Bank of America has been fined $225 million by federal regulators for unlawfully freezing customers bank accounts while they were collecting unemployment benefits in the middle of the pandemic.

According to the Consumer Financial Protection Bureau , Bank of America used a faulty fraud detection program to automatically and unlawfully freeze customer accounts, and then offered little recourse, when there was no fraud detected. As a result, consumers were deprived of millions of dollars that was rightfully theirs.

Taxpayers relied on banks to distribute needed funds to families and small business to rescue the economy from collapse when the pandemic hit, said Rohit Chopra, director of the CFPB. Bank of America failed to live up to its legal obligations. And when it got overwhelmed, instead of stepping up, it stepped back.

The bank failed these prepaid cardholders by denying them access to their mandated unemployment funds during the height of the pandemic, and leaving vulnerable consumers without an effective way to remedy their situation, said Michael J. Hsu, acting Comptroller of the Currency.

How Will I Know When Money Has Been Deposited Into By Account

You may choose to receive electronic notification that funds have been deposited into your account. You can request the notification to come via telephone or email. You may request telephone notification using the IVR at the time you activate your card or at any time after card activation. Follow the prompts to set up your phone notification preference. For email notification of deposits to your account, go to Set up your web ID and password and enter your email address. Each time a deposit is made on your account you will receive an email notification. Funds are available for withdrawal at 5:00PM the day they are deposited into your account.

The Card is not a credit card. The Card has funds loaded on it by your sponsor. You are not able to load value to the Card yourself. Use the Card until all funds on the Card are depleted. A Bay Area man says someone hacked into his EDD account, took thousands of dollars — and Bank of America shut down his claim.

COTATI, Calif. — It was a big problem during the COVID-19 pandemic. Unemployed workers received their Employment Development Department benefits on Bank of America debit cards — but they were targets of fraudsters who drained millions of dollars from workers’ accounts.

Many could not get reimbursed.

This year, BofA was fined $225 million for automatically denying their claims.

The problem seemed to go away. But now, a North Bay man says thieves drained his EDD debit account, too.

Banks are required by law to investigate every claim of fraud on a customer’s account. Bank regulators ruled that Bank of America instead used fraud filters to automatically deny claims during the pandemic. BofA says it stopped that practice — but this viewer says someone hijacked his EDD account, took thousands of dollars — and the bank shut down his claim.

Alfredo Mancilla of Cotati was recovering from surgery when it happened. “It was a shock to me to find out close to $15,000 was taken out of my account,” he said. “I thought, man, this money got stolen from me and I can’t get it back.”

Someone had stolen the disability payments from his EDD debit account. Nearly $15,000 — gone.

No More Food In The House

Legitimate recipients say theyve been caught in the crosshairs. Single moms Candace Koole, 29, and Vanessa Rivera, 30, said they had a similar experience to Moons. Koole, a doula, and Rivera, a lien negotiator, said they became unemployed last spring and were granted California benefits.

Koole discovered her funds were missing when she was trying to buy food at the grocery. She said she was unable to quickly recoup the $9,000 that had been stolen.

I never knew if I was gonna be homeless. I never knew ifyou know, if I was going to be able to get birthday presents for my kid, Koole said in an interview with CNBC. I never knew what was going on. It was around Christmastime, that was also really hard.

When Rivera noticed $800 of benefits were stolen, she said she had to drain her familys savings.

At one point, I had to actually break my sons piggy bank cause I didnt have gas and he didnt have we didnt have like, no more food in the house, Rivera told CNBC. The two are also plaintiffs in the same class-action lawsuit as Moon.

Bank of America did not comment on Moon, Koole and Riveras situations. The bank said in a statement to CNBC that its No. 1 goal always has been to ensure legitimate recipients could access their benefits.

Bank Of America Is Fined $225 Million For Botching Pandemic Benefits

Regulators are fining Bank of America $225 million for bungling the distribution of unemployment benefits amid the pandemic, and are ordering the bank to compensate more than 100,000 people in a dozen states as a result.

The Office of the Comptroller of the Currency on Thursday ordered the nationâs second-largest bank to pay $125 million and compensate those hurt by unfair and deceptive practices related to a prepaid card program. The Consumer Financial Protection Bureau also fined Bank of America an additional $100 million, accusing it of âbotching the disbursement of state unemployment benefits at the height of the pandemic.â

At issue: programs administered by Bank of America that largely used prepaid cards akin to a debit card on behalf of 12 states: Arizona, California, Iowa, Kansas, Kentucky, Massachusetts, Maryland, Michigan, New Jersey, Nevada, North Carolina and South Carolina, according to the OCC.

Hired by those states to administer the jobless aid, the Charlotte, North Carolina-based bank âfailed these prepaid cardholders by denying them access to their mandated unemployment funds,â while leaving them without a way to fix the situation, Michael Hsu, acting comptroller of the currency, said in a news release.

Bank of America also distributed jobless benefits on behalf of other states, most of which issued the payments through direct deposit.

A fault fraud filter led to delays for jobless claimants nationwide obtaining their benefits, federal regulators said last week.

Federal regulators have fined Bank of America $225 million for botching the distribution of state unemployment funds during the pandemic, leading to delayed payments for people relying on jobless benefits.

The bank faces two fines: a $100 million penalty from the Consumer Financial Protection Bureau and a separate fine of $125 million from the Office of the Comptroller of Currency.

The federal agencies found Bank of America which contracted with states to provide unemployment benefits on prepaid debit cards froze peoples accounts with a fault fraud detection program, and then gave them little recourse when there was, in fact, no fraud, according to a press release announcing the fine.

Its a story the I-Team heard over and over again earlier in the pandemic consumers like Amanda Bailey and Patricia Moynihan said the money in their Bank of America debit card accounts had disappeared.

The account was totally empty. I couldnt even get $30 out of it, said Bailey.

The point of that money is to keep me going until Im on my feet again, said Moynihan.

Security expert Jim Stickley told the I-Team back then that the debit cards were likely getting hacked, or skimmed. Its when thieves attach a device to an ATM and steal the data from your card when you insert it.

When you put it into a machine, they can put a skimmer in there, or if you give it to somebody at a restaurant, and they walk away with that card, they can skim the card, or record the data off the magnetic stripe, and make their own card, said Stickley.

Every time the I-Team has reached out to Bank of America with a fraud case, it has refunded consumers. It did the same for Abbruzze.

In a statement to the I-Team, the bank said: When a client disagrees with our initial review, we encourage the client to ask for reconsideration and provide any additional information that may be available.

But federal regulators have a beef with the bank, too. They recently fined it $225 million for how it handled fraud on EDD accounts during the pandemic.

Ohio is one example of a state in which a public-private partnership helped the states jobs agency turn the tide. With the input from bankers and others, the state agency added ReCaptcha, multifactor authentication, one-time passwords, challenge questions and identity verification to its online and phone systems. Monthly claim volume subsequently dropped by more than 90%.

When we started putting additional fraud detection technology in, we were able to prioritize claims that had few fraud flags, and the inbound claim volume dropped incredibly, Damschroder said. We could tune these systems to not block legitimate claims but also stay ahead of potential bad guys.

The agency also was able to adopt customer service changes such as a callback feature and predictive routing to get callers to a specific individual for help.

We need to have some of the same approaches from a customer-service standpoint and customer experience design standpoint that the private sector already has, Damschroder said.

Ficke says theres more potential now to create improved systems and services. Ohio contracted with LexisNexis to prevent identity theft in the frontend enrollment process, and with Google Clouds government division to help differentiate real citizens from cybercriminals.

Ohio had to use Big Data to assess where the likelihood was of real citizens versus fraudsters, and it prioritized the way we adjudicated claims and helped us accelerate it by months, Ficke said.
