D Unemployment Benefits For Independent Contractors Gig Workers Self

FOCUS: Unpaid unemployment back pay

1. Are Unemployment Benefits Available for Independent Contractors, Gig Workers, Self-Employed Individuals and Freelancers?

As part of the federal CARES Act, the new Pandemic Unemployment Assistance program helps unemployed Californians who are business owners, self-employed, independent contractors, have limited work history and others not usually eligible for regular state UI benefits who are out of business or whose services are significantly reduced as a direct result of the pandemic. The provisions of the program include:

  • Up to 39 weeks of benefits starting with weeks of unemployment beginning February 2, 2020, through the week ending December 26, 2020, depending on when you became directly impacted by the pandemic.
  • A new 13-week federal extension for those who run out of their regular state-provided UI benefits . File a PUA claim and you may be converted to the federal extension once it is available.

The PUA benefits are payable if you dont qualify for regular Unemployment Insurance benefits in California or another state, and also do not qualify for state Disability Insurance or Paid Family Leave benefits. This includes:

  • Business owners
  • Freelancers
  • Gig workers

You can also be eligible if you qualified for regular UI benefits, but have already collected all of those benefits.

You must also meet one of the following criteria:

What Is A Reasonable Severance Package

A severance package is severance pay plus other severance benefits. A severance package may address and discuss the following:

  • the specific amount of severance pay the employer will provide to the employee,
  • the stock options available to the employee ,
  • whether the employer will continue to provide health insurance ,
  • when the employer will make the severance payment ,
  • if the employer will offer any type of outplacement assistance ,
  • whether or not the terminated employee can file an unemployment insurance claim , and
  • how much the employee may get paid for any untaken vacation time.

This is just a sampling of unemployment benefits that a severance package may address. A specific employer may include others as well.

Note that severance packages and severance agreements are legally speaking contracts between the employer and the employee. As such, any legal issues that arise are resolved using California contract law.

Do You Meet The Minimum Earnings Requirement

Virtually all states look at your recent work history and earnings during a one-year base period to determine your eligibility for unemployment. In California, as in most states, the base period is usually the earliest four of the five complete calendar quarters before you filed your claim for benefits. For example, if you file your claim in July 2020, the base period would be from April 1, 2019, through March 31, 2020. However, if you didn’t earn enough during the regular base period, the EDD will use the most recent four quarters as an alternate base period.

During the base period, you must have earned at least:

  • $1,300 in your highest paid quarter, or
  • $900 in your highest paid quarter and, during the entire base period, at least 1.25 times your high-quarter earnings.

4) Any taxes paid by the employer to the certifying state between February 1st and 10th for the same calendar year,

Tax Implications Of Unemployment Benefits

Unlike workers’ compensation benefits, unemployment insurance benefits are taxed as income. Because the benefit amounts paid are often below the taxable annual earning level, however, many states will not take the automatic step of deducting any taxes from your unemployment benefit check.

However, the state will report the unemployment benefit amount you were paid to the Internal Revenue Service and to your state taxing authority.

If you receive unemployment benefits during a year in which you get a new job, you may want to increase the amount your employer withholds in taxes from your paycheck. Otherwise, you may be unpleasantly surprised at tax time when you either owe more tax or receive less of a refund than anticipated.

Are You Available And Actively Searching For Work

To maintain your eligibility for unemployment benefits, you must be able to work, available to accept a job, and looking for work. If you are offered a suitable position, you must accept it.

Normally, you must conduct a reasonable search for work, and certify that you have done so. You should keep records of the employers you have contacted, the dates you made contact, and the outcome. The EDD may ask you to provide this information.

I Submitted My Application But Havent Received Benefits Yet

14. I recently submitted my application. How long will it take for me to start receiving benefits?

The wait time for receiving benefits is generally 21 days to a month. However, due to the record number of people applying for UI, it may take longer. If your company did not pay payroll taxes on your earnings, or you were misclassified as an independent contractor, you will likely have to provide proof of your earnings to the EDD, and it will take longer for the EDD to process your claim. We recommend contacting the EDD if you have not heard back from them in 6 weeks.

15. I received a Notice of Unemployment Insurance Award stating that Im entitled to $0 in benefits. What does this mean?

Several scenarios may result in you receiving a Notice of Unemployment Insurance Award stating that you are entitled to $0 in benefits. Each scenario has a different recommended course of action:

The EED could not verify your identity. If the EDD needs to verify your identity, they will either verify your identity through, UI Online, or mail. The EDD will send you a message telling you which platform to use to verify your identity:

Once the EDD verifies your identity, you will receive a new notice indicating what the EDDs wage records show for your weekly UI benefit payments .

You are self-employed or an independent contractor and you have not paid contributions to the state Unemployment Insurance Trust Fund. You should apply for PUA.

Proof Of Income For Car Dealerships

Car dealerships may ask to see your most recent three months of Pay Stubs for income verification. This is so they can verify you have adequate income to pay your monthly payments on time, ultimately protecting their own interests.

Dealerships typically need 3 months of pay stubs. Therefore, if you are on a bi-weekly or semi monthly pay pay schedule then you would need approximately 6 pay stubs to cover a 3 month period.

Paycheck Vs Pay Stub Is There A Difference

You might even be sitting there wondering, is there a difference of a paycheck vs. a pay stub?

The answer is yes.

A paycheck is an actual check that you can present to your bank and have deposited in your account.

A pay stub, on the other hand, is a document which sometimes comes attached to the check that summarizes the amounts of the check and gives other necessary information such as deductions.

As direct deposit continues to become the more popular mode of pay, youre less likely to get a paper copy of your pay stub since you wont receive a physical check.

More frequently, youll receive an email with a link that will provide the same details youd see on a physical copy of a pay stub.
