Can My Employer Require Me To Use My Vacation Time
I work in accounts payable. During the last three weeks my hours have started to dwindle, and I am now only working three days a week. I have been using my personal/vacation time to compensate for the loss. My employer received the PPP. Do I have to keep using my personal time to cover lost hours?
Answer from Nick Oberheiden, Attorney & Founder of Oberheiden, P.C.:
If you are able to work and you choose not to do so, then your employer can require you to utilize vacation time that you have accruedand your employer can place limitations on the use of vacation time that apply generally to all employees .
With regard to the PPP and unemployment specifically, there are really two separate issues: If you are eligible for unemployment benefits, even temporarily, then you can file for and receive unemployment. If you are not eligible for unemployment because you are still employed and available to work , then your employer can require you to either work or take vacation time.
Join An Unemployment Facebook Group For Your State
Stettner recommends connecting with other people who have already received unemployment benefits, and are familiar with the process.
The group Harris and Pagan turned to was started by Erica Chan as an online community resource for people navigating Californias unemployment system. Chan, a Los Angeles-based filmmaker, says she had experience filing for unemployment benefits, and figured a Facebook group might help to connect others with similarly valuable experience with those filing in need of help. The group has become a platform for finding answers to common issues like identity verification, and how to contact the EDD.
Hundreds of thousands of people across the country are turning to such Facebook groups for help navigating state unemployment systems. While a Facebook group can be a good starting point, be sure to verify the advice you find in these groups, as personal experiences arent always a good substitute for expert guidance.
The experts we spoke with agreed that getting someone from your states unemployment office on the phone is your best option for getting a direct response, but even that can be hit or miss. While people have occasionally been able to reach someone at the unemployment office who is helpful, that usually isnt the case, Kalish says.

I Would Rather Stay On Unemployment Is It My Choice
I was laid off, I am now collecting unemployment and my employer applied for the PPP loan AFTER they laid me off. I am actually making a lot more money on unemployment, so if they get the loan and want to bring me back, am I required to take my job back?
Answer from Nick Oberheiden:
If an employee has been laid off, he or she cannot be forced to accept a new position with the company. However, in order to remain eligible for unemployment benefits, a former employee must be available to work, which means that he or she must be actively looking for employment and not suffering from a disability or other medical condition that impairs his or her ability to work. If a former employee declines an offer for a position that he or she is capable of filling, or if the company hires a replacement employee, then the former employees unemployment eligibility could be terminated.
It is also important for former employees to keep in mind that the additional $600 per week they may be receiving under the federal CARES Act expires on July 31, 2020. Once this expires, unemployment benefits will return to their normal below-wage level.
I Was Furloughed By My Employer But They Have Now Reopened And Asked Me To Return To My Job Can I Remain On Unemployment
No. As a general matter, individuals receiving regular unemployment compensation must act upon any referral to suitable employment and must accept any offer of suitable employment. Barring unusual circumstances, a request that a furloughed employee return to his or her job very likely constitutes an offer of suitable employment that the employee must accept.
While eligibility for PUA does not turn on whether an individual is actively seeking work, it does require that the individual be unemployed, partially employed, or unable or unavailable to work due to certain circumstances that are a direct result of COVID-19 or the COVID-19 public health emergency. In the situation outlined here, an employee who had been furloughed because his or her employer has closed the place of employment would potentially be eligible for PUA while the employer remained closed, assuming the closure was a direct result of the COVID-19 public health emergency and other qualifying conditions are satisfied. However, as soon as the business reopens and the employee is recalled for work, as in the example above, eligibility for PUA would cease unless the individual could identify some other qualifying circumstance outlined in the CARES Act.

How I Sent The Money Back For New York
In New York, I wasnt penalized for the error. Those who are overpaid will receive a written notice in the mail, which gives instructions on how to send a check or money order to pay the total amount due, Cohen says.
They didnât have an option to withdraw the money from my bank account like Hiltz in Michigan.
You can mail a payment for all, or a portion, of the amounts that was overpaid.
For those in other states, dont spend the money and hold onto the extra payment, experts advise. Contact your state unemployment office and wait for them to notify you by mail on how to pay the money back, they said.

Can My Employer Force Me To Come Into The Workplace Because They Are Paying Us After Obtaining Ppp
Im a dental assistant and our office has been shut down except for emergencies. My employer is approved for a PPP loan. This means all of the employees will go off unemployment and she will pay us. Can the dentist make us work in the office if it is non-essential or to do menial jobs?
Answer from Ian Meklinsky:
This is a common question we are receiving from employers and employees. An employer who receives a PPP loan, if it wants the loan forgiven, has eight weeks to spend it on otherwise eligible expenses. As a result, many employers are having employees either return to work or are having employees not work and paying them nonetheless. This is permitted. The failure of employers to do this will result in their PPP loan not being fully forgiven.
I understand the concern of employees here, as some may be earning more on unemployment compensationas a result of the federal unemployment insurance supplementbut employers have the right to compel employees back to work.
