How Much Is Nevada Unemployment Compensation

How to file for unemployment in Nevada

The Nevada unemployment benefits you will receive are based on the amount of wages you earn in your Base Period. The Base Period is defined as the first four of the last five completed calendar quarters that immediately precede your initial claim for benefits. Quarters are defined as January through March, April through June, July through September, and October through December.

The more money you make during your highest quarter of earnings, the more money you will be paid as an unemployment benefit until you reach the maximum weekly amount.

There are other wage requirements for Nevada benefits as well.

You must earn overall wages during your Base Period that are equal to or exceed one and one-half times your highest quarter earnings. Or you must have earned wages in each at least three of the last four quarters of the Base Period. In either situation, you must have earned at least $400 in the high quarter.

If you qualify for benefits, you can be paid a maximum of 26 weeks of unemployment insurance of your full weekly benefit amount during a full benefit year. This may change if benefits are extended by Nevada unemployment laws. In some cases, such as when the Nevada unemployment rate is high, it may be difficult to find work. In some cases, Nevada unemployment extensions may be considered.

Is There An Appeal Process

An appeal is a request for a review by a higher authority of a decision made by the Division. A person must have a formal determination on eligibility before an appeal may be filed.

f either the claimant or the employer disagrees with the determination, they have the right to appeal the decision and obtain a hearing before an impartial appeal referee. A hearing is held to review previously obtained information, as well as obtain additional information which may not have been presented in the adjudication process. When this hearing has been completed, the referee reviews the applicable law and issues a written decision.

If either party disagrees with the decision of an appeal referee, the party may request that the Employment Security Board of Review examine the case. 3 Unemployment insurance claims may also be appealed to court after administrative processes have been completed.

Las Vegas Woman Sentenced For Unemployment Benefits Scheme

Unemployment claim frustrations abound in Las Vegas Valley

LAS VEGAS, Nev. A Las Vegas woman was sentenced today to 12 months and a day in federal prison for fraudulently applying for and receiving nearly $23,000 in unemployment benefits debit cards, announced Acting U.S. Attorney Christopher Chiou for the District of Nevada and Special Agent in Charge Quentin Heiden of the U.S. Department of Labor Office of Inspector General , Los Angeles Region.

According to court documents, Deandra Michelle Smith, 36, used another persons personal identification information without that persons consent and fraudulently applied for unemployment insurance benefits with the Nevada Department of Employment, Training and Rehabilitation . Around February 2017, Smith falsely claimed that the victim had been laid off, when in fact the victim was employed. Smith also listed her own address on the benefits application, so she would receive the benefits debit card issued by DETR. In carrying out her fraudulent scheme, Smith used the same victims personal information to renew the unemployment claim several times. Between March 2017 and August 2018, Smith used the DETR-issued unemployment benefits debit cards in multiple states, including Nevada, California, Texas, and Hawaii. In total, Smith fraudulently received $22,490 from DETR.

Smith pleaded guilty in November 2020 to one count of mail fraud. In addition to the term of imprisonment, U.S. District Judge Andrew P. Gordon sentenced Smith to three years of supervised release.

After You File An Initial Claim

After you file an initial claim, you will be mailed a Monetary Determination. This statement will tell you if you have enough base period wages to qualify for unemployment insurance benefits. The Nevada Employment Security Division will also review the reason why you became unemployed to make sure it is a qualifying reason. Other factors will also be reviewed to make sure you are initially eligible.

If you are eligible for unemployment insurance benefits, payments will begin to be processed about seven days after filing your first weekly claim.

Eligibility Requirements For Nevada Unemployment Benefits

Work Search Requirement Returning May 1 For People Filing Unemployment Claims

LAS VEGAS People who receive unemployment benefits will be required to show that they are looking for work starting May 1, according to the Nevada Department of Employment, Training and Rehabilitation .

Work searches will again be required to be eligible for payment of Unemployment Insurance claims.

The work search requirement, which was suspended by Gov. Steve Sisolak as the COVID-19 pandemic began last year, does not apply to people claiming Pandemic Unemployment Assistance benefits, according to DETR.

The work search process falls under a program called Reemployment Services and Eligibility Assessment . The federal government ordered that RESEA be reinstated on Monday.

Following the restoration of RESEA services, DETR will be bringing back the work search requirement to seek, apply for, and accept suitable employment. Starting May 1, 2021, all claimants filing for UI benefits will be required to search for suitable employment and keep a record of the businesses or individuals they contact for employment, DETR said.

When you establish a claim you have not requested any specific weeks benefits. This will be a separate action. In addition, when you establish a claim, it will remain valid for one year, or until all of your benefits are exhausted.

Before you file an initial claim, make sure you have the following information:

  • Social Security number
  • The reason why you lost your last job
  • Alien registration number if you are not a U.S. citizen
  • A DD Form 214 if you were on active military for any part of the past 18 months.
  • A Standard Form 8 and Standard Form 50 if you worked for the federal government at any time in the past 18 months.
  • All employment information for the past 18 months, including contact information and dates worked
  • Additional wages you have received from vacation, severance or other sources

Detr Requiring Verified Identity To File New Or Continued Pua Claims

Claimants must conduct several different work search activities each week using methods customary to the occupation they are seeking. These work search activities will be required to remain eligible for UI payments, DETR said.

Job search assistance via a ZOOM call will be available for some claimants who are selected for RESEA, DETR said.

A Tuesday DETR news release indicated that only claimants who actually receive at least one UI payment will be subject to review of the work search requirement, but documentation on work searches and record keeping requirements will be sent to anyone filing a claim.

No claimant that is currently filing on a PUA or extended benefits claim will be selected for RESEA, DETR said.

Nevada Detr Reminds That Extra $300 In Unemployment Benefits Other Programs End Sept 4

LAS VEGAS — Federal extended unemployment benefits and programs for independent contractors will end on Sept. 4, and the Nevada Department of Employment, Training and Rehabilitation urges claimants to quickly utilize resources for social services or job searches.

According to a news release, the last paying benefit week for the federal extended unemployment benefits is the week ending on Sept. 4. The last time claimants can file for these benefits is Sept. 5-15, according to DETR.

Once these benefits end, regular unemployment insurance will be the only benefit program moving forward.

According to the release, the following federal programs expire Sept. 4:

  • Federal Pandemic Unemployment Compensation , which provided an additional $300 weekly payment for any claimant that is eligible for at least $1 of an underlying unemployment compensation program.
  • Pandemic Unemployment Assistance provided benefits for claimants who were unemployed as a direct result of COVID-19 and not eligible for regular unemployment insurance or PEUC, including those who are self-employed or are gig workers.
  • Pandemic Emergency Unemployment Compensation , which provides an extension of benefits after a claimant exhausts regular unemployment.

Weekly Certification And Maintaining Eligibility

Once your unemployment claim has been approved, you must certify your status on a weekly basis in order to continue to receive benefits. This is to prevent people from receiving benefits even after theyve found new work.

The process of certifying the claim is also known as filing a weekly claim. You can file by telephone or online. You may request permission to file a weekly claim by mail. You must show a compelling reason why you need to file by mail.

If you dont, your unemployment benefits payments may be delayed. The weekly certification process requires you to answer questions meant to determine if you have maintained your eligibility status. The DETR will want to know whether:

  • You are looking for work
  • You are able and available to work
  • You started or quit a job
  • You refused an offer of suitable employment
  • You earned any wages during the week youre certifying

If you earned any money, you should report it for the week in which you earned the money, not when you received a payment. There are a variety of forms of payment that the state requires you to report including commissions, tips or pensions paid by a base period employer. Some forms of income are exempt from the reporting requirement, like Social Security income.

If you are unsure about whether you are required to report it, refer to the unemployment handbook or call a claims center. The wages you earn may affect the amount of WBA you receive when after certifying.
