The Internal Revenue Service said it will review all tax returns filed before the March legislation was signed into law. The agency “is reviewing those tax returns to determine the correct taxable amount of unemployment compensation and tax. This could result in a refund, a reduced balance due or no changes to tax ,” the IRS said.

Refund amounts will vary, and not all adjustments will result in a refund, the IRS said. Unemployment aid is taxable income.

The IRS advises taxpayers who have not yet filed a tax return to follow the guidance for Forms 1040 and 1040-SR, which details how to exclude unemployment compensation.

The deadline for Texans to file their 2020 taxes was June 15, a deadline that was extended due to February’s deadly winter storm.

Yes. The Coronavirus Relief Bill extends the two types of unemployment benefits established under the CARES Act that real estate professionals may be eligible for:

  • Federal Pandemic Unemployment Compensation. The FPUC now allows for a $300 benefit through March 14, 2021. Under the CARES Act, this benefit was $600, but expired in July.
  • Pandemic Unemployment Assistance. PUA is based on previous income and now provides benefits for up to 50 weeks. The Texas Workforce Commission will continue to run this program and regular state unemployment benefits under the CARES Act, until March 14, 2021. Eligible workers still receiving benefits as of March 14, 2021, would be able to keep receiving benefit until April 5 .

    Per the Texas Workforce Commission , payments under this legislation are authorized to begin for the payment week ending January 2, 2021. For Federal Pandemic Unemployment Compensation, eligibility will begin on December 27, 2020, with the first payments set for the week ending January 2. If you have an existing claim, you do not need to take any further action. TWC will automatically update your claim and inform you of your potential eligibility.

    How Long Can I Receive Benefits

    Workers who qualify for benefits under Texas law can receive an initial 26 weeks of benefits. If they exhaust this, there are up to 26 extra weeks available. An additional 7 weeks of benefits may be available if the unemployment rate remains high. These will be available in October at the earliest.;;

    On December 27, 2020, a new pandemic relief bill was signed into law.;Under this legislation, unemployment benefits may be extended by up to 11 extra weeks.;

    Requesting Payment And Certifying For Benefits

    Do You Meet The Minimum Earnings Requirement

    Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment compensation. . In Texas, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your claim for benefits. For example, if you filed your claim in October 2020, the base period would be from June 1, 2019 through May 31, 2020.

    If you have been out of work for a long time because of disability, pregnancy, illness, or injury, you may have low or even insufficient earnings during the regular base period to qualify for benefits. In this situation, you may be able to use an alternate base period that looks at your earnings history before you became unable to work.

But be prepared to wait anywhere from a few minutes to several hours.     New Eligibility Requirement To Get Unemployment Benefits In Texas

    Texas Workforce Commission reinstates work search proof

    TYLER, Texas – Beginning November 1st, the Texas Workforce Commission is reinstating its work search requirements for any Texans on unemployment.

    From mid-September to October 17th, TWC reported 4,890 unemployment claims in East Texas. Since June, it has not been required for applicants to perform work searches to receive unemployment due to the pandemic, but that will soon change.

    According to James Bernsen, the Texas Workforce Commissions Deputy Communications Director, Texas is beginning to open up more and more businesses have found ways to open up and do so safely, that we think bringing back work search is more appropriate right now.

    Beginning next Sunday, in order to be eligible for unemployment payments, applicants must conduct three job searches a week or take online classes that count as work searches.

    Were really trying to get people back into searching for jobs. Not just checking a box, oh I looked at this job or that job, but looking at their career holistically, looking at building resumes, looking at going to our workforce development centers. There are a lot of things people can do to get them better positioned to get a job, Bernsen says.

    According to TWC, if youve been furloughed youre exempt from work searches as long as theres a return to work date established within 12 weeks of the furlough. Other coronavirus-specific considerations are also taken.

    Cares Act Unemployment Compensation Expansion For Covid

    The outbreak of COVID-19 has caused unprecedented changes to the lives of individuals all across Texas and across the globe. Since March 14, the Texas Workforce commission helped over 1 million Texans file unemployment claims which is equivalent to around 75 weeks of claims in a months time.

    The Governor declared the COVID-19 Pandemic a disaster March 13, 2020; therefore, the TWC can backdate a claim to the prior Sunday which is March 8, 2020 if an individual was unemployed and has been trying to file but has not yet been successful. If the individual became unemployed subsequent to March 13, 2020 and has been attempting file but not yet successful then their claim will be effective the Sunday prior to the date they were separated from work.

    The Texas Workforce Commission is working with federal, state and local government officials and agencies to help manage the Coronavirus pandemic.

    Under the CARES act, there are three types of federal unemployment assistance now available:
