You are disqualified from receiving unemployment benefits during an active labor dispute. You are not qualified for unemployment benefits when your partial or total unemployment is due to:

  • an active labor dispute at the factory, plant, etc. where you work or last worked or
  • an active labor dispute at another factory, plant, etc., owned by the same employing unit, which causes the materials or services necessary for operation of your factory, plant, etc. to become unavailable.

    Under normal circumstances you may qualify for regular state unemployment benefits if:

  • You are unemployed through no fault of your own
  • You worked for an employer who paid into the NC Unemployment Insurance Fund
  • You earned enough wages in at least two calendar quarters out of the last 5 quarters
  • You are not disqualified from receiving benefits due to misconduct, or for leaving work for a reason other than good cause attributable to the employer, or other disqualifying status
  • You are able and available to work, including that you are legally authorized to work in the U.S.
  • You are actively seeking work and
  • You file a claim for unemployment benefits and register for work with NC Works.
  • Due to COVID, Governor Cooper has waived the following requirements while the public health emergency is in effect:

    • There is no one-week waiting period to receive benefits once you are approved
    • There is no work search requirement to get unemployment benefits for claims filed before
    • Employers unemployment accounts are not charged for the unemployment benefits that their former employees receive if the unemployment was related to COVID-19.

    All of the following are required for you to be eligible for PUA benefits:

  • You are otherwise able to work and available for work except for these COVID reasons
  • You are not able to get paid for working from home

    In the last few years, many in the American workforce have gotten reduced working hours or have been laid off, primarily as a result of the global pandemic. Although the economy is recovering, businesses are stretching funds to stay afloat. And human resources are, unfortunately, the first costs to be cut.

    Unemployment benefits may help in the situation. However, many want to take on part-time work wherever they can to make ends meet. That said, the prospect of losing unemployment benefits may deter some from pursuing these opportunities.

    Sufficiency Of Ui Benefits

    Experts recommend that in order to be meaningful, a UI benefit should replace half of an average workers weekly wages. Before the last recession, in 2007, North Carolinas replacement rate was 49 percent. That dropped to 38 percent in 2019. Included in the 2013 legislation was a shift to calculating the weekly benefit amount on earnings in the most recent two quarters, or six months of work, rather than on the highest quarter of earnings in the benefit base period. This change effectively cuts benefits in two ways. First, averaging two quarters instead of simply using the highest quarter will usually result in a smaller benefit amount. Second, making it the most recent two quarters instead of the highest quarter can be particularly detrimental for a worker in a job that had cut back available hours and pay if it experienced a business slowdown. The change in the benefit-amount calculation can also harm workers in industries with highly variable hours and pay when they become unemployed.

    The 2013 change in the method for calculating benefit amounts caused a decline in the share of prior earnings being replaced for claimants, as well as a correlated decline in the average weekly benefit paid to claimants. In North Carolina, the average weekly benefit was $264.70 in the third quarter of 2019.     • The week ending September 4, 2021, is the last week of unemployment for which you can receive federal benefits. You may file your weekly certification for that week on or after September 5, 20201, and if eligible, you will receive payment for your last week of federal benefits.

    The maximum benefit an individual can receive in North Carolina is $350 per week. The formula generally aims to provide an individual with half of their average weekly salary, up to the max of $350. The minimum an individual can receive in regular state unemployment benefits is $15 per week. The minimum for federal PUA benefits is generally half of the states average weekly benefit amount, normally over $100 per week.     • Information on careers and the labor market
    • An assessment and an eligibility review
    • Help with developing a reemployment plan
    • Referrals to at least two reemployment-related services, such as workshops or training opportunities
    • An orientation to reemployment services

    Enrollment in the program can last up to 10 weeks.

    On March 27, 2020, the federal CARES Act was signed into law. The CARES Act creates three new federally-funded unemployment insurance programs. Workers can apply for these benefits through the state DES office as discussed above.
