How Do You Appeal An Unemployment Benefit Denial In New York

If you are denied benefits for any reason, you have the right to appeal the decision by requesting a hearing in front of an impartial Administrative Law Judge of the New York Unemployment Insurance Appeal Board.

You can request a hearing online by sending a message to the state through your NY.gov account. You may also request a hearing by completing a Claimant Hearing Request Form and mailing it to: New York State Department of Labor, PO Box 15131, Albany, NY 12212-5131.

The plan may provide SUB payments up to a maximum of 95% of the normal weekly earnings when the employee is not in receipt of EI benefits, and:

Repayment Of Ei Benefits

An employee whose net income is above 1.25 times the maximum yearly insurable earnings may be required to repay some of the EI benefits received.

The employer may offset the repayment of EI benefits under the SUB plan. The amount of the offset when added to the previous payments must not exceed 95% of the employee’s normal weekly earnings.

Example: The SUB plan has supplemented to 70%. The maximum amount of the offset cannot exceed 25% of the employee’s normal weekly earnings multiplied by the number of weeks in which EI benefits were received.

The program covers most individuals who have exhausted all rights to regular unemployment compensation under state or federal law and who are able to work, available for work, and actively seeking work as defined by state law. Importantly, the CARES Act gives states flexibility in determining whether you are actively seeking work if you are unable to search for work because of COVID-19, including because of illness, quarantine, or movement restrictions.

In addition, if you have exhausted the 13 weeks of additional benefits available under the PEUC program, you may be eligible to continue receiving benefits under the PUA program. PUA benefits are available for a period of unemployment of up to 39 weeks, meaning that if you have exhausted regular UC and PEUC benefits in fewer than 39 weeks, you may be eligible to receive assistance under PUA for the remaining weeks within PUAs 39 week period.

How Can Members Apply For Electric Certification Of Involuntary Separation

  • The member may file the application for Electronic Certification of Involuntary Separation over the counter or thru the the online facility of selected DOLE/POLO/POEA offices
  • For local employees/kasambahay: DOLE Field/Provincial Office where the employer/company is located.
  • For land-based/sea based OFWs: POEA Central Office, or any One-Stop Service Center for OFWs , POEA Regional Center, POEA Satellite Office , Regional Extension Unit , or POLO where the foreign employer operates.The application for certification shall be subject to the existing appointment system, if applicable, in the respective venues of the filing of application.
  • 2. Upon submission of application at the DOLE/POLO/POEA OFFICE or thru their respective website, the member shall be required to provide the following:

    • Transaction Number provided in the SSS email notification
    • One valid identification document with signature and photo
    • Copy of Notice of Termination of Employment issued by the employer or Duly Notarized Affidavit of Termination of Employment, in the absence of Notice of Termination of Employment.

    2. Upon submission of application at the DOLE/POLO/POEA office or thru their respective website, the member shall be required to provide the following:

    For OFWs, the Affidavit of Termination of Employment shuld be supported by an Employment Contract verified by POLO and/or proof of OFWs arrival to the Philippines in the OFWs passport or similar documents.

    Benefit Year End Date

    A regular unemployment insurance benefit year ends 12 months after the claim started.

    You cannot be paid for weeks of unemployment after your benefit year ends, even if you have a balance on your claim. Continue to certify for benefits if you have weeks available within your benefit year.

    You can reapply for a new claim if you earned enough wages in the last 18 months and are still unemployed or working part time. Apply online, and we will notify you when your new claim is processed. This usually takes two to three weeks.

    If you served in the military, worked for a federal government agency, or worked in a state outside of California within the last 18 months, you must reapply for a new claim by phone, mail, or fax.

Base periods are divided into calendar quarters and the quarter you were paid the highest amount of wages determines the amount of your New York unemployment weekly claims. While you can determine ahead of time how much New York unemployment compensation you receive, you will be formally notified before your benefits begin.

    New Yorks Basic Base Period is the first four of the last five completed calendar quarters prior to the beginning date of the UI claim. If you have earned enough wages in your Basic Base Period, those wages will be used to calculate your benefit amount.

    If you do not have enough wages in the Basic Base Period to establish a claim, you may be able to use an Alternate Base Period. It is the last four completed calendar quarters prior to the beginning of the claim.

If you think your New York unemployment amount would be higher, you can request that the state use your Alternate Base Period instead.
