If You Have Rental Income Coming In

When does an unemployment disqualification end? What makes ...

In general, if you rent out a single property as a form of passive income and it’s not tied to your employment , you likely won’t be required to include incoming rent when you report the wages you earn on your weekly filings.

This can vary by state, however, and Evermore recommends you check with your state unemployment agency for more details.

That also means if you lose rental income because your tenant can’t make rent that month, you won’t be able to recover some of those funds through unemployment assistance.

“That’s more like investment loss,” Evermore says. “My 401 could be doing great or it could be tanking, but that has nothing to do with my employment situation.”

You Meet Requirements For Time Worked And Wages Earned

To get unemployment, you must have worked for a certain amount of time and earned a minimum amount of money. Typically, the unemployment office looks at your employment and earning history in the previous year. Every state sets its own requirements. Check with your state to learn about its policy.

Most states also require that you were a part-time or full-time employee. If you were an independent contractor, like a freelancer, then you probably cant get benefits. Thats because your employer may not have paid unemployment taxes while you were working.

With that said, during the coronavirus pandemic, federal relief was offered to self-employed and gig workers. Although these benefits are often temporarily extended to freelancers, its wise to check with your states unemployment office for the most up-to-date information.

Rights Of Fired Employees

Private employment is at will in most cases, meaning that employers can terminate their employees at any time, and for any reasonas long as its not illegal, discriminatory or in violation of a contract.

However, terminated employees have certain rights, one of which is the right to receive unemployment compensation, if they qualify. Other rights of fired employees include:

  • Receipt of their final paycheck.
  • Paid severance, if the contract stipulates it.
  • Continued health insurance coverage after separation from their employer via COBRA.
  • Advance notification before closing of a facility or a mass layoff.

If you get hired for a new position that pays more than you are receiving in weekly unemployment compensation, then you are not eligible for unemployment benefits. However, if you find small jobs while you are unemployed and earn less than the weekly unemployment benefit amount, you still should be able to receive unemployment benefits. However, if you make more than $58 per week, the state of Florida will deduct a small portion from your unemployment check, which acts as a further incentive for you to find a job. Also, you must report your gross income and your earnings each time you request a benefit payment. And any payment for work you earn has to be declared the week you worked to make it, not the week you receive a paycheck.

Unemployment Eligibility If You Quit Voluntarily

My New York unemployment status is pending. Do I qualify ...

Even if you think you had a good reason to leave a job, that doesn’t necessarily mean you had good cause in the eyes of the law. For example, it might make sense to leave a job that doesn’t offer opportunities for advancement, but a worker who makes this choice won’t be eligible for unemployment benefits. Similarly, some people quit their jobs because they find the work unfulfilling or they want to pursue an entirely different career path. These decisions may lead to a better qualify of life and higher job satisfaction — but what they won’t lead to is an unemployment check.

In some states, former employees are eligible for benefits if they leave a job for compelling personal reasons — for example, to relocate when a spouse gets a distant job or because a family emergency requires the worker to be home. In other states, benefits are available only if the employee’s reasons for quitting are related to the job

Do I Qualify For Unemployment Benefits

Workers in Indiana must check the following boxes in order to get unemployment benefits:

  • You must be unemployed or have had your hours significantly reduced through no fault of your own.
  • You must be able to work and actively seeking work.
  • Your past earnings must meet certain standards, as discussed below.
  • Indiana has been slow to react to the sharp increase in unemployment applications due to COVID-19. Many other states have waived their work-search requirements during the pandemic, but Indiana has yet to make a similar announcement. However, it has said that recipients who receive letters requiring them to set up an in-person review of their work-search activities can ignore these requests for the time being.

The state uses a base period to determine whether your earnings qualify. This is the first four of the last five completed quarters before you applied for unemployment. That’s October 2018 to September 2019 for those who apply in March 2020 and January to December 2019 for those who apply in April 2020.

You must have earned at least $4,200 in total, and at least $2,500 of that money must have come in during the last six months of your base period. Also, your total wages in your base period must be at least 1.5 times the wages you earned in your highest-earning quarter. So if you earned $3,000 in your highest-earning quarter, you must have earned at least $4,500 during your base period.
