You may be eligible for PUA, depending on your personal circumstances. A gig economy worker, such as a driver for a ride-sharing service, is eligible for PUA provided that he or she is unemployed, partially employed, or unable or unavailable to work for one or more of the qualifying reasons provided for by the CARES Act. For example, a driver for a ride-sharing service may be forced to quit his or her job if he or she was diagnosed with COVID-19 by a qualified medical professional, and although the driver no longer has COVID-19, the illness caused health complications that render the driver objectively unable to perform his or her essential job functions, with or without a reasonable accommodation. Similarly, under an additional eligibility criterion established by the Secretary of Labor pursuant to 2102, a driver who receives an IRS Form 1099 from the ride-sharing service may qualify for PUA benefits if he or she has been forced to suspend operations as a direct result of the COVID-19 public health emergency, such as if an emergency state or municipal order restricting movement makes continued operations unsustainable. Relatedly, widespread social distancing undertaken in response to guidance from federal, state, or local governments may so severely reduce customer demand for a drivers services as to force him or her to suspend operations, and thus make the driver eligible for PUA.
I Am About To Exhaust My Regular Unemployment Compensation Benefits What Kinds Of Relief Does The Cares Act Provide For Me
Under the CARES Act states are permitted to extend unemployment benefits by up to 13 weeks under the new Pandemic Emergency Unemployment Compensation program. PEUC benefits are available for weeks of unemployment beginning after your state implements the new program and ending with weeks of unemployment ending on or before December 31, 2020. The program covers most individuals who have exhausted all rights to regular unemployment compensation under state or federal law and who are able to work, available for work, and actively seeking work as defined by state law. Importantly, the CARES Act gives states flexibility in determining whether you are actively seeking work if you are unable to search for work because of COVID-19, including because of illness, quarantine, or movement restrictions.
In addition, if you have exhausted the 13 weeks of additional benefits available under the PEUC program, you may be eligible to continue receiving benefits under the PUA program. PUA benefits are available for a period of unemployment of up to 39 weeks, meaning that if you have exhausted regular UC and PEUC benefits in fewer than 39 weeks, you may be eligible to receive assistance under PUA for the remaining weeks within PUAs 39 week period.
One Of My Workers Quit Because He Said He Would Prefer To Receive The Unemployment Compensation Benefits Under The Cares Act Is He Eligible For Unemployment If Not What Can I Do
No, typically that employee would not be eligible for regular unemployment compensation or PUA. Eligibility for regular unemployment compensation varies by state but generally does not include those who voluntarily leave employment. Similarly, to receive PUA, an individual must be ineligible for regular unemployment compensation or extended benefits under state or federal law, or pandemic emergency unemployment compensation, and satisfy one of the eligibility criteria enumerated in the CARES Act, as explained in Unemployment Insurance Program Letter 16-20. There are multiple qualifying circumstances related to COVID-19 that can make an individual eligible for PUA, including if the individual quits his or her job as a direct result of COVID-19. Quitting to access unemployment benefits is not one of them. Individuals who quit their jobs to access higher benefits, and are untruthful in their UI application about their reason for quitting, will be considered to have committed fraud.

Working While Receiving Benefits
Under the EI Act, if you work and receive regular benefits at the same time, you are entitled to earn a certain amount without having your benefits reduced. You can usually earn up to $50 per week or 25% of your weekly benefit, whichever is higher. Any money earned above that amount will be deducted dollar for dollar from your benefits.
However, since August 12, 2018, a Working While on Claim pilot project is in place which changes the way earnings you receive while on claim affect your weekly EI benefits.
Under this pilot project, once you have served the waiting period, if your earnings are equal to or less than 90% of your weekly earnings that were used to calculate your benefit rate, your benefits will be reduced at a rate of 50% of your earnings. Any earnings that exceed this 90% threshold will be deducted dollar for dollar from your benefits.
Under a previous WWC pilot project, if claimants earned less than $75 or 40 per cent of their weekly EI benefits, whichever was greater, their benefits were not reduced. However, benefits were reduced by every dollar earned above this threshold.
As of August 7, 2016, the option to revert to the previous measures is available to all claimants.
The option to revert to the previous pilot project does not apply to Self-Employment Benefits.
If you are working more than one to two days a week and there is the possibility that you may work more, then the current WWC pilot project may be more beneficial for you.
Ready Willing And Able To Work
All states require you to be ready, willing, and able to work to qualify for unemployment. “Ready and willing to work” means you’d accept a job if one was offered to you. You don’t have family commitments, transportation issues, or other personal reasons why you can’t work. “Able to work” means you’re physically and mentally capable of working in other words, you don’t have a disability or other condition that prevents you from holding a job. That means if you’re receiving disability benefits, you probably won’t qualify for unemployment, and vice versa.

Looking For A Suitable Job
Unless you have a good reason not to do so, you must generally do the following:
- apply for a suitable job that becomes vacant
- accept a suitable job offered to you
- take advantage of any opportunities to get a suitable job
- follow any instructions from the Canada Employment Insurance Commission to help you find a suitable job
- attend any interview the Canada Employment Insurance Commission asks you to attend to help you find a suitable job or to see if you need any job training
- attend and complete any course or training program the Commission asks you to attend and that you agreed to attend
You can lose your employment insurance benefits for a period of time if you dont respect these obligations.
You might have to submit reports to Service Canada showing that you are respecting your obligations.
It is a good idea to check with the people handling your employment insurance file to find out about any other specific obligations you may have.

LWA came into existence in response to the expiration of FPUC on July 31, 2020.
The deadline for states to apply for the Lost Wages Assistance Program was Sept. 10, 2020. Payments ended on Dec. 27, 2020.

Within one week of becoming unemployed, you should begin the claims process to receive your Reemployment Assistance benefits. The date your application is finished determines when you will begin receiving benefits. Claims always begin with the Sunday prior to the completion of the application. If you are offered a job that is consistent with your prior training and experience, you must accept the offer or you run the risk that your benefits will be suspended.
