TAX TIPS: How unemployment benefits can impact filing for 2021

In order to use Arizonas Internet Unemployment Tax and Wage System, your business must be:

  • registered with DES
  • determined by DES to be liable for Unemployment Insurance coverage and
  • have an active UI account as a rated or reimbursable employer.

To become registered: Your business must have filed an Arizona Joint Tax Application with the Arizona Department of Revenue or with DES . If you have not registered, you may do so online at AZTaxes.gov.

To be determined liable for UI: after registering, you will receive a “Determination of Unemployment Insurance Liability” form and an UI employer account number from DES. If you have met any UI liability criteria but have not received a liability determination from DES, contact the Employer Registration Unit by phone at 771-6602 or email at .

To become active: Your UI account should display as “active.” If your account states that it is temporarily suspended, permanently closed or not in active status, please contact the Employer Registration Unit by phone at 771-6602 or email at .

Rated: Your business is considered “Rated” once it has been determined by DES to be liable to pay for UI coverage by means of quarterly UI taxes and, therefore, has been assigned a tax rate for the calendar year.

Are There Any Exceptions To Taxation Of Unemployment Benefits

There is currently only one exception to taxation of unemployment benefits. The American Rescue Plan, passed in March 2021, makes a portion of unemployment benefits free from federal taxation. Specifically, the first $10,200 of 2020 unemployment compensation is now tax free. If your spouse also received unemployment and you file a joint tax return, each of you can exclude from taxable income up to $10,200 received in unemployment benefits.

This benefit applies only to households with a modified adjusted gross income under $150,000. It is important to note that this limit is not affected by the size of the household, whether the person filing is married, or whether the spouses file a joint tax return. Therefore, if you received unemployment compensation in 2020, but your and your spouses combined modified adjusted gross income was $150,000 or more, you should speak to your tax advisor to determine if filing separate tax returns would allow you to qualify for the unemployment compensation tax break.

The tax break applies only to federal taxation. As of the end of March 2021, Arizona has not yet followed the federal government in eliminating state income taxes on unemployment benefits.

Furthermore, the tax break only applies to 2020 unemployment benefits. It may be possible, however, that Congress will eventually pass a law providing a similar tax break for the 2021 tax year.

Use the information from the form, but do not attach a copy of the 1099-G to your federal income tax return because TWC has already reported the 1099-G information to the IRS. You can file your federal tax return without a 1099-G form, as explained below in Filing Your Return Without Your 1099-G.

A 1099-G form is a federal tax form that lists the total amount of benefits TWC paid you, including:

Arizonans should file amended state returns for a refund only after the IRS first adjusts their 2020 federal returns automatically. Taxpayers here will have four years after the return’s original due date, which was the unusual deadline of May 17 of last year, to file the amended return.     Despite Arizona’s unemployment agency saying it’s working on cleaning up the 1099-G mess, some say they still haven’t received new forms so that they can properly file their taxes on time.

    PHOENIX – New numbers reveal more than 16,000 people who’ve collected unemployment benefits in Arizona, or were fraudulently targeted, have reported tax problems and the deadline to file is nearing.

    Thousands of victims of unemployment fraud in Arizona received a tax form from the state telling them to claim money they never asked for or received.

    Its been a battle Christine Lahaie never wanted.

    “I would say I probably have 48 hours at least between sitting on hold, waiting, doing the paperwork, getting ahold of everybody,” Lahaie says.

    In early February, she received a 1099-G tax form in the mail claiming she received 3,400 dollars in unemployment benefits.

    But the problem is that shes retired. So likely someone fraudulently filed for benefits in her name with the Department of Economic Security .

    The state said anyone in her shoes should contact DES and get a new form in a week. However, seven weeks later, shes still waiting.

    “Im going to go ahead and file my taxes and Im not going to report that $3,400 because I never received it. If they want to come after me, Im 70-years-old, go for it,” Lahaie says.

    PHOENIX, Ariz. – According to KTAR News, the Arizona Department of Revenue is warning taxpayers on a new scam, saying residents are receiving unexpected unemployment benefits tax forms.

    The revenue department is asking individuals who have received a 1099-G Form for unemployment benefits they did NOT apply for, to reach out to the Arizona Department of Economic Security for a corrected form.

    Millions of people requested unemployment assistance due to the pandemic, and many taxpayers have fallen victims to fraudsters claiming unemployment for themselves.

    Unemployment benefits are taxable, and federal agencies send them out to individuals who receive financial assistance to report on income tax returns.

    If you are receiving benefits, you may have federal income taxes withheld from your unemployment benefit payments. Tax withholding is completely voluntary withholding taxes is not required.
