How Much Can You Receive

The maximum payment you can receive from the state of California as an unemployment benefit is $450 per week. But as we have mentioned in the paragraph directly above, the amount of money a person can receive depends on his earnings for 3 months while he was working, before he became unemployed.

That raises a question: what happens when a person finds some part-time work? How much work is considered part-time work? How much money can a person make and still collect unemployment benefits in California?

Pandemic Emergency Unemployment Compensation

States typically provide people with 26 weeks of unemployment benefits. But the CARES Act expanded that timeline under the PEUC, allowing individuals to claim benefits for an additional 13 weeks. But the law stated that people must be “able to work, available to work, and actively seeking work.”

These benefits were extended to 24 weeks with the passage of the CAA in December 2020. The Biden Administration changed that again in March 2021 to 53 weeks, and the PEUC expired on Sept. 6, 2021.

How Much Will You Receive

Although each state uses its own formula to calculate benefits, all states use the applicant’s prior earnings in their calculations. Because unemployment compensation is intended to partially replace your income, the amount you will receive depends on how much you used to earn. Most states use an applicant’s earnings during the highest paid calendar quarter of the base period as a starting point . Some states use the two highest paid quarters of the base period others look at the applicant’s prior annual earnings.

Once this amount is calculated, the state then uses a multiplier, based on what percentage of wages it replaces, to come up with a weekly benefit amount. For example, a state that uses the applicant’s highest paid quarter and replaces half of the applicant’s wages would multiple the total earnings in the highest paid quarter by 1/26 to come up with a weekly benefit amount.

This isn’t the last step in the process, however: Every state also has minimum and maximum benefit amounts. No matter how much you used to earn, you can’t collect more than the maximum weekly amount. Some states also pay a bit more per week to applicants with dependents.

More From Smart Tax Planning:

Here’s a look at more tax-planning news.

This means households that didn’t withhold federal tax from benefit payments may owe a tax bill or get less of a refund this season to make up the difference.

In 2020, the Covid-19 pandemic led the U.S. unemployment rate to spike to its highest level since the Great Depression. Roughly 40 million people got benefits that year, collecting $14,000 each, on average, according to The Century Foundation. However, less than 40% of payments had taxes withheld, the group estimated.

The U.S. economy and job market have rebounded significantly since then. Claims for unemployment benefits at the end of December had fallen to pre-pandemic levels, a roughly fourfold reduction from the beginning of the year. While there are still about 4 million fewer jobs relative to early 2020, the 4.2% national unemployment rate is at its lowest since February 2020.

The IRS is still processing tax refunds for thousands of households that qualified for the American Rescue Plan tax break. Many people filed their tax returns before President Joe Biden signed the legislation, meaning they overpaid their tax bill.

State Income Taxes On Unemployment Benefits

It may not be just the IRS you have to worry about. Many states tax unemployment benefits, too. There are several that do not, though California, Montana, New Jersey, Pennsylvania, and Virginia do not charge taxes on unemployment benefits. Arkansas and Maryland will not charge state taxes on unemployment benefits received in tax year 2021.

Eight states dont tax any income at all, so youll be spared if you live in Alaska, Florida, Nevada, South Dakota, Tennessee, Texas, Washington, or Wyoming. New Hampshire doesnt tax regular income it only taxes investment income.

% To 40% Of Jobless Americans Are Making More On Unemployment Than They Did At A Job

by Maurie Backman | Updated July 30, 2021 – First published on July 26, 2021

Boosted unemployment benefits are giving many workers a higher paycheck now than they used to collect.

In mid-March, the American Rescue Plan was signed into law, and the giant relief package did a lot of important things for the public — it put $1,400 stimulus checks into recipients’bank accounts, expanded the Child Tax Credit, and boosted unemployment benefits by $300 a week through the beginning of September.

At this point, those collecting unemployment should, in theory, have another four months of boosted benefits to help them along. But in 25 states, the boost is going away — and in some states, that’s happening this month.

Why are state lawmakers pulling the plug on that $300 weekly increase? It largely boils down to labor shortages and fear of halting progress on the economic recovery front. Lawmakers are concerned that if the jobless continue to get an extra $300 a week in unemployment on top of their regular state benefits, they won’t be motivated to go out and find work.

But when we compare what some jobless workers are making on unemployment vs. what they made at their old jobs, it might be true that many unemployed people are doing better financially now than they were while working. And that speaks to a greater problem beyond the decision to pull boosted unemployment benefits or not.

What To Do If You’re Still Waiting For Unemployment

Avoiding Common Unemployment Mistakes

People across the country are reporting that they are still waiting for benefits, even in June. That’s painful for millions of Americans.

Sadly, the state unemployment systems were not designed for this type of event, but some states definitely made their programs and systems worse than others. I hope you vote in November and hold your elected officials accountable for their poor actions leading up to this event.

But, what can you do now?

First, make sure you use the online portal for your claim if possible. Most states are very under-staffed to handle calls, so if you don’t need to call, don’t.

Second, if your claim is denied or your still pending, you should try to call at least a few times. We recommend documenting these calls with date, time, wait time, and more. Hopefully this will resolve it if you’re patient enough.

Third, if you’re still waiting on benefits, you should contact your state legislature representative. In nearly all states, local representatives and assembly members have personnel on staff that can help escalate issues with state departments . In fact, most state departments have a liaison office that helps with these requests, so your situation will be reviewed by higher level managers.

This way nearly all U.S. adults have a chance of selection. The survey is weighted to be representative of the U.S. adult population by gender, race, ethnicity, partisan affiliation, education and other categories. Read more about the ATPs methodology.

Putting It All Together

How Do I Sign Up For Unemployment Benefits ...

To find out roughly how much you will receive in benefits, you’ll need to know what formula your state uses, as well as its minimum and maximum amounts and any dependent allowance it might offer. For information on how unemployment is calculated in your state, see Nolo’s Collecting Unemployment Benefits page and select your state.

Here are a couple of examples so you can see how it works:

California replaces half of an applicant’s income, uses the highest paid quarter of the base period, and offers a maximum benefit of $450. If you earned $15,000 in your highest paid quarter, you would divide that by 26 to come up with half of your weekly wages: $576.92. That amount is more than the maximum benefit, so you would be eligible to receive $450 each week in benefits. California doesn’t provide any extra amount for dependents.

Illinois replaces 47% of an applicant’s income and uses the two highest paid quarters of the base period. If you earned a total of $20,000 in those two quarters, you would multiply that amount by .47, then divide it by 26 to come up with a weekly amount: $361.54. The current maximum benefit in Illinois is $418, so you would be entitled to collect the full $361.54. Illinois provides additional benefits to those who have a dependent spouse or child, so you would add these benefits to your weekly total if you were eligible.

Hear From The Experts

Q: What advice do you have for folks navigating unemployment right now?

A: One advice I would give is to think hard if your job is coming back, once the pandemic is over. We live in times when economies are very dynamic, and one needs to be flexible in meeting the demand for labor. It might not be a bad idea to learn some new tasks/skills at the local community college while being unemployed.

Dr. Miren Ivankovic, Adjunct Professor of Economics, Clemson University

Q: How would you advise that people adjust their plans about work during the current reality?

A: The bad news is that the nature of work is rapidly changing, many industries and jobs will never be the same, and will put enormous stress on workers who will be forced to adapt. The good news is that there are more options than ever to do so. Massively Open Online Courses like Coursera, edX, and Udacity offer cheap, flexible, bite-sized courses that can help supplement your current skills with those most needed as the working world evolves. Universities in general, and business schools in particular, increasingly offer high-quality, flexible, specialized degrees that can help you make a bigger transition.

You have the option of having income tax withheld from your unemployment benefits so you dont have to pay it all at once when you file your tax returnbut it wont happen automatically. You must complete and submit Form W-4V to the authority thats paying your benefits. Withheld amounts appear in box 4 of your Form 1099-G.

Federal law limits the amount you can have withheld from benefits to 10%. This may not be enough to adequately cover taxes on the benefits you received. If youve returned to work, you can opt to have extra tax withheld from your paychecks through the end of the year to help cover taxes owed on your unemployment benefits as well as your regular pay.

Your other option is to make advance estimated quarterly payments of any tax you think you might owe on your benefits. You have until Jan. 15, to make estimated tax payments on any benefits you receive between September and December the prior tax year. In fact, you must do so if sufficient tax wasnt withheld from your unemployment benefit payments. You could be charged a tax penalty if you dont pay as you go through either additional withholding or estimated payments during the tax year.

The tax you owe on your unemployment benefits might be minimal depending on how much you received. This is because unemployment doesn’t replace 100% of your previously earned compensation.
