Where’s my money? | Tracking unemployment, assistance & stimulus cash

What is time? became a familiar saying as the pandemic dragged on. Without their usual activities and events, days and weeks blurred together. Even with life getting closer to pre-pandemic normal, its still easy to get busy and lose track of things on your to-do list. It might be worth double-checking to make sure youve actually filed a claim for every week that youve been out of work.

How To Get The Refund

If you are owed money and youve filed a tax return, the IRS will send you the money or use it to pay off other owed taxes automatically.

You typically dont need to file an amended return in order to get this potential refund.

Instead, the IRS will adjust the tax return youve already submitted.

However, if you havent yet filed your tax return, you should report this reduction in unemployment income on your Form 1040.

The deadline to file your federal tax return was on May 17.

How Long Should I Keep Documentation Of My Work Search Efforts

Claimants should retain documentation of their work search activity for two years, even after finding employment. In the case of an audit, individuals are required to provide the needed information within 5 business days of the notice being mailed. OESC will then contact the employers listed on the work search documentation to confirm the work search activity.

What Can You Do To Ensure Youre Getting What Youre Owed

The huge influx of recent unemployment claims were partly caused by the number of people who qualify under this years unique circumstances but who wouldnt under normal circumstances.

The Coronavirus Aid, Relief, and Economic Security Act extends unemployment benefits to many who didnt previously qualify. Independent contractors, freelancers, gig workers, and the self-employed may be eligible for payments through the Pandemic Unemployment Assistance program, established by the CARES Act. Since these types of workers dont pay state unemployment insurance taxes and they dont have employers who pay into the unemployment system, they arent normally eligible for unemployment benefits.

But how you apply for PUA benefits isnt the same across the board. Different states have different procedures and rules on who qualifies for benefits, says Daniel Kalish, managing partner at the national employment law firm HKM Employment Attorneys. The stimulus package included language saying states should be more lenient with who gets extra benefits, but didnt spell out exactly how, says Kalish.

Because there is so much confusion right now surrounding qualification, Kalish has this straightforward advice: If you have had any reduction of your take-home compensation at all, you should apply for unemployment benefits, even if youre unsure whether you qualify. As long as you are honest in your application, there is no negative repercussion for applying. All they can say is no, he says.

Your Application Might Be Getting Vetted For Fraud

State unemployment offices have been hit massively with fraud. The FBI in July announced that they had seen a spike in fraudulent UI claims relating to the pandemic, which involved fake filers using stolen personally identifiable information. Other fraudulent applicants have used the names and personal information of people who have not lost their jobs, further overwhelming the system and costing states money.

To stop the problem, some states have started requiring more forms of ID. Others, such as California, have decided to pause making payments and accepting new applications for two weeks, so they can get control of the problem and work through their backlog.

All of these peoples benefits are frozen while theyre flagged, and the state has got to verify their identity, Evermore says. Thats not always easy to do.

Jobless Claims Strain States

“It is a big deal for states and businesses.”

Backlogs have become the norm in almost every state, according to federal timeliness reports reviewed by Stateline. As of November 1, only three states, North Dakota, Rhode Island and Wyoming, met the federal standard of getting benefit payments out within three weeks for 87% of applicants.

The 87% standard, set in 2005 by the U.S Department of Labor, carries no penalties but requires states to have a plan to correct the problem.

South Dakota had the lowest timeliness rate, with only 18.8% of payments going out within three weeks, with Kentucky and Maryland next. The rate was less than half for 14 states, including New York and California.

Before the pandemic, almost every state was at or above 87%. North Carolina had the lowest rate, 79.6%. Forty-four states and the District of Columbia paid 90% or more of claims within three weeks now none does.

States have a legal duty to pay benefits on time, said Andrew Stettner, a senior fellow at the progressive Century Foundation and co-author of an on state unemployment systems. Some advocates have gone to court to force payments and press for change.

The inability of states to climb out of the hole of untimely payment is an example of the system failures exposed by COVID-19, Stettner said. The federal government ought to be pressing them to understand their backlog and bottlenecks and coming up with solutions.

Can I Get Back Unemployment The Weeks I Waited To File

You may wait to file for unemployment for a variety of reasons, such as receiving severance pay or not realizing that you might be eligible. How Long Will It Take To Get My Unemployment Benefits After I File

The federal Department of Labor’s website says that you can expect your first unemployment check two or three weeks after you apply, as long as you submit all of the required information, and no follow-up is necessary. In some states, there is a waiting period between the time you become unemployed and when you are eligible for benefits. This means you won’t receive any unemployment compensation for the first week you are out of work.

What Are The Unemployment Tax Refunds

Whereâs My Money? Answers to Your Coronavirus Unemployment ...

The American Rescue Plan Act, which was signed on March 11, included a $10,200 tax exemption for 2020 unemployment benefits.

The exemption, which applied to federal taxes, meant that unemployment checks sent during the pandemic weren’t counted as earned income.

But because the change happened after some people filed their taxes, IRS is issuing refunds for overpayments or it may use it to pay other taxes owed.

It’s important to note that the $10,200 figure is the amount taxpayers can exclude from their earnings, not the amount of the refund.

The latter will vary between households, depending on overall income, your tax bracket and how much of your earnings came from the benefits.

Should You Reach Out To An Unemployment Lawyer

In general, it doesnt make sense to hire a lawyer right out of the gate. If you receive a letter saying your claim has been denied or that you are not eligible for benefits that you think is wrong, thats when you should look into legal services, Stettner says.

Unfortunately, getting legal representation can be difficult or not worth the cost of hiring a lawyer. A lot of states limit the fees an attorney can charge for unemployment representation, Kalish says. That prevents attorneys from gouging clients who are desperate and in need, he says. But in states where such caps are extremely low, it can be hard to find legal representation for unemployment cases. On the other hand, legal representation may be too expensive in states with no restrictions.

You might be able to find public interest groups that provide pro bono unemployment legal counseling. For example, the Unemployment Law Project provides free legal advice and representation for unemployment cases in Washington state. But these organizations are so overwhelmed they are likely only able to help a small fraction of people in need. Its really tricky to provide a large number of people with good unemployment advice, Kalish says.

After I Was Laid Off I Took My Son Out Of Day Care To Save Money Can I Still Collect Unemployment Even Though I’m Spending Most Of My Time Being A Stay

You must be able and available to work and actively looking for a job to qualify for unemployment benefits. This means, first of all, that you must be continuing your job search despite your childcare responsibilities. And second, you must be ready to take a job if one is offered. This doesn’t mean that you have to put your son back in daycare while you are unemployed, but you may have to prove to your state’s unemployment agency that you could arrange care for him quickly if you are offered a position. How To File For Unemployment Benefits Back Payments

Many of the recent comments in this article reflect the challenges with actually being able to claim unemployment back payments for eligible weeks. In particular getting through a live agent or getting a response from your local state agency has been a challenge which has often meant stress and panic around the status of your unemployment check, and if you will even be getting paid one for current or past weeks.

While it varies by state, the following are the key ways to file and get your retroactive unemployment payments:

  • To claim past weeks or correct dates you will generally have to contact your state UI agency and get them to retroactively certify you for past week. Getting an agent is a challenge, so may agencies are offering secure message as a way to lodge your claim. New York is doing this extensively and people have reported this is more effective than trying to get through to someone.
  • States like Florida have actually setup dedicated phone lines and options to modify the date of unemployment claims or to certify for past weeks. In California, there is a dedicated site to certify for past weeks to confirm your eligibility .
  • Some states like PA are trying to do more of this online through their unemployment portals/dashboards, and actually are recommending claimants experiencing any errors or issues email their state agency. But response times are still expected to be several days.
