Who Is Eligible And Time Periods

Children and spouses of veterans who are totally and permanently disabled are eligible for Dependents’ Educational Assistance. Spouses can generally use these benefits for 10 years from the date the VA deems them eligible. In some cases, spouses can use the benefits for 20 years. This happens when the veteran was rated permanently and totally disabled within three years after discharge from the service, and the 20-year-period begins running on the date the veteran received the disability rating.

Children are eligible for the benefits from the Dependents’ Educational Assistance program between 18 and 26 years old. Sometimes eligibility can begin before age 18 and continue past age 26. Children remain eligible for Dependents’ Educational Assistance even after they marry.

Children who are active service members in the military are not eligible to receive this benefit while on active duty. Once discharged, benefits are available as long as the discharge is not under dishonorable conditions. The period of eligibility for Educational Assistance will be extended by the amount of time spent on active duty, but this extension will usually not go beyond a child’s 31st birthday.

As of 2018 to 2025-Veterans with P& T disability rating are eligible for student loan relief.Eligibility:

List Of 0% Va Rating Benefits

At the 0% disability rating level, veterans with service-connected disabilities are eligible for these benefits:

• Youll be assigned to VA healthcare as Priority Group 6
• Travel pay to VA healthcare locations for service-connected conditions
• 10-point veteran preference for federal jobs
• Use of base or post commissaries, exchanges, morale, welfare, and recreation retail facilities, in-person and online
• Burial and plot allowance

Although this rating offers no monthly disability compensation, veterans at the 0% service-connected rating level are still qualified for VA healthcare. If youre a veteran with a 0% disability rating, you may be assigned to Priority Group 6. Your healthcare benefits as part of this priority group include free inpatient care. Some of the services below are free if income limits are met. Youll be charged a copay for:

• Prescription medications
• Specialty tests
• Urgent care visits

You may qualify for VA disability compensation if you were injured or developed a physical or mental illness during your service or if a preexisting condition got worse as the result of your time in the military.

The SSA is not concerned with how you became ill or injured rather, qualification for SSDI is based on your work history: You must have spent a certain period of time in covered employment meaning jobs or self-employment in which you paid Social Security taxes.

Medical eligibility

Social Security bases eligibility for disability benefits on whether your condition is severe enough to prevent you from doing most paid work for at least a year or is likely to result in your death. By the SSA’s lights, you are either disabled or you’re not.

If you developed multiple disabilities from your service, the VA has a complicated formula for combining them into a single rating. Who Is Eligible For Individual Unemployability Benefits

Any veteran with an other-than-dishonorable discharge who is unable to get or keep a substantially gainful occupation due to a service-connected disability can qualify for Individual Unemployability benefits from VA. Any service-connected mental or physical impairment can qualify a veteran for individual unemployability benefits. Veterans may qualify for Individual Unemployability on a schedular or extraschedular basis.

The schedular requirements for Individual Unemployability are as follows:

• The veteran has one service-connected disability rated at least 60 percent disabling OR
• The veteran has more than one service-connected disability, with one condition rated at least 40 percent, and a combined rating of at least 70 percent.

What Are Total Disability Individual Unemployability Benefits

Total Disability Individual Unemployability benefits are for veterans that cannot keep or obtain gainful employment. You must not be able to work because of mental and physical impairments. Those disabilities must be related to your time in the service and be considered service-connected to receive benefits.

Can VA reduce or terminate my TDIU benefits? Yes, VA does reserve the right to terminate individual unemployability benefits in some situations. The VA can take away your TDIU benefits if they discover that your condition has improved enough such that you are now able to follow substantially gainful employment.

The Impact Of Prior Tdiu Denials

Prior TDIU denials matter for a person currently applying for TDIU. The new Appeals Modernization Act has made it more difficult to reopen or file a supplemental claim for TDIU if a former servicemember has been denied in the past. This does not pertain to somebody who has been denied in the past year and is appealing the decision, as that is part of the appeals process.

A veteran who applied several years ago, failed to file an appeal, and is now attempting to reply for TDIU will have more trouble being approved. Although there is no limit to the number of times that a veteran can apply, under the AMA, new and relevant evidence is now required to file a supplemental claim for TDIU.

VA Travel Pay Reimbursement is for regular transportation, such as, car or POV, plane, train, bus, taxi, or light rail. You may be eligible for this reimbursement if youre traveling for care at a VA health facility or for VA-approved care at a facility in your community, and at least one of the below descriptions is true for you. In 2022, the current VA travel pay reimbursement rate is 41.5 cents per mile for approved, health-related travel.

Find the dependent status in the left column that best describes you. Then look for your disability rating in the top row. Your monthly basic rate is where your dependent status and disability rating meet.

Does It Help To Get Approved For One Program Is You Already Have The Other

In the past, the answer was yes. If you were approved for VA Unemployability benefits, then your chances of getting approved for Social Security Disability benefits were very high.

Unfortunately, from 2017 onwards, the Social Security Administration changed their regulations, stating that VA Unemployability approvals would not be taken into consideration while a persons application for Social Security Disability benefits was being processed.

In addition to the desirable monthly compensation at the 100% level, P& T disabled veterans are also eligible for survivor death benefits. These benefits are known as Dependency and Indemnity Compensation . DIC is a tax-free benefit for survivors of veterans who died from a service-related injury or illness.

To qualify, P& T veterans must have passed away due to their service-connected condition, or meet one of these requirements if their death wasnt service-connected:

• The veteran had a condition that was totally disabling for at least ten years before death
• The veteran had a condition that was totally disabling since release from active duty plus at least five years before death
• The veteran had a totally disabling condition for at least one year before death and was a prisoner of war who died after September 30, 1999.
