How Will I Receive My Payments

If your claim is approved, youll have to wait a week to receive your first payment. But youll still need to meet all eligibility requirements for that week. Youll generally receive your first payment two to three weeks from the time you filed your claim, but it could take longer if the state needs additional information.

If you enrolled in direct deposit, your payment will generally be deposited into your account within three business days of the department of labor releasing the payment. A 1905 Supreme Court Case Allows Employers To Require Vaccines

There are precedents for large-scale vaccination requirements in US law. In 1901, a deadly smallpox outbreak in New England prompted local governments to order mandatory vaccinations for area residents. Some locals objected, however, and one took it all the way to the Supreme Court. In Jacobson v. Massachusetts, the high court determined that the government could impose “reasonable regulations,” such as a vaccine requirement during a pandemic, to protect the safety of the general public.

That case forms the basis of guidance issued by the Equal Employment Opportunity Commission, which made it clear that employers may make similar demands of their workers.

Do You Meet The Minimum Earnings Requirement

Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment compensation. In New York, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your claim for benefits. For example, if you filed your claim in October of 2020, the base period would be from June 1, 2019, through May 31, 2020.

New York recognizes an alternate base period for those who can’t meet the earnings requirements in the regular base period. The alternate base period is the last four completed quarters before the person files for unemployment. This alternate period takes more recent employment into account. Even filers who qualify using the regular base period can ask the agency to instead use the alternate base period to calculate their benefits, if that would result in a higher weekly amount.

An Identity Protection PIN is a six-digit number that prevents someone else from filing a tax return using a taxpayers Social Security number. The IP PIN is known only to the taxpayer and the IRS, and this step helps the IRS verify the taxpayers identity when they file their electronic or paper tax return.

Expanded Unemployment In New York During The Covid

On March 11, 2021, President Biden signed into law a $1.9 trillion COVID-19 relief bill known as the American Rescue Plan .

Under ARP, the $300 per week federal unemployment supplement is extended until September 6, 2021.

The law also extends two unemployment programs originally created by the CARES Act in March 2020: Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation .

Under the PUA program, self-employed workersusually excluded from unemployment benefitsare entitled to unemployment if they meet certain criteria. ARP makes PUA benefits available through Labor Day 2021, and increases the maximum duration of these benefits from 50 to 79 weeks.

The PEUC program provides for a federally-funded extension of benefits when state unemployment benefits expire. ARP increases the maximum duration of PEUC benefits from 24 to 53 weeks, with an expiry date of September 4, 2021.

    Unemployed New Yorkers have been encouraged to file for unemployment insurance if needed, and more than 810,000 have filed since March 9. This has created a major volume issue the New York Department of Labor has never seen before.

    The application process and the phone system collapsed under the demand. This has left the jobless attempting to file scared and frantic. One spokesperson for Governor Andrew Cuomoâs office shared on Thursday that they have teamed up with Google to streamline the application and handle the demand on the New York State Department of Labor website.

    Work on the site should take place on April 9 from 5-7 p.m. The site will be down during this work. After the upgrades, users will fill out the application completely online, and the application will be marked finished.
