Posted: Each January, we mail an IRS Form 1099-G to individuals we paid unemployment benefits during the prior calendar year. The 1099-G form provides information you need to report your benefits. Use the information from the form, but do not attach a copy of the 1099-G to your federal income tax return because TWC has already reported the 1099-G information to the IRS.
What If I Have An Outstanding Overpayment From Previously Collecting Unemployment
On May 13 the NYS Department of Labor announced that forfeiture day penalties will be suspended for the duration of the pandemic emergency. Thats good news for anyone who was told they were going to have to wait until their forfeiture days were over to start receiving benefits.
Unemployed NYers with only forfeiture days on their accounts will immediately begin receiving $600 weekly FPUC payments, including back pay through the program’s launch on April 5. They will also begin receiving UI or PUA benefits they would otherwise be eligible for in ~2 weeks.

Forfeiture day penalties are days in the future that someone cannot receive unemployment insurance benefits, and they are given to applicants who willfully make a false statement to get benefits. The Department of Labor calls this overpayment or when people receive benefits they were not entitled to.
If you disagree with your overpayment determination or the forfeit day penalties, you have a right to request a hearing by visiting the Unemployment Insurance Appeal Board website.

So Do I Just Get The Extra $600 A Week From The Stimulus I Dont Have To Do Anything Extra
Yes, you just get it. The additional $600 per week will be automatically added to all unemployment benefits, whether you qualify for regular unemployment insurance or the newly expanded pandemic unemployment assistance.
If youre in the system to receive unemployment benefits of any kind, you will receive the extra $600 from the CARE Act each week until July 31. This also means that if you are working part time and receiving partial benefits, youll still get the extra $600. But you cant get this extra cash until youre able to successfully file your claim with the state.
How The Taxes On Unemployment Benefits Could Add Up
Take a single person getting benefits from being laid off due to the coronavirus.
He or she could receive a maximum New York benefit of $504 a week, plus the $600 additional CARES Act weekly payment that extends for 17 weeks for those impacted by the COVID-19 shutdown.
So the total income for those 17 weeks would be slightly more than $23,000. But that would also come with a combined federal and New York state tax liability of about $2,000, taking into account the standard deduction.
Depending on your specific circumstances, and your filing status, the tax liability may be higher or lower.
But the point is the same: Beneficiaries opting out of withholding are only delaying the inevitable sharing a portion of those payments with federal, state and, where applicable, local income tax collectors.
“The extra $600 is a serious tax issue and a lot of people are not expecting it will be taxable,” Kamlet said.
