What Is An Unemployment Overpayment Appeal Letter
It is a formal letter written by an individual/ex-employee after receiving notification that there has been an overpayment of his or her unemployment benefits. In some cases, former employers take the step of filing an appeal to reconsider the decision on unemployment compensation due to a miscalculation of payments.
On the other hand, former employees are also entitled to take the same route, filing an appeal in order to maintain the amount of the allowance. Showing a disregard for an overpayment letter can result in rejection of further unemployment assistance, and may even be considered an act of fraud.
Therefore, it would be wise if the former employee immediately followed up the notification of the overpayment by submitting a document to the competent department in charge of this matter.
Pa Unemployment Compensation Appeal
If your initial claim for Unemployment Compensation benefits was denied, you have the right to appeal this decision and have your case heard in front of a Pennsylvania Unemployment Compensation Referee. If your eligible decision was appealed, you can expect your employer to contest your case here as well. The purpose of the unemployment hearing is to ascertain your eligibility by obtaining all evidence related to your case, in other words, this is your one shot at putting all the evidence on the table. Many claims in the Pittsburgh region will heard at the Pittsburgh Referee Office, Suite 340 Piatt Place, 301 Fifth Avenue, Pittsburgh, PA 15222.
You and your former employer both have the opportunity to present evidence and testimony to support your claims. This is precisely the reason most people need counsel because its just like a court of law where both sides can say objection! The Pennsylvania Rules of Evidence apply, and we know its not fair to the employee, but the reality is that we win many of our unemployment cases using the technical rules to include or exclude all sorts of evidence . The secret to win your PA Unemployment Compensation Appeal Hearing is most often to know the objections to use so the employer cant introduce evidence against you.
Should I Represent myself at an unemployment appeal hearing? No.

How Is The Overpayment Repaid
In most cases, you will be asked to repay the overpayment. You may be asked to send a check for the balance of the overpayment. If you can’t repay it all at once, you may be able to negotiate a payment plan.
Otherwise, if you are entitled to further benefits, you may be able to use those benefits to repay the overpayment.
In some states, you will forfeit days or weeks of unemployment to make up what you owe.
For example, in New York, you will lose 25% of your benefits for that week for every forfeit day that is assessed, so if you have four forfeit days, you would receive no benefits for that week.
If you have not made an adequate arrangement for repayment, the money that you owe may be seized from your paycheck , lottery winnings, or tax refunds.
If the overpayment was because of fraud, you may be charged a penalty and possibly charged with criminal fraud. Also, you may be banned from collecting future unemployment benefits.

Overpayment Of Unemployment Benefits
You could have been overpaid because of an error or because you claimed benefits you were not entitled to receive. For example, some of the reasons a claimant might be overpaid include the following:
- You made a mistake when claiming benefits.
- You were not ready, willing, and able to work.
- You did not complete the required work search activities.
- You knowingly gave false or misleading information when filing a claim or claiming weekly benefits.
Another reason could be that your former employer successfully contested your unemployment claim. If this was the case, the state could have determined that you were not eligible for benefits. In most cases, you will be required to repay the unemployment compensation that was overpaid.

Requirements For Qualifying For Unemployment
Eligibility requirements to qualify for unemployment compensation vary from state to state. However, according to the U.S. Department of Labor, there are two main criteria that must be met in order to qualify:
1. You must be unemployed through no fault of your own. In this case, a persons unemployment must be caused by an external factor beyond his or her control, such as a layoff or a furlough. Quitting your job with a good reason or being fired for misconduct in the workplace will most likely render you ineligible for unemployment benefits.
2. You must meet your states requirements for time worked or wages earned during a set period of time. This marker can be confusing, but its safe to assume that if you had a long-term job that you lost unexpectedly or without just cause, you would meet your states requirements.
Apply By Filing Your Initial Claim
To find out if you qualify for unemployment benefits, you need to fill out an application. This is called filing an initial claim. You only file an initial claim once per benefit year. Before you start filling out an application, gather the required documents.
Take the Eligibility Quiz first to make sure you are filling out the right application. Filing out the wrong application will delay your benefits by several weeks.

Overpayments for which you were determined to be at fault accrue interest. The annual interest rate is 12% of the unpaid principal per year and begins accruing 30 days after the Notice of Determination is issued.
Overpayments that were determined to be at fault may be assessed a one-time 15% penalty. In some cases, you may also be required to serve penalty weeks for each week you were at fault for being overpaid benefits.
- Your penalty weeks will begin the next time you file a claim or request weekly benefits and are determined eligible
- Regardless of the penalty, you should continue to request weekly benefits for each week that you are unemployed in order to successfully serve the penalty weeks
- During the penalty week period, you will be disqualified from receiving benefit payments
- You will not receive any future benefits until all penalty weeks are served

If Youre Moving To Universal Credit From Income
If your income-based JSA claim is ending because youre making a new claim for Universal Credit, youll automatically continue to get the amount of JSA you currently receive, as long as youre still eligible. Youll normally get this for 2 weeks, starting from the date of your new claim.
The Department for Work and Pensions will write to you telling you how this works.
You do not need to pay this money back, and it will not affect the amount of Universal Credit you get.
