Both employers and employees can commit fraud on the unemployment insurance fund. Employers commit fraud by not paying in their fair share. Employees commit fraud by taking out more than their fair share. Unemployment compensation is not funded by general taxpayer funds. It is funded by employers paying into a state fund used to pay former employees who meet certain criteria. Penalties For Unemployment Insurance Fraud

There are both state and federal penalties for fraud crimes. In 2011, the Unemployment Insurance Integrity Act was passed to require states to enhance penalties for fraudulent unemployment claims.

You could be charged with insurance fraud crimes under Article 176 of the NY Penal Code identifying insurance fraud crimes. Title 9 Section 632 of New Yorks unemployment insurance laws also makes it a misdemeanor to willfully make a false statement or misrepresentation for the purposes of obtaining unemployment insurance for yourself or someone else.

Penalties vary depending upon the amount of money involved in the fraud scheme as well as what laws you are charged under. New York Dol Issues Unemployment Fraud Alert Identifies More Than 521000 Fraudulent Claims

BUFFALO, N.Y. In February, 2 On Your Side told you about Megan Davis. She had lost her job a few months prior, and before that she said she found out someone had used her name to file a false unemployment claim.

“And now, eight weeks out from losing my job, I have not had any success navigating the unemployment claims line because of the fraud,” she said.

Then she found out from the state that someone had used her previous name to file a false claim in New Jersey.

“So, there’s two different claims in two different states, under different names, but it’s just me, and now I’m trying to prove my identity to the state,” Davis said.

The Department of Labor has issued an alert making people aware of the dangers of unemployment fraud and information you should know.

First of all, the department says text messages from them will only come from the numbers 468-311 or 22-751.

Plus, the department will never text you or contact you through social media looking for personal information. You should also be on the lookout for websites that resemble the state labor department, but arent.

The state says it cannot give a specific number on how much money is released that turns out to be fraudulent, because it is always changing.

The state has identified more than 521,000 fraudulent unemployment benefit claims during the COVID pandemic.

Apart from unemployment fraud, according to the U.S. Labor Department, New York state overpaid $114 million in unemployment benefits last year.

Report Unusual Correspondence Or Unexpected Cash From State

The state has released guidance on how to spot if youve been a victim of unemployment benefit fraud.

Anyone who receives a monetary determination letter from the Department of Labor, but did not apply for unemployment benefits, should immediately report it to the DOL.

In addition, New Yorkers who receive the letter should take steps to proactively protect themselves, including those listed at report.com

  • Reporting the identity theft to the FTC
  • Filing a report with their local police department, if they wish and
  • Reporting a misused Social Security number.

Types Of Provider Fraud:

Providers: Includes physicians, dentists, pharmacists, home care providers, mental health providers, durable medical equipment suppliers, ambulance companies, medical transportation companies, hospitals nursing homes, and day care providers.

Example:

  • Billing for nonexistent or unnecessary medical services, such as x-rays, laboratory tests or drugs that were never dispensed.
  • Billing for more expensive products or labor intensive services than were provided.
  • Paying kickbacks or providing gifts and other incentives to third parties in exchange for business or referrals to a particular doctor or hospital.
  • Inflating of claimed mileage by transportation companies in order to receive greater reimbursement.
  • Billing Medicaid for transportation to non-Medicaid services.
  • Billing an insurance carrier or patient for the cost of a name brand prescription when a lower costing generic substitute or an over-the-counter drug was instead supplied.
  • Deliberately applying for duplicate reimbursement double billing.
  • Billing for more days in a hospital or nursing home than the patient actually stayed.
  • Billing services for patients who have died.
  • Billing related services separately to charge a higher amount than if services were combined and billed as one service.
  • Billing for used items as new items by durable medical equipment companies.
  • Continuing to send recipients medical supplies when it is no longer medically necessary.

Can You Collect Unemployment From Ny If You Move

The Telephone Claim Center is essentially the customer service line for unemployment benefits in New York state. Thus, while those moving are ineligible to continue receiving benefits from New York state, they can transfer benefit claims rather than undertaking the application process anew in another state.

BUFFALO, N.Y. Despite the pandemic, Buffalo school teacher Terra Bialy never stopped working. Which is why a letter saying she successfully applied for unemployment came as such a shock.

“My employers messaged me this morning saying they got a letter saying I filed for unemployment,” Bialy said, “which is odd because I had been there two days ago.”

“It’s a little disconcerting to think someone was able to get that much accurate information,” Bialy said.

Bialy is not alone, just last week Governor Andrew Cuomo said they are working to stop the fraud, while claiming New York is not suffering as much as others.

“Our level of fraud in the program is much much lower than in most states because we didnt rush it fast and did do verification as fast as we could >

This is something that Senate Republicans are pushing back on. Earlier Tuesday they called for the system to be fixed, while demanding to know exactly how many people have been wrongfully filed for unemployment.

“They’ll tell us how much fraud has been prevented, but not how much fraud has occurred,” State Senator George Borrello said, “other states know how much has been done, New York State does not.”

You May Be A Victim Of Unemployment Identity Theft If You Received:

  • Mail from a government agency about an unemployment claim or payment and you did not recently file for unemployment benefits. This includes unexpected payments or debit cards and could be from any state.
  • A 1099-G tax form reflecting unemployment benefits you weren’t expecting. Box 1 on this form may show unemployment benefits you did not receive or an amount that exceeds your records for the unemployment benefits you did receive. The form itself may be from a state in which you do not live or did not file for benefits.
  • While you are still employed, a notice from your employer indicating that your employer received a request for information about an unemployment claim in your name.

If You Believe You Are A Victim Of Fraud

If you believe your identity has been stolen and a fraudulent unemployment claim has been filed on your behalf, here’s some steps you can take to protect yourself:

  • File a police report with your local police department. Get a copy of the report that you can provide to creditors and credit agencies.
  • Change passwords on your email, banking, and other personal accounts
  • Make a list of credit card companies, banks, and other financial institutions where you do business. Tell them you are a victim of identity theft, and ask them to put a fraud alert on your account.
  • Get a copy of your credit report and dispute any fraudulent transactions. You can request credit reports online from the 3 major credit reporting agencies or by calling 322-8228.
  • Place a with each of the 3 major credit reporting agencies. Call each of the credit reporting agencies at these phone numbers or visit their websites to freeze your credit.

    If Targeted For Fraud

    The Department of Labor has issued recommendations about possible fraud. Labor officials say:

    New Yorkers who receive a monetary determination letter but did not seek unemployment from the Labor Department should immediately report to on.ny.gov/uifraud. They should also take steps to protect their identity, such as changing passwords for bank accounts, report the incident to police, and place a fraud alert with credit bureaus.

    After reporting suspected fraud through the online form, individuals will receive an email confirmation that the Labor Department has received the report. Labor officials will only call the individual if the Office of Special Investigations needs more information about the reported fraud.

    “It is very likely that individuals may receive additional mail, emails, text messages, and/or a debit card after the report has been filed,” according to the Labor Department. “While fraudulent claims are stopped immediately, the communication, printing, and mailing process may continue for weeks or months later. Individuals do not need to send a report for each piece of communication received.”
