WASHINGTON With millions of Americans now receiving taxable unemployment compensation, many of them for the first time, the Internal Revenue Service today reminded people receiving unemployment compensation;that they can have tax withheld from their benefits now to help avoid owing taxes on this income when they file their federal income tax return next year.

Withholding is voluntary. Federal law allows any;recipient to choose to have a flat 10% withheld from their benefits to cover part or all of their tax liability. To do that, fill out Form W-4V, Voluntary Withholding Request, and give it to the agency paying the benefits. Don’t send it to the IRS. If the payor has its own withholding request form, use it instead.

If a;recipient doesn’t choose withholding, or if withholding is not enough, they can make quarterly estimated tax payments instead. The payment for the first two quarters of 2020 was due on July 15. Third and fourth quarter payments are due on September 15, 2020, and January 15, 2021, respectively. What If My 1099

According to the IRS, taxpayers who receive an incorrect Form 1099-G for unemployment benefits they did not receive should contact the issuing state agency to request a revised Form 1099-G showing they did not receive these benefits. Taxpayers who are unable to obtain a timely, corrected form from states should still file an accurate tax return, reporting only the income they received. The department of labor keeps a directory of each states unemployment office and its website.

In some cases, an incorrect 1099-G form might indicate that you have been the victim of unemployment fraud, which has been a growing problem. Here is how to recognize if this has happened to you.

Income Taxes Vs Fica Taxes

Unemployment compensation is not subject to FICA taxes, the flat-percentage Social Security and Medicare taxes that would normally be withheld from your paycheck if you were working.

You’ll still pay significantly less in FICA taxes than you would have had you been working if you collected unemployment through a significant part of the year.

What To Do If You Have Filed Already

If you collected unemployment insurance in 2020 but you already filed your tax return, you are still eligible for the exemption under the American Rescue Plan. You do not need to take any action to claim the money youre owed. Instead, the IRS will automatically refund the money.;

The first round of payments will begin in May and continue over the summer, according to the IRS. Youll either receive a refund or the amount will be deducted from your taxes owed.

There is no need for taxpayers to file an amended return unless the calculations make the taxpayer newly eligible for additional federal credits and deductions not already included on the original tax return, the agency noted in a recent release.;

This includes, for example, taxpayers who claimed the Earned Income Tax Credit but are eligible for an increased credit under the new exemption. While youll automatically get a refund for the exemption, youll need to file an amended return to get a larger credit.

Can I Have Taxes Withheld From Unemployment Payments

Yes. State unemployment agencies allow you to have federal and state taxes taken out of your unemployment checks, and the IRS recommends you do this to avoid surprise tax bills. You can set this up when you first apply for unemployment, or at any point while you are receiving it, by filing Form W-4V. Most states allow you to do this online as well, and their unemployment websites are listed on a Department of Labor directory.

If you had federal taxes withheld from your unemployment benefits throughout the year, its possible the new $10,200 exemption will make you eligible for a refund. The IRS will automatically calculate this and give you a refund if necessary.

Important: The $10,200 unemployment tax exemption only applies to 2020. If you are receiving unemployment benefits at any point in 2021, setting up a withholding now may save you from a surprise tax bill next year.

Preparing Your Tax Return Now

If you are preparing you own tax return, you must determine if you are eligible for the exclusion by considering whether your AGI is less than $150,000. Filing electronically is the easiest way to calculate the correct amount. The IRS has worked with the tax return preparation software industry to reflect these updates so people who choose to file electronically simply need to respond to the related questions when electronically preparing their tax returns. State Vs Federal Taxation

Youll get even more relief if you live in a state that doesnt tax unemployment benefits. Otherwise, youll owe tax on your benefits to both the IRS and your state government.

What If I Need More Time

Maybe you lost tax documents, experienced a family emergency or just procrastinated. Regardless of the issue, you can still get an extension to file until Oct. 15.

Filing an extension when you owe taxes only gives you more time to file, not more time to pay. That means your payment is still due at the tax filing deadline.

So if you don’t pay your estimated tax due by Monday, the IRS will charge you interest on the unpaid balance.

Failure-to-file penalties can add up to 25% of the tax due, according to TurboTax.;If you file an extension but miss the extended deadline, you will be subject to this penalty.

To file an extension, submit IRS Form 4868 electronically by the filing deadline on May 17. You can also do it free using any of the Free File software offered by the major tax preparation companies. These often help you estimate your tax due so you can make a payment.;

Another option is to print out the form and send it to the IRS address for your state by the deadline.

When Harwood explained the situation to her daughter who had been expecting a refund to put toward a new car she “started to cry,” Harwood said.
