  • Update 12/29/20: The federal government has extended the federal unemployment benefit programs available through the CARES Act for an additional 11 weeks. Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation will be available through March 14, 2021, with qualified claimants benefits fully phasing out by April 5, 2021. Federal Pandemic Unemployment Compensation benefits will resume with $300 weekly payments until March 14, 2021.

  • To receive these extended federal benefits, continue to certify weekly while unemployed. To allow your fellow New Yorkers to reach NYS DOL representatives about regular matters, please do not call to inquire about the federal program extensions at this time. As we receive additional guidance on the federal programs from US DOL, we will provide updates on our website, social media platforms, and directly via emails and texts.

  • Waiting weeks for unemployment benefits have been waived during this crisis. If youve seen the term waiting week on your payment history, it is a relic of our existing system and does NOT impact your benefits.
  • To collect regular unemployment insurance benefits, you must be ready, willing, and able to work. We understand that many of you are unable to work due to the COVID-19 pandemic and the impact of NYS on PAUSE. If you would otherwise be able to work, you should answer âYESâ in order to receive your benefits.

Ial Unemployment Benefit Amounts: How Much Will You Receive

To figure out your weekly benefit amount, your state’s unemployment agency will calculate how much you would receive if you were completely unemployed.

Then, the state will subtract what you are actually earning each week, less a small allowance. Most states let applicants keep a little bit of what they earn, without reducing their benefit amounts, to encourage people to take occasional work. The difference is your weekly partial unemployment benefit.

Here are a couple of examples:

Example 1. David works in California and would be entitled to a weekly unemployment benefit of $400, based on his prior earnings. He currently earns $280 per week at his job because his hours and pay have been cut. California disregards the first $25 or one-quarter of an employee’s earnings in calculating partial unemployment benefits. The state would not count one-quarter of his earnings , but would subtract the rest from the weekly benefit he would receive if he were unemployed to come up with his partial benefit amount: $190.

Us Department Of Labor Publishes Guidance On Pandemic Unemployment Assistance

ALTIUS

WASHINGTON, DC The U.S. Department of Labor today announced the publication of Unemployment Insurance Program Letter 16-20 providing guidance to states for implementation of the Pandemic Unemployment Assistance program. Under PUA, individuals who do not qualify for regular unemployment compensation and are unable to continue working as a result of COVID-19, such as self-employed workers, independent contractors, and gig workers, are eligible for PUA benefits. This provision is contained in Section 2102 of the Coronavirus Aid, Relief, and Economic Security Act Act enacted on March 27, 2020.

PUA provides up to 39 weeks of benefits to qualifying individuals who are otherwise able to work and available for work within the meaning of applicable state law, except that they are unemployed, partially unemployed, or unable or unavailable to work due to COVID-19 related reasons, as defined in the CARES Act. Benefit payments under PUA are retroactive, for weeks of unemployment, partial employment, or inability to work due to COVID-19 reasons starting on or after January 27, 2020. The CARES Act specifies that PUA benefits cannot be paid for weeks of unemployment ending after December 31, 2020.

The UIPL also includes guidance to states about protecting unemployment insurance program integrity. The department is actively working with states to provide benefits only to those who qualify for such benefits.

Can I Collect Unemployment Benefits If I Have Been Laid Off Temporarily

Unemployment Benefits and Temporary Layoffs

As previously discussed, the pandemic has caused an unprecedented number of workers to apply for unemployment benefits. Some workers were permanently laid off, while others are still awaiting a decision from their company as to whether their temporary layoff period will convert to a permanent one.

In addition, the pandemic has also made it possible for workers who normally are not allowed to collect unemployment benefits, such as independent contractors and those who are self-employed, to receive them. Under the CARES Act of 2020, if an individual was temporarily or permanently laid off from their job because of the coronavirus, then they may be eligible to collect unemployment benefits from the state in which they work.

Depending on the laws of a particular state, an individual is usually permitted to collect unemployment benefits during the period in which they are temporarily laid off if their employer is not already paying them in full for a mandated layoff period. This may be true even in instances where a business regularly plans for seasonal layoffs. Such a scenario is very common in some states like Alaska.

In other states, however, if an individual is given the opportunity to work somewhere else, such as a different branch of their company, and they reject their employerââ¬â¢s offer, then it could mean forfeiting their right to collect unemployment benefits for that time frame.

One Of My Workers Quit Because He Said He Would Prefer To Receive The Unemployment Compensation Benefits Under The Cares Act Is He Eligible For Unemployment If Not What Can I Do

How To Apply For Partial Unemployment Benefits Nj

No, typically that employee would not be eligible for regular unemployment compensation or PUA. Eligibility for regular unemployment compensation varies by state but generally does not include those who voluntarily leave employment. Similarly, to receive PUA, an individual must be ineligible for regular unemployment compensation or extended benefits under state or federal law, or pandemic emergency unemployment compensation, and satisfy one of the eligibility criteria enumerated in the CARES Act, as explained in Unemployment Insurance Program Letter 16-20. There are multiple qualifying circumstances related to COVID-19 that can make an individual eligible for PUA, including if the individual quits his or her job as a direct result of COVID-19. Quitting to access unemployment benefits is not one of them. Individuals who quit their jobs to access higher benefits, and are untruthful in their UI application about their reason for quitting, will be considered to have committed fraud.

If desired, employers can contest unemployment insurance claims through their state unemployment insurance agencys process.

Weather Related Unemployment: Whats The Difference

First things first: do not confuse seasonal unemployment with a weather-related job disruption. While there are jobs that entail seasonal unemployment caused by weather , these should be viewed as seasons, therefore the layoffs are due to seasonal demands.

Weather-related unemployment only becomes valid when a weather-induced disruption causes loss in wages or outright unemployment. A lifeguard who goes home for the winter is not the same as a construction worker laid off for a few weeks because of snow. In this scenario, the construction worker would qualify for unemployment benefits, but not the lifeguard.

Temporary Work And Total Unemployment Benefits

The amount of compensation you can receive through unemployment benefits is typically calculated based on your wages during a 12-15 month period leading up to your first day of unemployment. This time frame is considered the base period. It is advantageous to maintain employment regularly during this period, as it lowers the total amount, which lessens your eligible compensation rate.

I Was Furloughed By My Employer But They Have Now Reopened And Asked Me To Return To My Job Can I Remain On Unemployment

No. As a general matter, individuals receiving regular unemployment compensation must act upon any referral to suitable employment and must accept any offer of suitable employment. Barring unusual circumstances, a request that a furloughed employee return to his or her job very likely constitutes an offer of suitable employment that the employee must accept.

While eligibility for PUA does not turn on whether an individual is actively seeking work, it does require that the individual be unemployed, partially employed, or unable or unavailable to work due to certain circumstances that are a direct result of COVID-19 or the COVID-19 public health emergency. In the situation outlined here, an employee who had been furloughed because his or her employer has closed the place of employment would potentially be eligible for PUA while the employer remained closed, assuming the closure was a direct result of the COVID-19 public health emergency and other qualifying conditions are satisfied. However, as soon as the business reopens and the employee is recalled for work, as in the example above, eligibility for PUA would cease unless the individual could identify some other qualifying circumstance outlined in the CARES Act.
