Availability To Work And Unemployment
Finally, an unemployed worker may only claim unemployment insurance if he or she is ready, willing, able, and available to work immediately. There are two issues that anyone seeking unemployment benefits should be aware of regarding work availability.
First, persons seeking to collect unemployment benefits must actively search for work by applying for jobs. If, at any time during the benefits period, an unemployed worker is offered work and declines it, he or she risks losing unemployment benefits
Second, unemployed worker is medically unable to work, then he or she may not eligible to collect unemployment benefits.
If you are medically unable to work, you still have some options for support. You could file a claim for workers compensation benefits, if you were injured on the job. With other medical disabilities, you may qualify for social security disability benefits. Visit the website of the New York Office of Temporary and Disability Assistance: www.otda.ny.gov.

How To Apply For Unemployment A Second Time
BUFFALO, N.Y. As COVID numbers soar to near record highs in Western New York, unemployment claims are climbing again as well. Western New York saw a 578% increase in Over-The-Year Change in Initial Claims from March 14th to November 7th.
I do have a feeling there are going to be a lot of people entering unemployment that were probably on it previously maybe during the months of March through July, Tim Eliason, the assistant district manager at EG Tax, said.
The New York State Department of Labor said from September 2019 to September 2020, the private sector job count dropped more than 10%. The hardest hit industry was leisure and hospitality with more than 19,000 jobs lost. Now, with the Orange Zone restrictions, that number could increase even more.
What happens if you have to file for unemployment a second time in 2020?If somebody went back to work before their 39 weeks were up, all they have to do is resume their claim, Eliason said.
If you have collected your 39 weeks of unemployment, you will have to apply again. But the way unemployment is calculated, it issues the last four quarters. If you havent been working, that could mean less money in your unemployment checks.
That’s going to be minimal income and it’s going to be a very low calculation on what they’re eligible for on unemployment. You can do something where it says there’s an alternate fourth quarter where you can go way back maybe when you were still working and they’ll use that, Eliason said.
How Do I Make A Claim
Go online and;begin by creating an account at NY.gov ID. Then proceed with the application. You’ll need your Social Security number, driver license number, the names and addresses of all your employers for the past 18 months, including those in other states. You’ll also need your Employer Registration number or its Federal Employer Identification Number, which can be found on your W-2 forms.

Are You Available And Actively Searching For Work
To maintain your eligibility for unemployment benefits, you must be able to work, available to work, and looking for work. If you are offered a suitable position, you must accept it. A suitable position is one for which you are a fit based on your training and experience. Even if the position pays less than what you used to make, you may not turn it down for this reason as long as it pays the prevailing wage for similar work.

What are Unemployment Insurance Benefits?
Unemployment insurance benefits provide temporary income for eligible workers who become unemployed. The benefits are administered by the New York State Department of Labor office. A portion of the benefits are paid for by employers. No deductions are taken from a worker’s paycheck for this program.
Who is Eligible for Unemployment Benefits?
To be eligible for unemployment benefits, a claimant must have earned enough wages in covered employment during a set time period, and have worked in New York State within the last eighteen months. The Department of Labor, not the former employer, makes the initial determination of whether a claimant will receive benefits.
In order to receive benefits, claimants should be:
New York State has at-will employment. This means that a worker can usually be fired at any time for non-discriminatory reasons, unless they are working under a contract or are a covered union member. To receive unemployment benefits though, it cannot be the claimants fault that they are unemployed.

Do You Meet The Minimum Earnings Requirement
Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment compensation. In New York, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your claim for benefits. For example, if you filed your claim in October of 2020, the base period would be from June 1, 2019, through May 31, 2020.
New York recognizes an alternate base period for those who can’t meet the earnings requirements in the regular base period. The alternate base period is the last four completed quarters before the person files for unemployment. This alternate period takes more recent employment into account. Even filers who qualify using the regular base period can ask the agency to instead use the alternate base period to calculate their benefits, if that would result in a higher weekly amount.
During the base period, your work history and earnings must meet all three of the following requirements:
