Unemployment benefits are available to employees who are out of work temporarily, through no fault of their own. Most people who collect unemployment have lost their jobs. However, you may be eligible for benefits even if you are still working, if your hours or pay have been cut or you have been forced to take a part-time position and you cant get additional work.

In this article, well explain:

  • who is eligible for partial unemployment
  • how much you can receive
  • how long benefits might last, and
  • how to apply for benefits.

Eligibility Requirements For Partial Unemployment Benefits

Each state determines its own eligibility requirements for partial unemployment benefits. But, no matter which state they live in, all claimants have to satisfy certain basic criteria. They must be able and willing to work full time if they can. They must also report all hours they have worked in the course of part-time employment plus their gross earnings. They must also work a certain minimum number of hours and earn at least a certain amount. These limits vary by state.

Prospective claimants need to check with their stateâs unemployment office website for a complete list of necessary requirements. Some states require claimants to report how many jobs they applied for each week, while others have less stringent requirements. Itâs important to understand that collecting unemployment benefits is not simply a matter of sending in a notification and then expecting to get a check every week.

Here are a few examples of how unemployment benefits are calculated in different states. New Yorkâs unemployment agency determines weekly benefits for part-time workers by looking at the number of hours a claimant works each week.

Part-time workers who work four hours or less in a given week won’t see any reduction in their weekly unemployment benefit. Those who work five to 10 hours will get 75% of their weekly benefit. As the number of hours worked increases, the percentage of a workerâs weekly benefit amount decreases.

How Do States Calculate Partial Unemployment Benefits

The state determines your weekly benefit amount. Each week, you will claim unemployment benefits, where you will also report any income you earned. To account for this earned income, the state will generally subtract your reported earnings from your weekly benefit amount, after factoring in your earnings disregard. The earnings disregard is an amount that you can earn without having it affect your weekly benefit amount.

Individuals who qualified for partial unemployment benefits also qualified for the $600 PUA supplement, but this program has ended. The President has issued an executive action to relaunch the program, but it will take time for participating states to put this into place.

What Is An Offer Of Suitable Employment And How Is It Connected To Unemployment Insurance Eligibility

Most state unemployment insurance laws include language defining suitable employment. Typically, suitable employment is connected to the previous jobs wage level, type of work, and the claimants skills.

Refusing an offer of suitable employment without good cause will often disqualify individuals from continued eligibility for unemployment compensation.

For example, if an individuals former employer calls the individual back to work after having temporarily laid the individual off for reasons related to COVID-19, the individual would very likely have to accept the offer to return to work, or jeopardize his or her eligibility for unemployment insurance benefits, absent some extenuating circumstance, such as if the individual tested positive for COVID-19. The job an individual held before the spread of COVID-19 will constitute, in the vast majority of cases, suitable employment for purposes of unemployment insurance eligibility.

Your Work Search Responsibilities

To receive unemployment insurance benefits, you must seek work with at least three potential employers each week and maintain a detailed and verifiable record of your work search. If you cannot prove you looked for work, you may be considered overpaid and required to repay benefits.

How to File a Claim for Unemployment

Within one week of becoming unemployed, you should begin the claims process to receive your Reemployment Assistance benefits. The date your application is finished determines when you will begin receiving benefits. Claims always begin with the Sunday prior to the completion of the application. For example, an application completed on Wednesday will take effect on the Sunday before that Wednesday.

All claims in Florida must be completed online. The process should take approximately 30-60 minutes to complete.

Those who need assistance because of disabilities, legal reasons, computer illiteracy or language barriers should call 1-800-681-8102.

Once your claim is filed, you will receive a confirmation notice that your claim has been received. You must request benefit payment no later than seven days from your scheduled report date. If your claim is accepted, it will take two to four weeks to receive your first payment. The week you file your claim is a âwaiting weekâ during which no benefits are paid.

File Online As Soon As You Can If Possible

The good news, particularly for tech-savvy millennials, is that states are really trying to move as much processing online as possible, and thats been happening for a while. In most states, online applications are strongly encouraged, Evermore says.

The Department of Labors CareerOneStop site has a helpful tool where you can look up each states direct unemployment website and contact information.

Hawaii, for example, restricts online applications to between the hours of 6:30 a.m. to 11:00 p.m. HST, Monday through Friday, and between 9:00 a.m. to 11:00 p.m. HST on weekends and holidays. Its better to try to apply between 9 a.m. and 5 p.m., Evermore says.

File Partial Unemployment Insurance Claims

Partial unemployment insurance claims may be filed by employers for full-time employees who work less than full-time during a pay period due to lack of work only. The employees must still be attached to the employer and must have earned wages that do not exceed the weekly benefit amount plus $50.00.

  • Partial Claims should not be filed when an employee is out of work due to disability, workers compensation or medical leave.
  • Partial Claims should not be filed when an employee is not able and available to accept all work offered by the employer.

Partial claims may be filed via the Internet, on tape or diskette, or by mail. Filing Internet claims requires the employer to access the Employer Portal. Filing partial claims electronically via the Internet results in faster payment. Paper filed partial claims require manual review and processing therefore, payments may be significantly delayed during peak periods.

The Georgia Department of Labor Employer Portal provides self-service options with a single sign-on for UI services. UI tax-related and partial claims filing services will now be accessible only by registering and using the Portal.

You are not eligible for benefits in any week you work 32 or more hours, or when your gross earnings for the week are equal to or greater than your weekly benefit amount.

A partial benefit payment will be made for any week you work less than 32 hours and your earnings are less than your weekly benefit amount. The system will deduct 50 percent of your earnings from your benefit payment. The amount not paid for that week stays in your account.

Ial Unemployment Benefit Amounts: How Much Will You Receive

To figure out your weekly benefit amount, your stateâs unemployment agency will calculate how much you would receive if you were completely unemployed.

Then, the state will subtract what you are actually earning each week, less a small allowance. Most states let applicants keep a little bit of what they earn, without reducing their benefit amounts, to encourage people to take occasional work. The difference is your weekly partial unemployment benefit.

Here are a couple of examples:

Example 1. David works in California and would be entitled to a weekly unemployment benefit of $400, based on his prior earnings. He currently earns $280 per week at his job because his hours and pay have been cut. California disregards the first $25 or one-quarter of an employeeâs earnings in calculating partial unemployment benefits. The state would not count one-quarter of his earnings , but would subtract the rest from the weekly benefit he would receive if he were unemployed to come up with his partial benefit amount: $190.

What To Expect With Partial Unemployment

With partial unemployment, claimants still need to certify their benefits each week with their states unemployment office, including reporting the number of days/hours worked in the previous week, Tayne said.

Your unemployment benefit amount is determined by the state you live in and is typically based on how much you earn or have earned and how many hours you work. The state will typically determine a reasonable weekly value and then subtract the amount you make from work each week.

Each state is different, and in New York, for example, the individual working part time must make $504 or less and work no more than 30 hours to be eligible for partial benefits, Tayne said. Benefits are reduced by how many hours the individual worked in a week. So a person working 11 to 20 hours in a week will have benefits decreased by 50%.

If you fail to certify your gross weekly pay, the benefits will be discontinued. Also, you cant certify in advance because your certification is for the previous week. For the week of Sunday, March 7 through Saturday, March 13, for example, the earliest you could certify is on Sunday, March 14. If you end up collecting more unemployment benefits than you are eligible for because you did not report earnings, there are severe penalties, as you could be committing fraud.

The process of filing for partial unemployment is the same as filing for regular or full-time unemployment. To file a new claim or check eligibility, visit your states Department of Labor site. Most states have an FAQ page that is a great resource to confirm any questions you have about eligibility which, according to Tayne, is often easier than calling the organization directly.

Prior to filing for partial unemployment, it helps to gather all necessary information in advance, including your tax returns from the previous year, addresses and dates of former employment, and the exact amount of your gross wages.
