The Vec’s Responsibilities In Responding To Your Request

  • The VEC must respond to your request within five working days of receiving it. Day One is considered the day after your request is received. The five-day period does not include weekends or holidays.
  • The reason behind your request for public records from the VEC is irrelevant, and you do not have to state why you want the records before we respond to your request. FOIA does, however, allow the VEC to ask you to provide your name and legal address. Your legal address is required as FOIA only applies to citizens of Virginia and representatives of media with a circulation in Virginia. Agencies are under no obligation to extend benefits of FOIA requests to individual and media bodies residing outside of Virginia.
  • FOIA requires that the VEC make one of the following responses to your request within the five-day time period:
  • We provide you with the records that you have requested in their entirety. The VEC is required to provide records currently in existence. FOIA does not require the VEC to create records in response to a FOIA request.
  • We withhold all of the records that you have requested, because all of the records are subject to a specific statutory exemption. If all of the records are being withheld, we must send you a response in writing. That writing must identify the volume and subject matter of the records being withheld, and state the specific section of the Code of Virginia that allows us to withhold the records.

Companies always ask for this, typically in the form of a resume or within an application. You will likely be asked to provide detailed information about your past two to five positions.

With the amount of information an employer can access, its highly recommended to be as accurate as possible when submitting your work history. If you think you may have certain information that will raise concern, be sure to find a way to address it with the employer up front. Honesty and initiative are highly valued attributes in the eyes of an employer.

Job Searching When You Have Gaps In Your Resume

Finally, although you should expect your employment gaps to come to light during the interview process and be prepared to explain them, you don’t have to volunteer the information during the job search process.

One way to make sure a potential employer focuses on your skills and qualifications and not the months you’ve been unemployed is to prepare a functional resume rather than a chronological one. This type of resume highlights what you can do without offering a linear work history.

While a prospective employer couldand probably willuncover the gaps in your employment history during the background check phase of the process, a resume that shows off your skills can get you an interview.

If you explain the circumstances of your employment gap, it most likely will not be held against you.

Will Unemployment Show Up On My Credit Report

A record of receiving unemployment benefits will not appear in your credit reports. Though you may see a list of past employers, your with information from financial institutions, like banks, credit unions and debt collection agencies. Bankruptcy filings are the only public record included in your credit report, and only because it may be relevant to a lender. Income, marital status and bank balances are not included in your reports at all.

If you’ve combed through your credit reports and seen past and current employers listed, it’s because you included that information on a past application for credit. Lenders often use your income and employer to determine whether to grant you a loan or credit, and when they send your application details to credit reporting agencies, your employment information is sometimes included.

It’s important to know that the “employers” entry on your credit reports does not represent your complete employment history and will only include occasional instances where employment information was received. This information is not factored into any credit scoring models and will not have an impact on your credit scores.

How Do Employers Verify Employment History

Your employment history includes the companies you have worked for over the past several years, your job titles, dates of employment, and your salary at each job. The companys human resource department either will verify your employment history themselves or will hire a third-party company to complete the process.

In the first case, the human resource department may call the human resource departments of your previous employers to verify your information. There is a lot of misconception as to whether a prospective employer can ask why you left. The reality is there is nothing legally prohibiting a company from telling another if you were fired or let go.

Some companies hire third-party pre-employment screening services to conduct a screening for employment history. These companies will typically provide a report that verifies the persons identity and residency, a criminal record summary and employment summary with employer names and addresses. These reports will also reveal a persons education history and whether they completed any degrees or certifications.

Some reports are more thorough than others. This largely depends on the type of service used to conduct the check and the type of job the candidate applied for. A basic report will verify that a person worked at a certain place, why they left, and whether they would be eligible for rehire. Theres also a place for comments on the employees performance.
