What Do Disability Judges Think About Collecting Unemployment

Not all disability judges will deny you benefits because of it judges fall into four categories.

  • Some judges don’t like to see that disability applicants are collecting unemployment benefits, no matter what the circumstance.
  • Other judges will deny your disability claim only if you received unemployment after you applied for disability benefits, unless you can prove your condition medically worsened since you applied for unemployment benefits.
  • Other judges simply will not pay you disability benefits for the time period that you were receiving unemployment your disability onset date so that your disability starts after your unemployment benefits ended).
  • Still others judges don’t care even if you’re receiving unemployment benefits at the time of your hearing. These judges realize that people need income to live on, and that there is no guarantee that someone will receive disability benefits after the long process of applying for benefits.

Receiving Social Security Disability Benefits And Unemployment Benefits Simultaneously

If you are wondering about claiming Social Security Disability Benefits and Unemployment Benefits together then you are not alone. Let us address this question by first understanding the difference between Social Security Disability Benefits and Unemployment Benefits.

Social Security Disability Benefits

Social Security Disability Insurance benefits are administered by the Social Security Agency of the state you reside in. This is a federal program that administers benefits to individuals who are unable to work for wages due to some sort of medical condition or disability. The basic eligibility criteria for claiming these benefits is that you have worked successfully in the past, and are unable to continue working on medical grounds. The severity of your disability restricting your work abilities is also taken into consideration by the SSA while making a decision on your claim. It can be a long and arduous road to get a decision on your claim from the agency.

How Can You Receive Both Benefits At The Same Time

The Social Security Administration does not deny an individual the ability to collect both SSD benefits and Unemployment benefits. Since eligibility for unemployment benefits hinges on your ability to be ready and able to work at any given time and SSD benefit eligibility hinges on your ability not to be able to work, these two are often mutually exclusive. Exceptions do exist, however. If you attempted to re-enter the workforce through the Social Security Administrations Ticket to Work Program or if you previously worked full-time but are now only able to work part-time due to medical restrictions, you may be able to qualify for both sets of benefits.

The Ticket to Work Program is a program that lets individuals with disabilities test their ability to re-enter the workforce. Individuals have nine months to determine if they are able to work in some capacity, while still keeping their SSD benefits. If an individual worked in this program for less than 9 months but was suddenly laid off, then they may qualify for both unemployment benefits and SSD benefits.

With a qualified attorney on your side, you may be able to prove your eligibility for both types of benefits. Yet, you may face repercussions for double dipping if you are unable to make a solid case for receiving both benefits at the same time.

How Is Application Duration Related To The Use Of Coping Strategies

Table summarizes regression results using an unbalanced sample, which includes both completed and right-censored observations19. Column and presents regression coefficients of linear probability models estimating equation for the two regressions: month of initial application and all months of application. Column and presents IV results from equations and for month of application and all months of application, respectively. For the month of application , the IV measures whether applicants react to an unexpectedly change in the wait time by changing their initial coping strategy, during the first month of application. For all months of application , the IV measures how an unexpected change in the wait time is related to changes in coping strategies over the full course of the application.

Finally, as our descriptive statistics show that applicants of the 1990s are significantly different from applicants of the 2000s, we also explore an interaction model with the period dummy interacting with the waiting duration. We find that compared to applicants of the1990s, applicants with longer wait-time of the 2000s are increasingly more likely to use SNAP and UI benefits to fund consumptions while waiting for SSDI benefits, and less likely to use workers compensation, sell the house, or borrow from credit cards.

Should I File For Unemployment And Social Security Disability

Becoming disabled is more than just a physical problem. Unable to work due to declining health, individuals with disabilities often face financial hardships as well. While a disabled person might immediately file for Social Security Disability Insurance benefits, there is a minimum five-month wait period. Due to the vast number of disability applicants, approvals can take up to three years in some cases. Unfortunately, the financial responsibilities of life do not stop during difficult times.

Many individuals are forced to look for other means of financial assistance during this time. Some people turn to unemployment benefits as a means of support. While this may seem like a good idea, applying for unemployment can hurt a claimants ability to earn disability benefits. As the two programs serve very different purposes, applicants who apply for both may appear to be contradicting themselves.

The Use Of Coping Strategies Before At And After Application

The average application duration is over 6 months, or approximately 200 days, but wait times are quite skewed to the left, as depicted by Figure. Specifically, the 25th percentile is 60 days, the median wait time is 101 days, and the 75th percentile is 152 days. The right tail is also quite long, with 12 percent of the sample waiting at least one year, and 5 percent of the sample waiting more than two years.

    Figure 1

While not shown in the figures, we also find that home ownership declines, suggesting SSDI applicants could be using housing assets to support their consumption. In addition, the probability of changing address decreases over time. While applicants may borrow from credit cards to fund consumption while waiting, there is no significant correlation between borrowing from other financial resources and waiting time.
