Work Search Requirement Reinstated

On Sunday, July 4, Maryland LABOR reinstated the standard active search for work requirement for all claimants receiving regular unemployment insurance benefits. Claimants receiving benefits under the Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation federal programs must meet the active search for work requirement beginning Sunday, July 18, 2021.

All claimants must actively search for work by completing at least three valid reemployment activities each week, which must include at least one job contact. Claimants must satisfy the active search for work requirement to maintain their eligibility for UI benefits.

Valid reemployment activities are intended to help a claimant become reemployed and remove potential barriers to employment. Qualifying activities include, but are not limited to: activities completed through the Maryland Workforce Exchange , such as setting up a virtual recruiter or completing a skills self-assessment attending networking events creating a résumé in MWE and attending employment events held by the Maryland Division of Workforce Development and Adult Learning . Job contacts refer to actions a claimant takes to contact employers in an attempt to secure employment. Acceptable job contacts include: submitting a job application to an employer interviewing for a job or completing a pre-screening for a job interview among other actions.

Traditional unemployment benefits in Texas are typically available to people who have been laid off from their jobs or who have lost hours or wages for reasons that arent tied to employee misconduct. They are funded through employer taxes and meant to provide a temporary, partial income replacement for people who meet certain qualifications.

Melissa Jacobs, an attorney with Texas RioGrande Legal Aid, says generally, people who are separated from work through no fault of their own qualify for some type of assistance.

State unemployment systems across the country have changed, however, during the coronavirus pandemic. The CARES Act, a federal law passed in March, has temporarily made many more workers whove been affected by COVID-19 eligible for unemployment assistance than would be otherwise under Texas law. Those workers include independent contractors, gig workers, people who have already used up their unemployment benefits and people who didnt earn enough in the past to qualify for regular unemployment. What You Need To Know

  • Update 12/29/20: The federal government has extended the federal unemployment benefit programs available through the CARES Act for an additional 11 weeks. Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation will be available through March 14, 2021, with qualified claimants benefits fully phasing out by April 5, 2021. Federal Pandemic Unemployment Compensation benefits will resume with $300 weekly payments until March 14, 2021.

  • To receive these extended federal benefits, continue to certify weekly while unemployed. To allow your fellow New Yorkers to reach NYS DOL representatives about regular matters, please do not call to inquire about the federal program extensions at this time. As we receive additional guidance on the federal programs from US DOL, we will provide updates on our website, social media platforms, and directly via emails and texts.

  • Waiting weeks for unemployment benefits have been waived during this crisis. If youve seen the term waiting week on your payment history, it is a relic of our existing system and does NOT impact your benefits.
  • To collect regular unemployment insurance benefits, you must be ready, willing, and able to work. We understand that many of you are unable to work due to the COVID-19 pandemic and the impact of NYS on PAUSE. If you would otherwise be able to work, you should answer ‘YES’ in order to receive your benefits.

Opening A New Benefit Year

What is a benefit year?

When a claimant opens a new initial claim, that claim last for 12-months. During that year-long period, the claimant can file weekly certifications , for benefits during weeks in which they are unemployed or partially unemployed. When the 12-month benefit year ends, the claimant must reapply for benefits by submitting a new initial claim application. This allows the Department to reevaluate the claimants eligibility and set a new benefit amount based on earnings during the prior year.

How to Open a New Benefit Year

STEP 1: Identify when your benefit year ends. This can be found by logging into your online claimant portal. Benefit years always end on Saturday . DO NOT open a new benefit year on the same day the benefit year expires.

STEP 2: After the benefit year expires , file the final weekly claim under the old benefit year, once the benefit week has ended, as you normal would . Because each weekly claim represents time worked and wages earned for the prior week, claimants will be able to file the final weekly claim before opening a new benefit year. It is important to file the final weekly claim before opening a new benefit year to avoid processing errors. DO NOT open a new benefit year on the same day you submit your final weekly claim.

What Time Does Unemployment Offices Open

To apply for Unemployment Insurance benefits, you need to provide personal information including your Social Security number, birth date, home address, email address , and phone number.

You also need information about your employment history from the last 15 months, including:

  • Names of all employers, plus addresses and phone numbers
  • Reasons for leaving those jobs
  • Work start and end dates
  • Recall date

You may need additional information in certain situations:

  • If you are not a U.S. citizen your Alien Registration number
  • If you have children their birth dates and Social Security numbers
  • If youre in a union your union name and local number
  • If you were in the military your DD-214 Member 4 form. If you dont have it, you can request your DD-214 online.
  • If you worked for the federal government your SF8 form

To receive payments by direct deposit, youll also need your bank name, account number, and routing number. Otherwise, the Department of Unemployment Assistance will send you a debit card.

If youre a non-U.S. citizen applying for UI benefits, DUA must verify that you are legally authorized to work in the United States. Non-English speakers can apply for UI in their own languages on DUA’s foreign language application site.

What Happens During The Appeals Hearing

Upon receiving the appeal, the agency sends a notice of a telephone hearing. That lists your hearing officer who amounts to the judge in the case. Legal representation is optional. You can have someone represent you, but the TWC does not provide a lawyer. You also may call witnesses, and your most recent employer may also appeal and participate in the hearing. The hearing officer has your documents in front of them and asks a series of questions, and you are provided an opportunity to lay out your case. Ahead of your hearing, the TWC recommends gathering the following materials to have on hand:

  • Letters and memos.
  • Maps, charts and diagrams.
  • Performance record.

Angeline Stevens, the welding teacher in Dallas, appealed a TWC finding. She recommends having on hand a history of your pay stubs, termination letters and/or any written correspondence youve had with your previous employer.

Any of the relevant documents you want to present during the hearing must be provided to the hearing officer listed on your appeal hearing notice. The agency recommends sending relevant documents as far in advance as possible. You should not include documents already included in the hearing information packet.

What Are The Unemployment Qualifications In Indiana

To qualify for unemployment benefits in Indiana, you must meet several qualifications before being granted unemployment payments. There are three specific requirements mandated by the Indiana unemployment department that impact whether or not you qualify for unemployment:

Requirement #1: You are able to work.

Indiana unemployment laws require you to be able to find new work before you can receive benefits.

  • You must be able to work.
  • You must be available to work.
  • You must be actively searching for a full-time job.

Requirement #2: You lost your job through no fault of your own.

  • Did you quit your job voluntarily? If so, and your reason for quitting was not work-related, you cannot receive benefits. Work-related reasons for quitting that still allow you to qualify for unemployment benefits include the following:
  • Worksite safety violations
  • Unreasonable changes to your work duties or conditions
  • Military service
  • Moving to follow a spouse who has accepted a new job
  • Harassment, family violence, or domestic abuse

Requirement #3: You earned enough during your base period.

For your claim to be valid, you must have earned at least 1.5 times the amount of your highest-quarter wages in your base period and have made at least $2,500 in the final six months of that period.

Reapplying For Unemployment Insurance Benefits

If you are not able to file your weekly claim certification this week, please check your BEACON portal to see if you have an âApply for Benefitsâ button. If you have this button, there could be several reasons including, but not limited to:

  • You did not apply for benefits last week,
  • Your benefit year has expired , or
  • Your monetary eligibility needs to be redetermined.

Even if your account is active and you have a balance, if you have an âApply for Benefitsâ button, then you need to re-apply for benefits to be able to file your weekly certification as required by Maryland unemployment law and federal program rules.

If you wish to re-apply for benefits, you should access your BEACON portal from an internet browser, click on the âApply for Benefitsâ link on your home page, and follow the steps. You cannot complete this process from the MD Unemployment for Claimants Mobile App.

Reminder: Claimants have through Saturday, June 12 to file their weekly certification for the week. If you have successfully filed your weekly certification this week, please ignore this message. There are no issues with the BEACON system.
