Pandemic Emergency Unemployment Compensation Extension

Pandemic Emergency Unemployment Compensation is a federal extension program for people who have exhausted their regular unemployment benefits. PEUC was created by the CARES Act on March 27, 2020.

Under the original text of the CARES Act, PEUC benefits were available for a maximum of 13 weeks and set to expire on December 26, 2020. Congress has extended the PEUC program several times since then.

The week of August 29 through September 4, 2021 will be the last week for which you can be paid PEUC benefits. You will be able to request payment for that week on or after September 5, 2021. Refer to Federal benefit programs ending in September for more information.

Biden Administration Pushing For Extension Of Unemployment Benefits

With the unemployment benefits ending next month, the U.S. Treasury and the U.S. Department of Labor are pushing Congress for the extension on unemployment benefits past the Sept. 4 cutoff date.

In a rare joint letter, Secretary of the Treasury Janet L. Yellen and Secretary of the Department of Labor Martin J. Walsh sent a letter to Congressional leaders to extend unemployment benefits.

Guam Department of Labor Director David DellIsola confirmed that there are moves within the Biden administration to extend the unemployment benefits, specifically the Pandemic Unemployment Assistance .

The Biden administration is in support that the temporary FPUC should expire because that was always intended to be temporary. But theyre also asking Congress to consider extending the PUA because they also recognize that for some states, it makes sense for unemployed workers to continue to receive additional benefits as they are taking a longer period of time to ramp up and their unemployment is very high, DellIsola said in an interview with NewsTalk K57s Patti Arroyo.

In their letter, the Biden Cabinet members said the unemployment programs have been a critical lifeline for millions of Americans who were unemployed, through no fault of their own during the COVID pandemic.

Which States Ended Unemployment Benefits Early

Following recent job reports that showed a shortage of workers to fill open positions, many Republican led states have now ended federally funded pandemic unemployment programs in order to incentivize workers to return to work. You can see the table below for when states ended one or more of the pandemic unemployment programs early.

The argument is that these generous UI benefits deter lower income workers from returning to work. Opponents argue that the reason people are not going back to work is due to fears around getting COVID and/or child care and schooling restrictions.

After the pandemic-related expansion of unemployment insurance ended on Sept. 6, roughly 7.5 million people lost their benefits entirely, with millions more losing the $300 weekly bonus checks. The temporary federal benefits — which included coverage for those normally ineligible for jobless aid, like gig workers and the long-term unemployed — were in place since spring 2020 to help those who lost income from COVID-19 restrictions or layoffs.

This week, a group of Democratic lawmakers, led by Reps. Cori Bush and Alexandria Ocasio-Cortez, called to reform the unemployment system in the coming $3.5 trillion House spending plan. While the ARP stated that both the PUA and PEUC programs were extended by 29 weeks, the actual number of weeks between week ending March 20th and September 4th is only 25 weeks. This was noted in the DOL guidelines around the ARP extension and as such claimants will not be able to exhaust their full entitlements, unless the UI programs are extended

I had also noted earlier that there could have been a phase-out period for active claimants to use remaining weeks like the CAA 11-week extension however final DOL guidelines removed phase-out provisions and all program benefits expire on weeks that end before September 6th, 2021. This would be September 4th, 2021 in most states, or September 5th, 2021 for those that a benefits week ending on a Sunday.

$900 Billion Covid Stimulus Bill Funding Extensions

There are some constraints to be aware of in the recently approved $900 billion stimulus bill unemployment benefits extension as discussed below. Just to recap the legislation passed under the new stimulus bill includes the following unemployment benefits: Eleven more weeks of benefits under the Pandemic Emergency Unemployment Compensation program and the Pandemic Unemployment Assistance program. It also includes a $300 Federal Pandemic Unemployment Compensation per week supplemental payment to anyone receiving unemployment benefits from any other unemployment program during the coverage period.

Under the PEUC program states can now pay up to 24 weeks of additional unemployment benefits to individuals who have qualified for, but exhausted regular state unemployment compensation . They must also be able to work, available for work, and actively seeking work assuming no Coronavirus/COVID-19 restrictions. An individual is deemed to have exhausted benefits when no further UC payments can be made under any federal or state law because the individual has received all available regular UC based on employment or wages during such individualâs base period or the individualâs right to such regular UC has been terminated by reason of the expiration.

If there is no benefits extension for unemployment available, the unemployment claimant may need to explore other means of assistance such as other financial assistance programs.

Unemployment extensions are not the only form of assistance available for unemployed residents.

Examples of other available programs include the Low-Income Home Energy Assistance Program and Weatherization Assistance Program, both of which can help unemployment claimants who are losing their benefits to lower their monthly bill payments.

Biden Emergency Extension To Pandemic Unemployment Benefits

With the rapid spread of and potential economic slowdown from the virulent Delta COVID-19 strain there is now talk of the Biden administration repurposing some of existing ARPA stimulus bill funding to extend pandemic unemployment programs to the end of 2022.

This is similar to the six week LWA extension that President Trump passed by executive order last year when Congress could not initially agree on funding an extension to pandemic unemployment benefits.

If Congress cannot provide additional funding then this will be the most likely path for a short-term emergency extension of pandemic benefits and could be done relatively quickly along party lines, or simply by a Presidential Executive order. White House lawyers are likely already working on this as a possible option.

Note that states which had ceased participation early in the federally funded unemployment programs will need to reapply to get access to this short term extension, if indeed it is passed.

Who Is Eligible For Extended Unemployment Benefits

What benefits are unemployed workers eligible for? Ordinarily, workers in most states are eligible for 26 weeks of unemployment benefits, although some states provide less coverage. Montana is the only state that provides more with 28 weeks of unemployment benefits.

In times of high unemployment, the federal government provides funds to the states to extend unemployment insurance programs for additional weeks of benefits beyond what each state offers.
