The huge influx of recent unemployment claims were partly caused by the number of people who qualify under this years unique circumstances but who wouldnt under normal circumstances.

The Coronavirus Aid, Relief, and Economic Security Act extends unemployment benefits to many who didnt previously qualify. Independent contractors, freelancers, gig workers, and the self-employed may be eligible for payments through the Pandemic Unemployment Assistance program, established by the CARES Act. Since these types of workers dont pay state unemployment insurance taxes and they dont have employers who pay into the unemployment system, they arent normally eligible for unemployment benefits.

But how you apply for PUA benefits isnt the same across the board. Different states have different procedures and rules on who qualifies for benefits, says Daniel Kalish, managing partner at the national employment law firm HKM Employment Attorneys. The stimulus package included language saying states should be more lenient with who gets extra benefits, but didnt spell out exactly how, says Kalish.

Because there is so much confusion right now surrounding qualification, Kalish has this straightforward advice: If you have had any reduction of your take-home compensation at all, you should apply for unemployment benefits, even if youre unsure whether you qualify. As long as you are honest in your application, there is no negative repercussion for applying. All they can say is no, he says.

The legislation for the 2021 UI extensions limited back dating for new or initial claims to March 14th, 2021 under the latest ARP extension. Further the $300 FPUC weekly supplementary payments would only be over the extension period for weeks you have an active claim that you certify for.

Because you can only get the supplementary FPUC payment while you are getting some form other other unemployment and you need to certify weekly for enhanced unemployment benefits, you can only go back to the date you filed your claim. This should in most cases be backdated to when you lost your job, because one week waiting periods have been waived to get the pandemic unemployment benefits.

How An Overpayment Of Unemployment Insurance Benefits Happens

If you receive unemployment insurance benefits that you arenât entitled to, a notice of overpayment will be sent to you. The notice will request that you return the amount of the overpayment. There can be several reasons why you received these unearned benefits. You may have mistakenly given incorrect information to the state unemployment office.

If you get a job and donât notify the unemployment office that youâre working, you may receive an overpayment as well. While you often can work part-time and still receive UI benefits, your weekly benefit amount will usually be decreased based on those earnings.     The Pandemic Unemployment Compensation program, which temporarily provides an additional $600 weekly to qualified unemployed workers, is an essential benefit in this moment, as it attempts to make up for the fact that UI benefits only replace approximately 40 percent of wages.

    If you were paid more unemployment benefits than you were due through no fault of your own, or the fraud alleged was not committed by you, you can ask the unemployment commission for an unemployment overpayment waiver, which means you don’t have to repay the benefits. If you receive a Notice of Overpayment, you can appeal the repayment requirement. The court will consider the reason for the overpayment, as well as your ability to repay the money.     Retroactive Supplementary Unemployment Insurance $300 Extra Fpuc

    The new stimulus bill provides supplementary unemployment insurance via additional funding for the Federal Pandemic Unemployment Compensation program. This was originally enacted under the CARES act for a weekly $600 payment. A variation of supplementary was then enacted via Executive order under the $300 LWA program. The new $300 FPUC payment for 2021, above and beyond what people get via regular or enhanced pandemic unemployment, will only be retroactive to the start date of the new program extension date in the same manner as the two previous supplementary UI benefit programs.

    Given there is funding for 11 weeks, starting from Dec 27th 2020, it would be retroactive only to that date and for a maximum of eleven weeks. Some had thought Congress may make this payment retroactive to when the LWA expired or to the beginning of December, but in the final bill and per DOL Guidelines it only covered the weeks from December 27th to March 14th.
