Paying Taxes When You Are Unemployed
Unless the federal and/or state governments act to change the law, youll likely have to pay federal income tax on the unemployment compensation you receive while out of work because of COVID-19.
You have multiple options for paying your taxes when youre unemployed.
You can choose to have federal income taxes withheld from your unemployment compensation when you apply for unemployment benefits, or you can choose not to do so and just pay estimated taxes each quarter to avoid a tax bill when you file your return.
Of course, you could also wait until you file your taxes and pay any tax you owe at that time. But you may want to think long and hard before choosing that option, especially if youre worried you may continue to struggle financially even after the COVID-19 crisis subsides. The federal tax system is pay-as-you-go, so youre supposed to pay taxes on income as you receive it throughout the year. If you dont pay enough throughout the year, a big tax bill in April might not be your only worry. You could also face a penalty for underpaying your estimated taxes.
If your total income for the year including wages, unemployment benefits, interest, retirement distributions and all other income you made is less than the standard deduction for your filing status, you normally arent required to file a tax return, says Christina Taylor, senior manager of tax operations for Credit Karma TaxÂ®. In that case, you might not need to have tax withheld from your unemployment.
Information Needed For Your Federal Income Tax Return
Each January, we mail an IRS Form 1099-G to individuals we paid unemployment benefits during the prior calendar year. The 1099-G form provides information you need to report your benefits. Use the information from the form, but do not attach a copy of the 1099-G to your federal income tax return because TWC has already reported the 1099-G information to the IRS. You can file your federal tax return without a 1099-G form, as explained below in Filing Your Return Without Your 1099-G.
A 1099-G form is a federal tax form that lists the total amount of benefits TWC paid you, including:
- Unemployment benefits
- Federal income tax withheld from unemployment benefits, if any
- Alternative Trade Adjustment Assistance and Reemployment Trade Adjustment Assistance payments

If you are eligible for a stimulus check and it was lost, stolen or destroyed, you should request a payment trace so the IRS can determine if your payment was cashed.
If a trace is initiated and the IRS determines that the check wasn’t cashed, the IRS says it will credit your account for it but the IRS cannot reissue the payment. Instead, you will need to claim the Recovery Rebate Credit on your 2020 tax return if eligible.
“If you are filing your 2020 tax return before your trace is complete, do not include the payment amount on line 16 or 19 of the Recovery Rebate Credit Worksheet,” the IRS says. “You may receive a notice saying your Recovery Rebate Credit was changed, but an adjustment will be made after the trace is complete.If you do not request a trace on your payment, you may receive an error when claiming the Recovery Rebate Credit on your 2020 tax return.”

If You Included Your Unemployment Income Already The Irs Wont Require You To File An Amended Tax Return In Most Cases
Since we are in the middle of tax season, you may have already filed and claimed your full unemployment benefits on your tax return.
According to the IRS, more than 23 million Americans filed for unemployment last year. On March 31, the IRS announced taxpayers who have already filed would not have to resubmit their tax returns in most cases the IRS will adjust qualifying returns automatically in two phases.
The IRS will start with single taxpayers who qualify for the tax break and then process taxpayers who filed jointly. It estimates that taxpayers will begin to receive tax refunds as early as May, and the agency will continue to process refunds through the summer. If you owe taxes, the IRS will apply any adjustment to outstanding taxes due.
However, if you expect your tax return adjustment makes you eligible for a tax credit or an increase of a tax credit previously claimed, you will need to file an amended tax return to claim the credit.
For example, lets say, for instance, you qualify for the Earned Income Tax Credit . However, because of the unemployment tax break, your income has changed and you may now be eligible for a higher credit. In this instance, the IRS requests you to file an amended tax return to claim the increase or any other credit you may now be entitled to due to the reduction of income.

How Taxes On Unemployment Benefits Work
You should receive a Form 1099-G from your state or the payor of your unemployment benefits early in 2022 for the unemployment income you received in 2021. The full amount of your benefits should appear in box 1 of the form. The IRS will receive a copy of your Form 1099-G as well, so it will know how much you received. You dont have to include the form when you file your federal return, but you do if your state requires it.
Unemployment benefits arent subject to Medicare or Social Security taxes, only income tax. This may help reduce your overall tax burden in the year you claim them.
When youre ready to file your tax return for 2021, write the amount stated in box 1 of your Form 1099-G on line 7 of Schedule 1, Additional Income and Adjustments to Income. You must file Schedule 1 with your Form 1040 or 1040-SR tax return. Line 7 is clearly labeled, Unemployment compensation. The total amount from the Additional Income section of Schedule 1, line 10, is then entered on line 8 of your tax return.
You must report your unemployment benefits on your tax return even if you dont receive a Form 1099-G. Go to your states website if you didn’t receive one and think you should havesome states may not mail out paper versions of the form. The form is usually available electronically, but you can also call your state unemployment office.
Reporting and investigating an incorrect or fraudulent Form 1099-G in your name will probably slow down the processing of your tax return.

Types Of Unemployment Tax Breaks
In the past, you could deduct a number of expenses related to your job search, like transportation, relocation costs, and seminar fees. Unfortunately, these deductibles were eliminated by the 2017 Tax Cuts and Jobs Act. But there are still certain ways you can find financial relief during unemployment.
Reporting Unemployment Benefits On Your Tax Return
You report your unemployment compensation on Schedule 1 of your federal tax return in the Additional Income section. The amount will be carried to the main Form 1040. Remember to keep all of your forms, including any 1099-G form you receive, with your tax records.

I Forgot To File Unemployment On My Taxes
If you have already filed your return, youâll need to wait for your tax return to either be rejected or accepted, if it is rejected you can add your Form 1099-G, correct any other errors on the return and resubmit it. If it is accepted, you will need to amend your return to include the Form 1099-G.
Please be aware that Form 1040X will not be available to prepare in TurboTax until mid-February, but once it is available, you will be able to prepare and print your amended return so that you can mail it to the IRS. You cannot e-file an amended return as this cannot be filed electronically. The form is only filed on paper, so it will need to be printed and filed by mail.

How To Prepare For Your 2020 Tax Bill
Contact your unemployment office immediately if you do owe tax on your unemployment benefits and are concerned about being able to pay. You can start having income tax withheld from your payments if you havent already done so and if youre still collecting.
If youre still collecting unemployment benefits, see if you can opt in to having federal and state taxes withheld, Capelli said.
It probably wont solve your whole problem with the 10% withholding cap in place, but it will somewhat defray the impact of those benefits being included in your income. Ask for Form W-4V, fill it out, and file it with your unemployment office.

How To Pay Federal Income Taxes On Unemployment Benefits
Perhaps the easiest way to pay taxes on unemployment compensation is to have federal income taxes withheld from your weekly payments. To have federal income taxes withheld, file Form W-4V with your states unemployment office to instruct them to withhold taxes.
If you request tax withholding, the state will withhold 10% of each paymentno other amounts or percentages are allowed.
Another option is to make estimated quarterly payments by mailing a check with Form 1040-ES or making a payment online via IRS Direct Pay. However, this option is fairly high maintenance compared to having tax withheld from your unemployment benefits.
First, you need to estimate the amount youll owe using your tax software or the worksheet accompanying Form 1040-ES. Then you need to make four quarterly payments, generally due April 15, June 15, September 15, and January 15 of the following year.
The final option is to wait until you file your tax return to see how much youll owe. However, this option can be risky because it can leave you with a large tax bill and underpayment penalties in April.

However, if you received any jobless benefits at all last year, you might be in for a shock when you file your taxes.

New Exclusion Of Up To $10200 Of Unemployment Compensation
If your modified adjusted gross income is less than $150,000, the American Rescue Plan enacted on March 11, 2021, excludes from income up to $10,200 of unemployment compensation paid in 2020, which means you dont have to pay tax on unemployment compensation of up to $10,200. If you are married, each spouse receiving unemployment compensation doesnt have to pay tax on unemployment compensation of up to $10,200. Amounts over $10,200 for each individual are still taxable. If your modified AGI is $150,000 or more, you cant exclude any unemployment compensation. If you file Form 1040-NR, you cant exclude any unemployment compensation for your spouse.
The exclusion should be reported separately from your unemployment compensation. See the updated instructions and the Unemployment Compensation Exclusion Worksheet to figure your exclusion and the amount to enter on Schedule 1, line 8.
When figuring the following deductions or exclusions from income, if you are asked to enter an amount from Schedule 1, line 7 enter the total amount of unemployment compensation reported on line 7 and if you are asked to enter an amount from Schedule 1, line 8, enter the amount from line 3 of the Unemployment Compensation Exclusion Worksheet. See the specific form or instructions for more information. If you file Form 1040-NR, you arent eligible for all of these deductions. See the Instructions for Form 1040-NR for details.
Unemployment Taxes At The Federal Level
At the federal level, unemployment benefits are counted as part of your income, along with your wages, salaries, bonuses, etc. and taxed according to your federal income tax bracket.
With most income, like wages, taxes are pay-as-you-go. With wages, you are expected to pay taxes on your income as you earn it. As an employee, part of your paycheck is usually automatically deducted to pay your federal income and Social Security taxes. Unlike wages, federal income taxes are not automatically withheld on unemployment benefits.

What About The Tax Break For People With Children That Was In The American Rescue Plan
The bill passed by Congress includes an extra $1,000 deduction for each child 17 and younger in a household for 2021. That means qualified families with children in that age range would receive a total of $3,000 for each child, Oware said.
But its a 2021 break and cant be claimed on this years tax returns, he said. However, the IRS is supposed to start sending families the money sometime between July and December, although a timetable has not been set.

Eligibility For Unemployment Benefits
The first big question to tackle is to see if you qualify for unemployment benefits. Though the Department of Labor administers the guidelines, each state has its own separate requirements to qualify.
There are generally two requirements youll have to meet:

How Much Are Unemployment Benefits Taxed
At the federal level, unemployment benefits are treated the same as other types of ordinary income. The federal income tax brackets, which range from 10% to 37%, will determine how much you pay.
Which bracket you fall into depends on your total income minus deductions and credits, with the rate youll pay being determined on a per-dollar basisyou wont pay the same rate for every dollar you made during the year.
It works something like this: If you file as single in 2020, you can automatically receive a $12,400 standard deduction, which reduces your taxable income. As a result, you wont have to pay any federal income taxes on the first $12,400 you makeyou might not even have to file a federal tax return. The next $9,875 you make falls into the 10% tax bracket, with the 12% bracket after that covering income from $9,876 to $40,125, and so on .
As the amount you earn climbs, new earnings are pushed into new brackets, but the rate that applies on lower-dollar earnings stays the same. Even if you make $1 million in a year, you still receive the standard deduction, pay 10% on the first $9,875, 12% on the next portion, on up to the top tax rate of 37% for income above $518,400.
As a result, your unemployment benefits may be taxed federally anywhere from 0% to 37%.
What To Do If You Already Filed Taxes But Want To Claim The $10200 Unemployment Tax Break
A valuable tax exemption emerging during the heart of tax season is a potential windfall and a new curveball for people trying to get back on their feet after a financially devastating year.
Even though jobless benefits count as income for tax purposes, the newly-signed $1.9 trillion American Rescue Plan will not impose federal income tax on the first $10,200 in unemployment benefits a person received last year.
The exemption applies for households with adjusted gross incomes below $150,000.
Here is the windfall first: The provision could result in individual household tax savings between $1,000 and $2,000, depending on some different estimates.
Here is the curveball: The provision is becoming law after Americans have already filed 55.7 million tax returns with the Internal Revenue Service as of March 5.
Its safe to say at least some of these returns came from people racing for a badly-needed tax refund after a tough 2020 that sent them to the unemployment line. Now, they have filed their taxes before accessing an exemption meant to help people like them.
Taxpayers who received jobless benefits and have not filed their income taxes should try to wait a little longer, experts told MarketWatch.
Taxpayers who have already filed should also wait, they say. But these people should be prepared to possibly file an amended income tax return that will claim the exemption, the observers added. Thats accomplished with the Form 1040-X.
