New York Won’t Extend Unemployment Benefits To Healthcare Workers Fired Over Covid
- New York will not extend unemployment benefits to most unvaccinated healthcare workers who are fired over the vaccine mandate.

Healthcare workers who refuse the COVID-19 vaccine and are fired for failing to comply with a new state law will not be able to collect unemployment benefits unless they present a doctor-approved request for medical accommodation, according to the New York Department of Labor.
New York’s new vaccine mandate, which goes into effect Monday, makes it necessary for workers in New York’s hospitals and nursing homes to have received at least one dose of a COVID-19 vaccine. Employees working at in home care, hospice, and adult care facilities need to be vaccinated by October 7. The mandate also applies to all out-of-state and contract medical staff who practice in New York.
“Workers in a healthcare facility, nursing home, or school who voluntarily quit or are terminated for refusing an employer-mandated vaccination” are not eligible for unemployment insurance because the employer has a “compelling interest” for its employees to be vaccinated, according to the New York Department of Labor website.

What Is The Extended Benefits Program And When Does It End
The Extended Benefits program, or EB, is a federal program that became available on July 5, 2020.;
It was meant to continue providing income for those whod already exhausted two other state or federal unemployment programs state Unemployment Insurance and Pandemic Emergency Unemployment Compensation, or PEUC.;
Initially, New Yorkers could access up to 20 weeks of EB. But the amount of EB available was dependent on New Yorks unemployment rate. If the rate ran less;than 8% for a three-month period a threshold set by the federal government;;the EB amount available to New Yorkers would decrease to 13 weeks.;
That’s;what is;taking effect Aug. 9: The decrease from 20 weeks to 13 weeks of EB eligibility.
New York’s average unemployment rate between April and June was 7.9%,;triggering the change, according to the most recent unemployment data from the U.S. Labor Bureau of Statistics.;
So what does that mean for you? If youve been receiving EB for 13 or more weeks, it means you will stop receiving it on Aug. 9. If youve been receiving EB for less than 13 weeks, you may receive it until Sept. 5, when the program comes to a full stop for everyone around the country.;
If you become eligible for EB after Aug. 9,;your EB benefits will cease on Sept. 5.;

Aoc To Introduce Bill To Extend Pandemic Unemployment Insurance To 2022
Rep. Alexandria Ocasio-Cortez, D-N.Y., is calling for pandemic-era unemployment insurance programs to be extended until February 2022, she announced during a virtual townhall Tuesday.
The congresswoman said she will introduce a bill to extend federal unemployment programs established under the March 2020 CARES Act, which expired over Labor Day. If passed, the enhanced jobless aid would be retroactive to Sept. 6 and extended until Feb. 1, 2022.
Millions of Americans and their families lost their access to;pandemic UI;programs this month that provided aid to out-of-work freelancers, gig workers, caregivers and the long-term unemployed. All remaining workers collecting unemployment benefits also lost the $300 weekly booster that was created to supplement low state aid.
“I’ve been very disappointed on both sides of the aisle that we’ve just simply allowed pandemic unemployment assistance to completely lapse, when we are clearly not fully recovered from the consequences of the pandemic,” Ocasio-Cortez said.
While she added she’s not sure of the prospects of the legislation being passed, Ocasio-Cortez said she “simply could not allow this to happen without at least trying” to extend jobless aid.
Several studies have shown jobless benefits have had a minimal impact on hiring, and that concerns over the virus and ongoing child-care challenges remain top issues for workers evaluating their job prospects amid the health crisis.

Citing labor shortages in the spring, 26 state governors claimed pandemic-related unemployment benefits were producing limited incentives for workers to take jobs.;Many economists and analysts disagreed, highlighting several factors that prevented people from finding suitable work, including low wages, lack of health care, inadequate child care and fear of contracting COVID-19.;

Jobless New Yorkers To Hold Rally In Long Island City Tuesday Night To Call For Extension Of Unemployment Benefits

Unemployed New Yorkers will gather in Long Island City tonight to call on the federal government;to extend federal unemployment benefits that expired on Labor Day.
The jobless, along with activists, will rally at Gantry Plaza State Park at 8 p.m. Tuesday to demand legislators extend the pandemic-era benefits after as many as 800,000 New York City residents lost all unemployment benefits on Sept. 6. They are specifically calling on U.S. Senator Chuck Schumer, who represents New York, to help push the extension through.
The job market in New York City has not fully recovered to pre-pandemic levels, according to a recent study by The New Schools Center for New York City Affairs. The study noted that the city is still 510,000 payroll jobs short of its pre-COVID-19 peak.
Furthermore, the states official unemployment rate of 7.6 percent is the fourth highest in the country, according to Unemployed Action, a movement for and by unemployed workers and their families.
Many of the residents affected by the federal cutoff are low-paid workers including people who had worked in leisure and hospitality, local services, retail, and the arts and entertainment industries ;according to the New Schools study.
The rally is being organized by members of Unemployed Action,;who will project images of unemployed workers on the parks historic gantries.
A spokesperson for Schumers office didnt immediately respond to a request for comment.

The group held a rally in front of the Rath Building in downtown Buffalo calling on Congress to pass the HEROES ACT which was approved by the House of Representatives two months ago to provide financial help for communities and individuals affected by COVID-19.
Citizen Action believes Erie County needs to allocate $15 million to prevent evictions and homelessness.

The way that these programs function is that workers exhausting their PEUC benefits transition onto EB. However, if the state EB program also turns off on September 6, hundreds of thousands unemployed New Yorkers will lose a key source of income.

Hochul Launches Massive Covid Testing Program For Anti
New York will not pay to extend COVID-19 unemployment benefits for the 1.6 million state residents receiving them when the related federal programs expire at the end of Sunday, Gov. Kathy Hochul said.
Speaking at an unrelated press conference in Manhattan, Hochul claimed to have her hands tied by both federal regulations and state law, which she said prohibit allocating additional funds while the state is still running a deficit.
Our unemployment system was so overtaxed last year and a half that we now have an $11 billion deficit, and the state law does not allow us to allocate any increase in resources as long as there is a deficit, Hochul said.
We looked long and hard to find out what options are available for the people, the governor said.
The programs set to expire by the end of Sunday include Pandemic Emergency Unemployment Compensation and Extended Benefits, according to THE CITY. The programs have extended the amount of time someone could receive payments after losing their job.
An additional $300 in COVID support per week paid out by the feds to all unemployment recipients also expires at midnight Sunday, THE CITY said.
Unemployment stood at 7.6 percent statewide in July and 10.5 percent in New York City, according to the state Department of Labor.
Hochul on Sunday advised unemployed New Yorkers set to lose benefits Monday to seek help from workforce training programs.

Based on your particular circumstances, the New York Department of Labor will send you a notice of how many weeks of eligibility you have. Normally you can draw 26 weeks of benefits in any given Benefit Year. Know how and when you will be paid. Most applicants start receiving benefits anywhere from 3 to 6 weeks after they file their first claim.

New Federal Guidance May Not Help Resolve States’ Confusion
When reached for comment ahead of the guidance’s release, Washington state had its own reservations. A spokesperson for the governor said that while the initial letter “gives states express “permission” to “use the funds we already have, but there are too many unaddressed issues for many to continue to offer pandemic unemployment assistance beyond the week of Sept. 6.”
They went on to note that there’s “not much” American Rescue Plan funds left and it’s costly to maintain weekly benefits. The state will be focused on helping with reemployment and upping vaccinations.;
“To adequately address continued claim payments for those not traditionally eligible for unemployment assistance or those facing the completion of available claims weeks, we would need to see further congressional action.”
Congress, however, is highly unlikely to extend unemployment benefits. Democrats are in the early stages of assembling a $3.5 trillion party-line package, but a renewal of unemployment aid hasn’t been seriously considered. Democratic moderates like Sen. Joe Manchin of West Virginia are staunchly opposed.
House progressives like Rep. Alexandria Ocasio-Cortez of New York are discussing whether to push for an extension of jobless aid in the partisan spending plan. But they would face long odds given House Speaker Nancy Pelosi’s focus on crafting a bill that can garner every Democratic senator’s support.
