The EED could not verify your identity. If the EDD needs to verify your identity, they will either verify your identity through ID.me, UI Online, or mail. The EDD will send you a message telling you which platform to use to verify your identity:

Once the EDD verifies your identity, you will receive a new notice indicating what the EDDs wage records show for your weekly UI benefit payments .

You are self-employed or an independent contractor and you have not paid contributions to the state Unemployment Insurance Trust Fund. You should apply for PUA.
