On Tuesday, Rep. Maxine Waters, D-Calif. and chairwoman of the House Committee on Financial Services, introduced the Protecting Benefits for Disabled Veterans Act, arguing the change is needed to provide assured financial support for veterans who depend on the program.
Codifying the program is needed so that we can ensure all veterans who are unable to secure a job due to a service-related disability receive benefits, Waters said in a statement. It also ensures that veterans are not kicked out of the program simply because theyve earned other benefits, like retiree benefits.
That was a major friction point between veterans advocates and President Donald Trumps administration, which proposed cutting back on the benefit for veterans after they reach retirement age.
Under current rules, the Individual Unemployability program awards payouts at the 100 percent disabled rate to veterans who cannot find work due to service-connected injuries, even if actual rating is less than that. That financial support can top $20,000 a year for some individuals.
The program is aimed largely at working-age veterans, but VA officials said in 2018 that about 225,000 veterans over the age of 60 were also enrolled in the program.

What Are The Vas Criteria For Tdiu Eligibility
TDIU is a total disability rating based on a veterans individual unemployability. When your VA schedular rating is less than 100%, but you can demonstrate that your service-connected impairments obstruct you from getting or maintaining gainful employment, you may be entitled to VA disability compensation at the 100% rate.
Therefore, in order to claim TDIU benefits:
- You must be a recipient of service-connected compensation disability benefits. Of those SC disabilities, you must meet the following minimum requirements :
- One disabling condition is rated at least a 60 percent disability rating, or
- You have two or more disabilities with one rated at least 40 percent and the combined rating for both adding up to at least 70 percent.
- There are cases where your ratings are lower than the above minimums, but you may still qualify for TDIU benefits. Sometimes cases are so exceptional or unusual that the regular rating method used by the VA is insufficient. These cases are known as extra-schedular and require VA to consider various other aspects particular to your case, including your work history, education, periods of hospitalization and your SC disabilities.

How To File For Iu
To get Total Disability based on Individual Unemployability benefits, a Veteran must make sure that their disability claim for the VA includes the following information:
- Clear medical information supporting the Veterans statement regarding their physical and mental health. This should include all the documented information you have, such as medical exam records, hospital records , and outpatient records. If the VA considers your medical information insufficient or inconsistent, they may mandate a C&P exam
- Detailed work history of the five years prior to acquiring the service-connected disability or disabilities preventing the Veteran from sustaining gainful employment, and records of any work performed after acquiring the injury or disability. This should contain information about all work, including sheltered work or work in a family business
- A statement from every employer you have worked for during the year prior to becoming unable to maintain gainful employment
- If you get Social Security Disability benefits, you should include all relevant Social Security Administration information as well
- If you have undertaken the VAs Vocational Rehabilitation and Employment Service , but the vocational rehabilitation was found impractical because of your condition, include all relevant information.
What Is Total Disability Individual Unemployability
On the other hand, extra-schedular rating refers to Total Disability Individual Unemployability. The Veteran has a disability with a rating of less than 100%. However, the VA rater has decided that their Service-Connected disability or combination of disabilities means that the Veteran is unable to find or to maintain substantially gainful employment. If this is the case, the rater will assign the Veteran a TDIU rating. Their pay will be at the 100% rating, even if their disability is less than 100%.
