Requirements For Qualifying For Unemployment

Eligibility requirements to qualify for unemployment;compensation vary from state to state. However, according to the U.S. Department of Labor, there are two main criteria that must be met in order to qualify:

1.;You must be unemployed through no fault of your own.;In this case, a persons unemployment must be caused by an external factor beyond his or her control, such as a layoff or a furlough. Quitting your job with a good reason or being fired for misconduct in the workplace will most likely render you ineligible for unemployment benefits.

There may be an exception, however, if;wrongful termination;or;constructive discharge;played a role in your termination from employment.

2.;You must meet your states requirements;for time worked;or wages earned during a set period of time.;This marker can be confusing, but its safe to assume that if you had a long-term job that you lost unexpectedly or without just cause, you would meet your states requirements.

Is There An Unemployment Waiting Period

Unemployment insurance waiting periods are 100% state-driven. Many states have what is known as a “waiting period,” otherwise referred to as a “waiting week” as part of their unemployment insurance laws.

For example, in New York State, you must serve an unpaid waiting period equivalent to one full week of unemployment benefits before you receive payments. Minnesota has a non-payable waiting week before benefits can be collected. In some locations, the waiting week benefits will be paid, but you will have to wait until the end of the claim period in order to collect those funds.

Based on the state-by-state differential, it’s best to check with your;state unemployment office website as soon as you lose your job;for information regarding the unemployment waiting period in your location.

Do I Qualify For Unemployment Benefits

Traditional unemployment benefits in Texas are typically available to people who have been laid off from their jobs or who have lost hours or wages for reasons that arent tied to employee misconduct. They are funded through employer taxes and meant to provide a temporary, partial income replacement for people who meet certain qualifications.

Melissa Jacobs, an attorney with Texas RioGrande Legal Aid, says generally, people who are separated from work through no fault of their own qualify for some type of assistance.

State unemployment systems across the country have changed, however, during the coronavirus pandemic. The CARES Act, a federal law passed in March, has temporarily made many more workers whove been affected by COVID-19 eligible for unemployment assistance than would be otherwise under Texas law. Those workers include independent contractors, gig workers, people who have already used up their unemployment benefits and people who didnt earn enough in the past to qualify for regular unemployment. TRLA offers a detailed breakdown of who can access unemployment benefits during the pandemic here.

Im On Floating Or Furlough Status Can I Avail Of The Sss Unemployment Benefits

How To Register For Unemployment

No. Technically, furloughed employees are still employees. They may be temporarily off the payroll but they retain their employment rights and can still enjoy some of the company benefits. They are different from laid-off workers who are technically not employees of the company anymore.

Since furloughed employees are still considered employed, they cant be issued the required termination contract and DOLE certificate necessary to be qualified for the SSS unemployment benefits.

Learn About Federal Unemployment Extension Requirements

Claimants eligibility for unemployment extensions is determined based on similar criteria to what unemployment offices use when candidates first apply for enrollment. These prerequisites include:

  • Reasons for job loss Applicants must be out of work due to circumstances they could not control.
  • Available to work Petitioners need to be able to work during normal hours, and they cannot have scheduling conflicts that prohibit them from working.
  • Searching for job opportunities The qualifications for unemployment benefits extensions also indicate that petitioners must be actively looking for new work opportunities while they receive UC.

In addition to these unemployment insurance eligibility requirements, petitioners must also ensure that they meet an extension-specific prerequisite. This requirement states that claimants who enroll in a federal unemployment extension also must have utilized all of their states available benefit weeks. These limits vary from one state to another. However, petitioners must know that any Disaster Unemployment Assistance or Trade Readjustment Allowances do not count toward this total. Furthermore, petitioners must also be aware that not all claimants who qualify for UI are eligible to receive these extensions. Candidates must consult with their local UI office to determine if they could be candidates for this program.

How Much Unemployment Benefits/insurance Will Be Given To Qualified Sss Members

How to apply for unemployment in IL

The simplest answer is you can get an unemployment benefit equivalent to 50% of your monthly salary for a maximum of two months. So if you earn Php 10,000 a month, for example, the amount of insurance you can claim is basically the same amount .

Alternatively, you can use the following formula:

Unemployment Benefit = Average Monthly Salary Credit x 50% x 2 months

As you may recall, SSS uses the monthly salary credit to determine the amount of contribution that will be deducted from the employees salary.

Basically, the MSC is the median of the range of compensation, with the minimum and maximum MSC currently set at 3,000 and 25,000, respectively .

Lets say you have a monthly salary of Php 10,000. As you can see in this SSS contribution table, that salary falls in the 9,750 10,249.99 range so your monthly salary credit is Php 10,000.

Take note that monthly salary credit is different from the average monthly salary credit .;

According to the guideline written in the Social Security Act of 20183, your average monthly salary credit shall be the higher of the following:

  • The result obtained by dividing the sum of the last sixty monthly salary credits immediately preceding the semester of contingency by sixty ; or
  • The result obtained by dividing the sum of all the monthly salary credits paid prior to the semester of contingency by the number of monthly contributions paid in the same period.
