Can You Collect Unemployment If You Work Part

Many people think that holding a part-time job after they lose a full-time job will compromise their ability to collect unemployment benefits, but this isn’t necessarily the case. You might be eligible to receive unemployment benefits even if you’re currently working part-time. You might also be eligible if you’ve lost your part-time job.

Eligibility for partial unemployment depends on the state you work in and on your qualifying for unemployment compensation based on your employment history.

In normal times, according to the US Department of Labor, you’re eligible for UI benefits if you:

      1. Lose your job through no fault of your own.

      2. Meet the work and wage requirements established by your state as well as any additional state requirements.

That noted, the eligibility criteria was adjusted in 2020 with the emergence of the COVID-19 pandemic, but those pandemic unemployment benefits have since expired. Can Self-Employed Apply to Unemployment, SBA & PPP? **Multiple Stimulus Programs**

No, typically that employee would not be eligible for regular unemployment compensation or PUA. Eligibility for regular unemployment compensation varies by state but generally does not include those who voluntarily leave employment. Similarly, to receive PUA, an individual must be ineligible for regular unemployment compensation or extended benefits under state or federal law, or pandemic emergency unemployment compensation, and satisfy one of the eligibility criteria enumerated in the CARES Act, as explained in Unemployment Insurance Program Letter 16-20. There are multiple qualifying circumstances related to COVID-19 that can make an individual eligible for PUA, including if the individual quits his or her job as a direct result of COVID-19. Quitting to access unemployment benefits is not one of them. Individuals who quit their jobs to access higher benefits, and are untruthful in their UI application about their reason for quitting, will be considered to have committed fraud.

If I Am Eligible For Pandemic Unemployment Assistance Do I Need To First Apply For Unemployment Insurance

States must have a process for determining that Pandemic Unemployment Assistance applicants are ineligible for regular unemployment benefits, which may not include filing a regular claim as a first step. States are not required to take and adjudicate a full claim for regular unemployment insurance benefits to meet this requirement. While states are not prohibited from taking a full claim, to facilitate expedited claims processing the U.S. Department of Labor has discouraged states from doing so. Individuals should apply using the states PUA application process and, in states that have not yet established that process, must wait until it is established.

Who Is Eligible For Unemployment Benefits

Normally, unemployment benefits are typically reserved for full-time employees who lose their jobs. With the expanded coverage, part-time and self-employed workers may now qualify.

The CARES Act created the Pandemic Unemployment Assistance program, which provides benefits to individuals who would not normally be eligible for unemployment benefits from the states, including gig workers, freelancers, independent contractors and small business owners whose income has been affected by the pandemic. For now, PUA funding is set to run through Dec. 31.

You may also be eligible to collect unemployment benefits if you fall into one of these categories:

      • You or a family member have been infected by COVID-19 and cannot work.
      • You have been advised by a doctor to self-quarantine.
      • Your workplace closed due to the coronavirus.
      • You’re not working because you have to care for children or other family members who would otherwise attend school or another facility.
      • College students who worked a job last year — even a part-time one.

How Are States Handling The Issue

Transportation / Can I Apply for Unemployment Benefit?

State lawmakers “have widely diverse views on vaccine mandates,” according to David Mallen, a partner representing the Employee Law Group in Torrance, California. “States like CA and NY are introducing these vaccine mandates, but other states are doing the exact opposite. They have either introduced or already passed legislation banning vaccine mandates.”

In New York, health care and education workers are required to get vaccinated, and the state’s Labor Department has clearly stated that employees in these sectors who refuse employer-mandated vaccination or COVID testing aren’t eligible for UI benefits.

The guidelines are less clear in other states. Washington Gov. Jay Inslee mandated that all health care workers be vaccinated against COVID-19 by Oct. 18 or face dismissal. But while the majority will likely be ineligible for UI, there may be accommodations based on “unique circumstances.”

Other states are working on legislation that would make discriminating against employees’ vaccine status illegal. One such bill was introduced in the Tennessee Senate in February 2021. A similar bill in Arkansas, , added a clause that an individual could not be disqualified from UI benefits “due to a refusal to be vaccinated against COVID-19 or its variants.”

That’s why many legal experts are saying that unemployment claims will be determined on a case-by-case basis.

Many employers are requiring proof of vaccination to continue working.

When Can I Refile For Unemployment After Benefits Run Out

      Related

If you’re eligible for unemployment benefits after your initial benefits period has ended, you can immediately refile by applying for extended benefits. There’s no wait time. You could, for example, exhaust all your benefits, get another job and become unemployed a day later. Provided you still qualify, you can immediately file for an extension of benefits even if you’ve worked only one day on your last job.

Although it’s natural to think of this as “refiling,” what you’re really doing is applying for an extension of your original benefits. California uses the expression “reopening your benefits,” which is a good way of thinking about it.

Im Partially Employed Because Im A Student And Work Part Time Doing Ride

Coronavirus: How to apply for unemployment benefits online

You may be eligible for PUA, depending on your personal circumstances. A gig economy worker, such as a driver for a ride-sharing service, is eligible for PUA provided that he or she is unemployed, partially employed, or unable or unavailable to work for one or more of the qualifying reasons provided for by the CARES Act. For example, a driver for a ride-sharing service may be forced to quit his or her job if he or she was diagnosed with COVID-19 by a qualified medical professional, and although the driver no longer has COVID-19, the illness caused health complications that render the driver objectively unable to perform his or her essential job functions, with or without a reasonable accommodation. Similarly, under an additional eligibility criterion established by the Secretary of Labor pursuant to 2102, a driver who receives an IRS Form 1099 from the ride-sharing service may qualify for PUA benefits if he or she has been forced to suspend operations as a direct result of the COVID-19 public health emergency, such as if an emergency state or municipal order restricting movement makes continued operations unsustainable. Relatedly, widespread social distancing undertaken in response to guidance from federal, state, or local governments may so severely reduce customer demand for a drivers services as to force him or her to suspend operations, and thus make the driver eligible for PUA.
