What If I Havent Filed A Tax Return

If you didnt file a tax return or an extension, but should have, you need to take action or the penalties you face may increase.

If you file your return over 60 days late, youll have to pay a $435 fine or 100% of the tax you owe whichever is less.

How Long Does It Take To Get The Debit Card

Your unemployment debit card will be mailed the day after your first eligible weekly certification has been filed. Please allow 10-14 days to receive the card. If it has been more than 14 days since you filed your first eligible weekly certification, and you have received confirmation from OESC that you are eligible for benefits and payments have been issued, please contact Conduent at 866-320-8699 to resolve your missing card.

What Can You Do To Ensure Youre Getting What Youre Owed

The huge influx of recent unemployment claims were partly caused by the number of people who qualify under this years unique circumstances but who wouldnt under normal circumstances.

The Coronavirus Aid, Relief, and Economic Security Act extends unemployment benefits to many who didnt previously qualify. Independent contractors, freelancers, gig workers, and the self-employed may be eligible for payments through the Pandemic Unemployment Assistance program, established by the CARES Act. Since these types of workers dont pay state unemployment insurance taxes and they dont have employers who pay into the unemployment system, they arent normally eligible for unemployment benefits.

But how you apply for PUA benefits isnt the same across the board. Different states have different procedures and rules on who qualifies for benefits, says Daniel Kalish, managing partner at the national employment law firm HKM Employment Attorneys. The stimulus package included language saying states should be more lenient with who gets extra benefits, but didnt spell out exactly how, says Kalish.

Because there is so much confusion right now surrounding qualification, Kalish has this straightforward advice: If you have had any reduction of your take-home compensation at all, you should apply for unemployment benefits, even if youre unsure whether you qualify. As long as you are honest in your application, there is no negative repercussion for applying. All they can say is no, he says.

Your Application Might Be Getting Vetted For Fraud

State unemployment offices have been hit massively with fraud. The FBI in July announced that they had seen a spike in fraudulent UI claims relating to the pandemic, which involved fake filers using stolen personally identifiable information. Other fraudulent applicants have used the names and personal information of people who have not lost their jobs, further overwhelming the system and costing states money.

To stop the problem, some states have started requiring more forms of ID. Others, such as California, have decided to pause making payments and accepting new applications for two weeks, so they can get control of the problem and work through their backlog.

All of these peoples benefits are frozen while theyre flagged, and the state has got to verify their identity, Evermore says. Thats not always easy to do.

Jobless Claims Strain States

“It is a big deal for states and businesses.”

Backlogs have become the norm in almost every state, according to federal timeliness reports reviewed by Stateline. As of November 1, only three states, North Dakota, Rhode Island and Wyoming, met the federal standard of getting benefit payments out within three weeks for 87% of applicants.

The 87% standard, set in 2005 by the U.S Department of Labor, carries no penalties but requires states to have a plan to correct the problem.

South Dakota had the lowest timeliness rate, with only 18.8% of payments going out within three weeks, with Kentucky and Maryland next. The rate was less than half for 14 states, including New York and California.

Before the pandemic, almost every state was at or above 87%. North Carolina had the lowest rate, 79.6%. Forty-four states and the District of Columbia paid 90% or more of claims within three weeks now none does.

States have a legal duty to pay benefits on time, said Andrew Stettner, a senior fellow at the progressive Century Foundation and co-author of an on state unemployment systems. Some advocates have gone to court to force payments and press for change.

The inability of states to climb out of the hole of untimely payment is an example of the system failures exposed by COVID-19, Stettner said. The federal government ought to be pressing them to understand their backlog and bottlenecks and coming up with solutions.

In general, it doesnt make sense to hire a lawyer right out of the gate. If you receive a letter saying your claim has been denied or that you are not eligible for benefits that you think is wrong, thats when you should look into legal services, Stettner says.

Unfortunately, getting legal representation can be difficult or not worth the cost of hiring a lawyer. A lot of states limit the fees an attorney can charge for unemployment representation, Kalish says. That prevents attorneys from gouging clients who are desperate and in need, he says. But in states where such caps are extremely low, it can be hard to find legal representation for unemployment cases. On the other hand, legal representation may be too expensive in states with no restrictions.

You might be able to find public interest groups that provide pro bono unemployment legal counseling. For example, the Unemployment Law Project provides free legal advice and representation for unemployment cases in Washington state. But these organizations are so overwhelmed they are likely only able to help a small fraction of people in need. Its really tricky to provide a large number of people with good unemployment advice, Kalish says.

In particular getting through a live agent or getting a response from your local state agency has been a challenge which has often meant stress and panic around the status of your unemployment check, and if you will even be getting paid one for current or past weeks.
