Which Benefits Are Taxed

Typically, unemployment insurance benefits are subject to federal income tax. You may have been unemployed, but its still income, and consequently still subject to income tax.

In addition, some states also expect you to pay income tax on unemployment benefits that you receive. Obviously, states without a state income tax, such as Alaska, Nevada, and Washington, dont tax unemployment compensation either. But even some states with a state income tax dont tax unemployment insurance benefits, such as Alabama, California, and the District of Columbia .

Your city or county may tax unemployment compensation as well.

In 2020, 40 million people received unemployment compensation, and fewer than 40% of them had taxes withheld on it, according to USA Today.

If youre one of them, its important to make sure youre keeping track of the amount youre making in unemployment compensation throughout the year so that youll have the money to pay the taxes at the end of the year, or quarterly through estimated taxes. On the federal level, the IRS can help you keep track of that as well.

Paying Unemployment Taxes At The State And Local Level

At the local and state level, the options to pay for your state and local taxes may differ depending on where you live. Contact your state, county, or local unemployment office to learn about the different options to pay your taxes. These options may include:

1. Requesting to have state and/or local taxes withheld. The steps to request state and local tax withholding differ.

2. Making quarterly estimated payments. The due dates for estimated payments at the state and local level may differ from federal due dates.

3. Paying your taxes in full. If you need your full amount of your unemployment benefits and cannot make quarterly estimated payments, you can pay your taxes all at once when they are due. However, you may receive an underpayment penalty for not paying enough taxes throughout the year.

Millions of taxpayers who are expecting an additional refund check related to unemployment compensation are checking their bank accounts this week and wondering if the much-anticipated payment will finally arrive.

They have good reason to wonder: After the Internal Revenue Service announced that it had sent out the first round of 2.8 million refund checks a few weeks ago, it followed up by saying the next batch would be sent out in mid-June.

What exactly counts as mid-June? Unfortunately, the IRS did not share those specifics, but the agency tends to put out updates late on Fridays, so with any luck well know a bit more about the timeline soon. Weve reached out to the IRS for more information and will update this post if we hear back.

The refund checks were announced in March, after the passage of the American Rescue Plan Act, which exempted up to $10,200 in taxable income on unemployment compensation paid in 2020. The IRS said it identified some 13 million taxpayers who filed before the laws passage that now had to have their returns corrected. Corrected could mean a refund, or they might simply result in someone owing less money. Its still unclear how many refund checks are due to be released.

Other Reasons Individuals Could Be Experiencing Delays

Those who did not receive the first or second stimulus check could claim the funds through the Recovery Rebate Credit. If errors were made while the credit was claimed, individuals should expect a delay in receiving their returns. Additionally, if the return was incomplete, affected by identity theft or fraud, or Includes a claim filed for an Earned Income Tax Credit or an Additional Child Tax Credit using 2019 income, the return may take longer to process.

How The Treasury Offset Program Works

Here’s how the Treasury Offset Program works:

  • The TOP will check if your name and taxpayer information are in its delinquent debtor database.
  • If there is a match, TOP will notify you that it is deducting the amount you owe from your tax refund.
  • TOP will send the outstanding amount to the government agency to which you owed the money.
  • If you owe more money than the payment you were going to receive, then TOP will send the entire amount to the other government agency. If you owe less, TOP will send the agency the amount you owed, and then send you the remaining balance.

    Here’s an example: you were going to receive a $1,500 federal tax refund. But you are delinquent on a student loan and have $1,000 outstanding. TOP will deduct $1,000 from your tax refund and send it to the correct government agency. It will also send you a notice of its action, along with the remaining $500 that was due to you as a tax refund.

    Undelivered Federal Tax Refund Checks

    Refund checks are mailed to your last known address. If you move without notifying the IRS or the U.S. Postal Service , your refund check may be returned to the IRS.

    If you were expecting a federal tax refund and did not receive it, check the IRS’Wheres My Refund page. You’ll need to enter your Social Security number, filing status, and the exact whole dollar amount of your refund. You may be prompted to change your address online.

    You can also to check on the status of your refund. Wait times to speak with a representative can be long. But, you can avoid waiting by using the automated phone system. Follow the message prompts when you call.

    If you move, submit a Change of Address – Form 8822 to the IRS you should also submit a Change of Address to the USPS.

    Reporting Unemployment Benefits At The Federal Level

    For most states, you will receive Form 1099-G in the mail from your state unemployment office. Find out how you can obtain your 1099-G. On Form 1099-G:

    • In Box 1, you will see the total amount of unemployment benefits you received.
    • In Box 4, you will see the amount of federal income tax that was withheld.
    • In Box 11, you will see the amount of state income tax that was withheld.

    You dont need to attach Form 1099-G to your Form 1040 or Form 1040-SR.

    In certain states, you will not automatically be mailed a Form 1099-G. You will have to access your Form 1099-G online through your unemployment portal or call your state unemployment office to request that they mail your Form 1099-G. In other states, you will only be mailed a Form 1099-G if you selected that as your delivery preference.

    It’s best to locate your tax transcript or try to track your refund using the Where’s My Refund tool . The IRS says that you can expect a delay if you mailed a paper tax return or had to respond to the IRS about your electronically filed tax return. The IRS makes it clear not to file a second return.

    Each January, we mail an IRS Form 1099-G to individuals we paid unemployment benefits during the prior calendar year. The 1099-G form provides information you need to report your benefits. Use the information from the form, but do not attach a copy of the 1099-G to your federal income tax return because TWC has already reported the 1099-G information to the IRS.     Unemployment Tax Refunds Are Delayed Well Into 2022

    The IRS Is Sending Out Unemployment Tax Refund Checks

    The IRS issued 11.7 million of these special refunds, totaling $14.4 billion. In a , the IRS stated that it had identified over 16 million taxpayers who may be eligible for the adjustment. Some will receive refunds, while others will have the overpayment applied to taxes due or other debts.

    Therefore, there are still thousands of people waiting for their unemployment tax refund, and no deadline has been announced. For now, watch for the letter, which should be sent within 30 days from when the corrections were completed. It will include the refund amount. Any overpayment will be applied to outstanding taxes or other federal or state debts owed.

    Most Dont Have To File An Amended Return

    Most taxpayers dont need to file an amended return to claim the exemption. If the IRS determines you are owed a refund on the unemployment tax break, it will automatically correct your return and send a refund without any additional action from your end.

    The only reason to file an amended return is if the calculations now make you eligible for additional federal credits and deductions not already included on your original tax return, like the Additional Child Tax Credit or the Earned Income Tax Credit. The IRS said it will be sending notices in November and December to people who didnt claim the Earned Income Tax Credit or the Additional Child Tax Credit but may now be eligible for them.

    Unemployment Tax Check: When Will It Hit Your Bank Account

    The agency has confirmed that it will issue the refunds automatically to U.S. taxpayers who qualify. But when?

    According to the Internal Revenue Service, there is indeed life after this current third round of $1,400 coronavirusstimulus checksand the next payment will come in the form of tax refunds from 2020 unemployment benefits.

    This newest cash windfall was green-lighted via President Joe Bidens American Rescue Plan, which was able to waive federal tax on up to $10,200 of unemployment benefits, or $20,400 for married couples filing jointly, that were collected last year.

    Unemployment benefits are typically treated as taxable income, according to the IRS. Keep in mind, though, that American households with $150,000 or more in earned income are ineligible for the new benefits.

    The IRS has stated that the first of these refund checks are expected to be sent out some time this month and will continue throughout the summer. As of this week, the agency has yet to provide an exact timeline.

    According to a recent Treasury report, approximately 7.3 million tax returns processed by the IRS appear to qualify for these new tax refunds.

    Of the 7.4 million tax returns, nearly 7.3 millionor 98.6 percenthad modified adjusted gross income of less than $150,000 and would likely qualify for the exclusion, the report wrote.

    The agency has confirmed that it will issue the refunds automatically to U.S. taxpayers who qualify.

    When Will I Get The Refund

    Unemployment tax refunds started landing in bank accounts in May and ran through the summer, as the IRS processed the returns.

    The first phase included the simplest returns, made by single taxpayers who didnt claim for children or any refundable tax credits.

    More complicated ones took longer to process.

    In mid-July, the IRS issued 4million refunds, of which those by direct deposit landed in bank accounts from July 14.

    Meanwhile, households who receive the cash refund by paper check could expect this from July 16.

    Another batch of payments were then sent out at the end of July, with direct deposits on July 28 and paper checks on July 30.

    The IRS didnt announce payouts in August, September nor October but on November 1, it noted another 430,000 refunds had been paid out.

    These refunds were worth a collective $551million.

    The IRS also said itll issue another refund batch before the end of the year, but as of December 30, its yet to confirm when and how many it applies to you.

    It comes as Erin Collins, of the independent Taxpayer Advocate Service within the IRS, in September revealed that 13million accounts had been processed so far.

    She added that there were still about 436,000 returns yet to be processed, as they were waiting in the Error Resolution System as of September 11.

    This mean they had to be manually reviewed by the IRS, after which the refund was either released or the error confirmed.
