Ui Back Payments With End Of Extended Unemployment Programs

With the expiry of federal enhanced unemployment benefit programs like PUA, PEUC, $300 FPUC and $100 MEUC after September 6th 2021 in all states, there have been a lot of questions around what happens with ongoing, new and past payments.

Ongoing and new weekly payments will end after September 6th . This means a cessation of federal pandemic unemployment benefits for 8 million+ jobless or under-employed claimants which that will result in them losing all current and future benefits under the PUA, PEUC or supplementary $300 FPUC programs.

States like New Jersey and California, have already stated that validated claims after a successful determination or appeal for eligible weeks would be paid out over the next several weeks. Note, per the sections below, that back payments are limited to the program extension coverage periods.

Eligible Claimants should continue to certify for benefits for weeks they are owed unemployment. Any weeks of unemployment that occurred before these programs expire can still be paid retroactively if a claimant is later determined to be eligible for those weeks of benefits. Check your state unemployment website for more details on certifying for retroactive back payments.

Biden Stimulus Pua Extensions To September 6th 2021

The PUA program, designed for freelancers, gig workers and independent contractors or those that generally dont qualify for regular state unemployment has been extended by another 29 weeks under the Biden Stimulus Plan that has been passed into law.

Under the enhanced unemployment funding extensions the total number of covered weeks in the PUA program will increase to 79. This does not include extra weeks some states provided for residents under this program and would be reduced by any weeks of regular UC and EB that the individual receives during the coverage period. You can see an overview of the federal extensions to date, including PUA, in the diagram below.

The minimum PUA payment is still 50% of a states average weekly benefit amount and limited to the states maximum weekly benefit amount . Another change to the earlier PUA extension is that that the 4-week phaseout period for active claimants has been removed. So all benefits will end by September 6th, even if claimants have a claim balance remaining.

Those who had regular/W2 jobs could technically qualify for the PUA program, but would need to first use up their allocation of regular state unemployment, extended benefits and enhanced unemployment benefits under the PEUC program.

Benefit Year End Date

A regular unemployment insurance benefit year ends 12 months after the claim started.

You cannot be paid for weeks of unemployment after your benefit year ends, even if you have a balance on your claim. Continue to certify for benefits if you have weeks available within your benefit year.

You can reapply for a new claim if you earned enough wages in the last 18 months and are still unemployed or working part time. Apply online, and we will notify you when your new claim is processed. This usually takes two to three weeks.

Several readers have asked if the $600 payment will be back dated for those who become eligible for state unemployment benefits under the PUA program. While this is subject to the different timelines of the PUA and FPUC programs, generally speaking if you qualified for the PUA program between early April and the end of July, you would be eligible for FPUC benefits per the dates shown below. Will I Get Back Payments Automatically Applied Or Manual Claim/actions Required

Once states are able to update their IT systems to pay the extended PEUC and PUA benefits they are automatically adding the extra weeks to eligible claimant accounts. One the claimant claims or certifies for the relevant weeks they should get payment for current and past eligible weeks.

However due to the complexities, unique cases or system limitations some states area asking claimants to take manual actions to get back payments. For example in Pennsylvania , claimants on PEUC are being requested to email the UC Help Desk for backdating retroactive weeks. Similarly in IDES in IL is asking claimants to call their call center representatives to discuss backdating their claims

So essentially if you cannot claim your past weeks online or you have received a current/recent week payment but no back payments for prior eligible weeks or any official notification of delays, then you will likely have to take a manual action via your state UI agency to get your payment.

B Time Requirements For Continued Claims

Title 22, Section 1326-6, provides:

. The claimant shall, to maintain his or her eligibility to file continued claims during a continuous period of unemployment, file continued claims at intervals of not more than two weeks, or such other interval as the department shall require, unless he or she shows good cause for his or her delay in filing his or her continued claim.

The Department communicates this requirement to claimants on the continued claim form, which shows the date the form is to be mailed. A Guide to Unemployment Insurance Benefits, DE 1275A, advises claimants to mail the continued claim form on the date shown on the front of the form it also advises claimants that they may lose benefits if they mail the form more than 14 days after the last week ending date.

Congressional leaders and the President have now passed another COVID relief stimulus package into law. The package includes funding for extending the $300 FPUC weekly boost, Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation programs to September 6th, 2021 or the earlier end date some states have chosen to end participation in these federally funded programs.

Some lawmakers, economists and advocates have spent months making the case to extend pandemic UI as the delta variant caused Covid caseloads to rise and job market recovery to slow.

But much of the grassroots advocacy that helped spur previous extensions didn’t see enough momentum make it to Congress this time around.

By August, the Biden administration called on states to use emergency coronavirus funds to provide additional benefits to millions of Americans who remain out of work across the country. But the majority of state labor departments confirmed they have no intention of extending or providing additional benefits on their own.

ExtendPUA has since added to its advocacy resources ways people can contact their state legislators to urge them to provide more financial and career support to unemployed constituents.

Many worker advocacy groups, including ExtendPUA, Unemployed Action and Unemployed Workers United are also putting pressure on policymakers to institute more long-term systemic reform to cover more workers and put in automatic stabilizers, like the unemployment rate, to trigger federal relief rather than letting lawmakers choose calendar dates.
