The Internal Revenue Service said it will review all tax returns filed before the March legislation was signed into law. The agency “is reviewing those tax returns to determine the correct taxable amount of unemployment compensation and tax. Refund amounts will vary, and not all adjustments will result in a refund, the IRS said. Unemployment aid is taxable income.

How Long Can I Receive Benefits

An additional 7 weeks of benefits may be available if the unemployment rate remains high. These will be available in October at the earliest.;;

Getting Fired For Misconduct
Under Texas law, you will be denied benefits if you were fired for misconduct. If you were fired for intentionally failing to perform your job, breaking the law, or violating company policy, you will likely be disqualified from receiving benefits. On the other hand, if you were simply a poor fit or lacked the skills to perform your job, you will probably still be eligible for benefits.
Requesting Payment And Certifying For Benefits
You must request payment to receive benefits. Request benefit payment as instructed, approximately one to two weeks after you apply for benefits, and every two weeks after that. You can find the date you are scheduled to request payment online using;TWCs;Unemployment Benefits Services;or by calling Tele-Serv at 800-558-8321.; If you do not request payment within the calendar week your request is due, your payment may be delayed or denied.
Dont wait for TWC to notify you of your eligibility. Make sure to request payment on the date listed in the instructions sent to you by the TWC. If you cannot complete your payment request because of high call or user volume, you will need to call in and speak to a representative. If you delay requesting payment or cannot get through to TWC to complete your request, it will not affect your eligibility for benefits. However, it may delay when you receive your payment.
When requesting payment, you will answer several questions regarding your work and earnings and whether you met eligibility requirements during the claim period. Do You Meet The Minimum Earnings Requirement
Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment compensation. . In Texas, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your claim for benefits. For example, if you filed your claim in October 2020, the base period would be from June 1, 2019 through May 31, 2020.
If you have been out of work for a long time because of disability, pregnancy, illness, or injury, you may have low or even insufficient earnings during the regular base period to qualify for benefits. In this situation, you may be able to use an alternate base period that looks at your earnings history before you became unable to work.
During the base period, your work history and earnings must meet both of these requirements:

If you dont have access to the internet or need to talk to someone, you can try calling 800-939-6631, the TWCs main line for unemployment claims. But be prepared to wait anywhere from a few minutes to several hours. Jacobs recommends calling your local workforce office first and asking to be put into the hold queue for unemployment benefits if the call taker cant help you. Some Texans, like Ozona resident Sean Sanchez, 52, have had luck in recent months calling TWCs main line first thing in the morning. Start calling at 7 a.m. on the dot, Sanchez advised.
Request a call through the live chat function on the TWC website. At the bottom of the homepage, a virtual assistant can help answer common questions about TWC services. Check back in if you dont receive a call within a couple of days. Some people say they never heard back. You must be out of work through no fault of your own to qualify for unemployment benefits in Texas. If you are laid off, lose your job in a reduction-in-force , or get “downsized” for economic reasons, you will meet this requirement. In Texas, employees who are fired for work-related misconduct may not qualify for unemployment benefits. Examples of work-related misconduct include violating company policy, violating the law, or failing to perform your job if you are able to do so.
If you quit your job, you won’t be eligible for unemployment unless you had a good reason for doing so, relating to your work or a medical condition. If someone who truly wanted a job would have left their position in the circumstances you faced, you will still be eligible for unemployment benefits. If you left the job because of domestic violence or stalking, you may also be eligible for benefits. Whenever you quit, you will be expected to have documentation of your reasons .
If you quit to move with your spouse, you will be disqualified from receiving unemployment benefits for a period of time. However, if you are moving with a spouse who is in the military, you may be eligible right away, depending on the circumstances.

John was fired from his job after he was a no-call, no-show at work for six days. His truck broke down so he didnt have a way to get to work. After a week, he fixed his car and reported to work and was fired for job abandonment.
To receive benefits, John must meet the requirements for past wages, job separation and ongoing eligibility requirements.
Although he received two determination letters saying we could pay him benefits based on his past wages and transportation issue, he also received one letter explaining that we could not pay him benefits because he is disqualified on his job separation. Therefore, John will not receive benefits.
I Returned To Work After Filing For Benefits But Im Out Of Work Again What Do I Do
According to the workforce commission, if three weeks or less have passed since you last requested payment, you should go ahead and request payment again as normal. You should report any hours you worked or income you received during the time period for which you request unemployment benefits.
If it has been more than three weeks since you last requested payment, you should reapply for benefits. To help the TWC activate your claim quickly, the agency says, select layoff as the reason you lost your job. Choose layoff even if you were furloughed or the business where you were most recently working closed.

New Eligibility Requirement To Get Unemployment Benefits In Texas
Texas Workforce Commission reinstates work search proof
TYLER, Texas – Beginning November 1st, the Texas Workforce Commission is reinstating its work search requirements for any Texans on unemployment.
From mid-September to October 17th, TWC reported 4,890 unemployment claims in East Texas. Since June, it has not been required for applicants to perform work searches to receive unemployment due to the pandemic, but that will soon change.
According to James Bernsen, the Texas Workforce Commissions Deputy Communications Director, Texas is beginning to open up more and more businesses have found ways to open up and do so safely, that we think bringing back work search is more appropriate right now.
Beginning next Sunday, in order to be eligible for unemployment payments, applicants must conduct three job searches a week or take online classes that count as work searches.
Were really trying to get people back into searching for jobs. Not just checking a box, oh I looked at this job or that job, but looking at their career holistically, looking at building resumes, looking at going to our workforce development centers. There are a lot of things people can do to get them better positioned to get a job, Bernsen says.
According to TWC, if youve been furloughed youre exempt from work searches as long as theres a return to work date established within 12 weeks of the furlough. Other coronavirus-specific considerations are also taken.

You Were Fired For Misconduct
Theres a difference between getting fired and getting laid off. If youre fired for gross misconduct, then you likely wont qualify. Misconduct could include chronic lateness or absenteeism, carelessness or violence.
Some states only consider misconduct within the workplace. Others let employers fire employees for their behavior outside of work.
If theres bad blood between you and your employer, then you can argue your case at an unemployment hearing. If the judge decides against you, your last recourse is to appeal the decision and try again.

Cares Act Unemployment Compensation Expansion For Covid
The outbreak of COVID-19 has caused unprecedented changes to the lives of individuals all across Texas and across the globe. Since March 14, the Texas Workforce commission helped over 1 million Texans file unemployment claims which is equivalent to around 75 weeks of claims in a months time.
The Governor declared the COVID-19 Pandemic a disaster March 13, 2020; therefore, the TWC can backdate a claim to the prior Sunday which is March 8, 2020 if an individual was unemployed and has been trying to file but has not yet been successful. If the individual became unemployed subsequent to March 13, 2020 and has been attempting file but not yet successful then their claim will be effective the Sunday prior to the date they were separated from work.
The Texas Workforce Commission is working with federal, state and local government officials and agencies to help manage the Coronavirus pandemic.
Under the CARES act, there are three types of federal unemployment assistance now available:
