Thousands are waiting for unemployment in NC. What’s the hold up?

The state unemployment insurance benefit program will remain in place. Under state law, these benefits currently provide eligible claimants with up to 13 weeks of benefits in a one-year period, with a maximum benefit of $350 a week.

To be eligible for state unemployment insurance benefits:

  • You must be unemployed due to no fault of your own. The Division of Employment Security will make this determination based on information provided by you and your last employer.
  • You must have earned sufficient wages in employment that was subject to unemployment insurance tax.
  • You must be physically able and available to work.
  • You must be actively seeking work, and you must register for work with NCWorks.gov or your resident state’s job service office.

In North Carolina, the Division of Employment Security handles unemployment benefits and determines eligibility on a case-by-case basis. Applicants must meet the following three eligibility requirements in order to collect unemployment benefits in North Carolina:

  • Your past earnings must meet certain minimum thresholds.
  • You must be unemployed through no fault of your own, as defined by North Carolina law.
  • You must be able and available to work, and you must be actively seeking employment.

What Does It Mean To Be Monetarily Eligible

Monetary eligibility simply means that you have worked and earned enough wages within your base period to meet the requirements for establishing a claim. You must have filed a valid claim and met the requirements for eligibility and qualification to receive benefits.

What Is A Waiting Period Week

Your waiting period week is the first eligible week for benefits under each claim filed. You must serve a waiting period week for each claim filed. You will never receive payment for this first week, but it must be claimed to be counted. It does not mean you should wait a week before filing a UI claim.

How Will I Receive My Payments

You wont receive your first payment immediately, since theres a one-week waiting period before payments begin.

The DES pays weekly unemployment insurance payments through direct deposit into your bank account or on a DES debit card issued by Bank of America. You can use the card anywhere Visa debit cards are accepted. Be aware, though, you may encounter fees if you use the card at an ATM thats not a Bank of America or Allpoint ATM, or if you use it outside of the country.

How To Appeal A Denial Of Unemployment Benefits In North Carolina

If your unemployment claim is denied, you have ten days to appeal the decision. This is called a “Higher Authority Review” and is conducted by the DES Assistant Secretary, the Board of the Review, or another designated administrative official.

Your request for appeal must be in writing . After receiving your appeal request, the Higher Authority will review the record and make a decision. In rare cases, the Higher Authority may schedule another hearing to receive evidence. More often, a decision is made based on a review of the documents and testimony already in the record.

If you disagree with the Higher Authority decision, you may ask for reconsideration within the DES , or you may file an appeal in the North Carolina Superior Court .

Final guidelines on these programs and final eligibility including additional document verification procedures to combat Fraud have been issued by the Department of Labor and then have to be implemented by the state UI agency in their systems and programs. So this could delay the actual date of payments.

UI claimants with existing or expired claim balances should be aware of the following:

  • PUA and PEUC, FPUC will be automatically added to the claimants benefits if they are eligible for the weeks outlined in the new legislation.
  • Claimants who will have additional weeks in UI and PUA or PEUC due to state provisions should watch their state agency UI portal or website for updates that will allow additional weeks to be filed
  • Claimants with weeks remaining in UI should continue to file weekly claims if their state UI systems have been updated for the extended coverage period.
  • Claimants will receive retroactive payments for all weeks they are eligible.
  • Claimants currently receiving benefits through the Extended Benefits program must finish all weeks of EB before receiving additional weeks of PEUC.

    A Wage Transcript and Monetary Determination is a document that itemizes your quarterly wages paid by each base period employer. This form also shows your weekly benefit amount, duration, and effective date of your claim. If monetary eligibility is not established, the reason is shown on this form.

    The expiration of the programs include:

    The federal funds have been hotly contested over the last few months, with many states voting to end the programs before the official expiration on Monday, Sept. 6 . At the beginning of summer, the North Carolina General Assembly passed Senate Bill 116 in attempt to end federal payments, though Gov. Roy Cooper vetoed it.

    The Biden administration announced on Aug. 19 it would not stop the expiration of the federal program, which was first enacted by the CARES Act in 2020 to provide additional payments of $600 a week.     If you are working reduced hours because of the COVID-19 coronavirus pandemic, the wages you earn will affect the amount of unemployment benefits you are entitled to receive. If you earn $420 per week or more then you will not be able to receive a benefit. Each claimant has a Weekly Earning Allowance, 20% of their benefit amount. That is the amount that a claimant can make before their benefit is impacted.

    If the payment was issued and it has been seven mail delivery or banking days, but you still have not received benefits, call the claims center for help.

    Replacing lost or stolen payments takes time. In the meantime, continue to submit your weekly claims.

    The bill has wide support with Republican lawmakers in the General Assembly, who control both the state House and Senate.

    The bill passed the North Carolina House of Representatives 71 to 36, with seven Democrats joining the Republicans. No Republicans voted against the bill.

    In recent weeks, 25 states have decided to cut off the federal unemployment benefits early, according to the AP. Those states include South Carolina, Georgia and Tennessee.

    Itâs not clear what North Carolinaâs governor would do with the bill, but heâs made it clear that he supports the extra unemployment benefits.

    North Carolinaâs two Republican U.S. Senators called on Cooper to end the extra federal benefits in a joint statement late last month.

    âThe employment shortage caused by exorbitant federal unemployment benefits is a real and serious threat to North Carolinaâs recovery,â Senators Thom Tillis and Richard Burr said in the joint statement.

    âOver the last several weeks, weâve heard from countless small, mid, and large-sized business owners across North Carolina struggling to hire enough workers to reopen this summer. Employers, particularly in hard-hit industries like tourism, service, and hospitality, are finding they canât compete with excessive federal benefits,â the senators said.

    Cooper could potentially veto the bill, leaving the ball with the Republicans in the state House and Senate to get the three-fifths majority to override the veto.

    What Effect Do Vacation And Severance Weeks Have On Eligibility For Benefits

    Any worker who receives severance pay is considered to be attached to that employer’s payroll during that time and not eligible for UI benefits.

    Paid Time Off will not be considered separation pay if the payment was issued as a result of the employer’s written policy established prior to your separation. Workers receiving Paid Time Off under these conditions will not be disqualified from receiving benefits.
