How To Go About Collecting Unemployment

Don't Miss

Q: Can You Get Unemployment Compensation

Why go back to work if you can make more money collecting unemployment?

A: You are eligible to receive unemployment compensation if you:

  • Were fired or laid off through no fault of your own, or if you were forced to quit because of a compelling reason, and
  • Are able and available to work at another job that is suitable, considering your skills, education, or training, and
  • Worked for a company that paid unemployment compensation taxes, and
  • Earned enough money to qualify for unemployment compensation.
  • What Happens If You Quit Or Get Fired

We will schedule a phone interview to discuss your claim and circumstances. If you quit, you must prove good cause for quitting. If you are fired, your employer must prove there was misconduct. Either party can disagree with the decision and file an appeal.

If you do not receive a call at your scheduled appointment time, we may have canceled your appointment because we confirmed your eligibility or resolved the issue before your interview. If your appointment has been canceled, it will no longer show in UI Online. Check UI Online for your current payment status.

    While You Receive Benefits

If you do meet all the various qualifications to receive unemployment, be aware that compensation comes with conditions. While you are receiving unemployment, you must be actively seeking a new joband states can request proof of your job search.

If you turn down a suitable position , your unemployment benefits may be terminated. Also, during the Great Recession that bottomed out in 2009, many states changed their laws to prohibit receiving severance and unemployment benefits simultaneously.

Can You Take A Vacation While On Unemployment

You probably could use a vacation, as we all know how stressful big life changes can be. But if youre collecting unemployment insurance, you must be able to accept a job if one is offered to you. For that reason, during a trip away, you cannot claim benefits. If you do, you could find yourself in trouble, even charged with unemployment fraud.

Now that you know if you can file for unemployment if you quit your job, you may have other pressing questions, including:

    • Is unemployment compensation enough to live on?
    • How long will you receive payment while you search for your next job?

The answers all depend on where you live. Most states offer 26 or more weeks of benefits. Georgia has one of the shortest limits at 14 to 20 weeks but increased to 26 weeks during the coronavirus pandemic.

The government determines your benefits as a percentage of your former salary. States also set a cap on how much youll get. Alabama has one of the lowest limits at $275 a week. Massachusetts has one of the highest at $855.

Richmond Hill Salvation Army Kicks Off Christmas Kettle Drive Nov 16

    timerupdate

The Salvation Army’s iconic red Christmas kettles are expected to return to the streets of Richmond Hill, hoping to raise $140,000 through the holiday season to help the less fortunate weather through the tough times.

The annual Christmas Kettle Kick-off is slated on Tuesday, Nov. 16 at 9 a.m. at Hillcrest Mall, located near the set of Santa Claus.

“This kickoff will draw attention to the public of the Christmas kettles and the solicitation of support from the greater community to help us raise $140,000 to ensure we can continue to help those in our community who have fallen on tough times,” said Major Everett Barrow.

City councillors are invited to the event along with representatives from the mall management and the Salvation Army.

The Salvation Army’s Christmas Kettle Campaign is one of Canada’s largest and most recognizable annual charitable events.

The Christmas Kettle Campaign is essential to so many, and because of the continued support in the communities, last year the Salvation Army in Ontario was able to help 1.1 million individuals and families across the province.

Here in Richmond Hill, they provided 673 households which included approximately 2,680 individuals with food security, clothing, winter coat program, back to school programming and other support.

    How Policies Protect Your Business

How to Collect Unemployment: 15 Steps (with Pictures ...

In addition to solid documentation of corrective action, it is important to have a clearly written employee handbook that contains policies with specific language that helps officials come to a resolution in your favor. Your employees also need to sign the handbook to acknowledge the policies inside.

A big part of the unemployment decision can be how reasonable the judge found the employers policies, the employers actions, and, of course, the employees actions.

UI benefits are there for the employee, so the scales are already tilted in the employees favor. Unfortunately, a lot of UI decisions are unpredictable as they come down to how the judge personally views the employees situation.

Again, even in a seemingly straightforward case of willful misconduct, there are no guarantees that the employee will be disqualified from UI benefits. But, you will very much increase the chances of this happening if you follow the steps detailed above .

Guidelines For Qualifying For Unemployment Benefits

How can you tell if you’re eligible to receive unemployment? Each state sets guidelines that determine whether an individual will be eligible for unemployment benefits, and how much compensation they will receive.

There are eligibility requirements to qualify for unemployment benefits, including having worked a certain number of weeks for a certain number of hours each week. Those guidelines also determine how many weeks of benefits an unemployed worker can collect.

You’ll find detailed information regarding eligibility criteria on your state unemployment website. In most states, you will need to have worked for a certain period of time, met minimum earnings requirements, and have lost your job through no fault of your own. If your claim is denied or contested by your employer, you can appeal the denial.

But even if youve been terminated for cause, dont assume youre out of luck. You may be able to collect, depending on the circumstances, and whether or not the termination was justified. Its worth it to learn about your rightsincluding your right to appeal a denial of your unemployment claimsbefore you give up on the idea of filing for benefits.

Check with your state unemployment department for information on qualifying for and collecting unemployment compensation in your location.

    Keep Filing For Unemployment

Continue to file for unemployment payments as scheduled until you have gone through the appeals processand dont press pause on your job search process. Unemployment benefits are generally contingent on the recipient looking for work. You dont want to get all the way through your appeals process, only to discover that youre disqualified from receiving benefits because you are not actively job searching.

Weather Related Unemployment: Whats The Difference

First things first: do not confuse seasonal unemployment with a weather-related job disruption. While there are jobs that entail seasonal unemployment caused by weather , these should be viewed as seasons, therefore the layoffs are due to seasonal demands.

Weather-related unemployment only becomes valid when a weather-induced disruption causes loss in wages or outright unemployment. A lifeguard who goes home for the winter is not the same as a construction worker laid off for a few weeks because of snow. In this scenario, the construction worker would qualify for unemployment benefits, but not the lifeguard.

Will Applying For Social Security Benefits Affect Unemployment

Problems with over-payments going out to people collecting unemployment benefits

While unemployment benefits will not affect Social Security payment amounts, unless the payments exceed the SSI maximum, the opposite is true under some circumstances. Funds received through one of Social Security benefit programs may end up reducing a persons unemployment benefits, depending on the state in which the recipient lives.

Social Security benefits only affect unemployment benefit amounts in the following states: Illinois, Louisiana, Minnesota, and South Dakota .

This wasnt always the case. In the early 2000s, 20 states and the District of Columbia had Social Security offset laws. States began repealing them in 2003 amid advocacy efforts on the issue. The most recent state to do so was Illinois, which repealed its offset law in 2015.

Minnesota still has partial offset laws regarding Social Security and unemployment compensation. For residents who receive both benefits, Minnesota reduces unemployment insurance by half of your Social Security benefits. There are determining factors, such as when you started receiving disability payments and the length of time between filing for Social Security and filing for unemployment.

For Starters Who Is Eligible For Unemployment

Not every person who’s out of work is eligible to receive unemployment benefits. Exact eligibility requirements vary by state but guidelines generally include:

    • You must meet your state’s minimum earnings requirements. To qualify, employees must have worked a certain amount and/or worked a minimum amount of time prior to becoming unemployed.
    • You must be actively looking for work. Many states require that, if you are able and available to work, you must look for work in order to continue receiving benefits.
    • You must be out of work through no fault of your own. If you quit your job without good cause or if you were fired for misconduct, you may not qualify.

Find your state unemployment insurance office to learn more about eligibility in your state.

You Are Eligible For Unemployment Benefits Only If You’re Able To Work

    By Lisa Guerin, J.D.

Unemployment benefits are meant to act as a temporary safety net for employees who are out of work through no fault of their own — to tide them over until they can find a new job. These days, of course, many out-of-work employees have found new work hard to come by, no matter how hard they pound the pavement. But the unemployment system requires workers to look for work — and to be able and available to work, should a job turn up.

If you earn as much as your weekly benefit or more, no payment would be made for the week.

But if your earnings are less than the weekly benefit amount, the first $58 would be discounted and the remainder deducted from the weekly benefit amount, according to Floridas Agency for Workforce Innovation.

The difference would be your unemployment payment for that week.

    Proving You Had Good Cause

If you claim that you were forced to quit, you will probably have to go through a hearing process to qualify for unemployment benefits. When an employee is laid off or fired for reasons other than serious misconduct, most employers don’t contest the employee’s claim. Even though unemployment claims cost employers money, there’s no good reason to fight an eligible employee’s claim for benefits — and little hope of succeeding. If an employee claims he or she was forced to quit, however, the employer might have more incentive to contest the claim. The employee won’t be eligible for benefits if the employer convinces the hearing officer that he or she quit voluntarily. And, no employer wants to admit that an employee was constructively discharged . Many employers will choose to fight this type of claim, hoping that they can win and avoid setting the employee up for a wrongful termination lawsuit.

To prepare for the hearing, think about how you can prove that you had to quit. If you quit for medical reasons, ask your doctor to document your condition and why you could no longer do your job. If you quit to relocate with your spouse, get a copy of your spouse’s offer letter or official paperwork from the military , as well as any documents showing when you moved.
