You Dont Apply For Unemployment Insurance

If determining whether youâre eligible for unemployment, and actually applying for it, seems complex, thatâs because it is. Every state determines who qualifies for unemployment aid and what the application process entails.

Recently, unemployment assistance has opened up to include nearly every person whoâs lost work, through no fault of their own, due to the coronavirus.

âThe biggest question Iâve been getting is, âMy circumstance is X-Y-Z should I apply?’â says Michele Evermore, senior policy analyst at the National Employment Law Project, a nonprofit research firm. âAnd the answer to that is almost always âyes.’â

Workers will qualify for aid if they were laid off, furloughed or had their hours cut. You can also check with your stateâs department of labor to determine additional eligibility, such as if you lost work because you were diagnosed with Covid-19, youâre providing care to a family member with the virus, you have to care for a child due to school closures, youâre unable to get to work due to closures or other qualifying reasons.

People whoâve seen a reduction in work hours and wages due to the virus may qualify for partial unemployment.

âIn this particular period in history, getting an unemployment check isnât good just for you, but itâs good for the local economy, and itâs an important public health measure,â Evermore says. âPeople need to take these benefits and not be making ends meet by going out to work.â

Your Application Might Be Flagged For What You Listed As Your Reason For Job Loss

Applications for UI have never been the easiest to navigate. That goes for both filers and administrators.

Your application might be flagged for further verification if you have a unique reason for losing your job, particularly if it might sound like you quit your position voluntarily. An example of that, Evermore says, could be someone whos recently been injured and had to quit their job operating heavy machinery. While it may appear like youve left voluntarily, theres actually more to the story that requires additional verification.

Any slightly more ambiguous answer to that question puts you in a category that gets extra review, Evermore says. And once the system says we cant automatically approve this because theres a flag, then it has to go to the adjudicator.

How Long Does It Take For Edd To Go From Pending To Paid

Payment information is updated daily at 6 a.m. . If you submit your certification by phone, your payment will generally be deposited on to your EDD Debit CardSMwithin 24 hours. Note: If you submitted your certification by mail and/or requested your benefit payments by check, allow 10 days for processing.

When Will Payments Start

Thefirst week you are eligible for unemployment benefits is called your waiting week. You do not get paid for your waiting week.

Submit Your Biweekly Reports

After you apply for Employment Insurance benefits, you’ll have to submit reports to Service Canada every 2 weeks for as long as you receive benefits. They help show your ongoing eligibility and make sure you get the benefits to which you’re entitled.

You’ll need your social insurance number and the 4-digit access code we mailed you to submit your reports online or by phone. Once you submit your report, you’ll get the date to submit your next one. You have 3 weeks from that date to complete the next report.

What Can You Do To Ensure Youre Getting What Youre Owed

The huge influx of recent unemployment claims were partly caused by the number of people who qualify under this years unique circumstances but who wouldnt under normal circumstances.

The Coronavirus Aid, Relief, and Economic Security Act extends unemployment benefits to many who didnt previously qualify. Independent contractors, freelancers, gig workers, and the self-employed may be eligible for payments through the Pandemic Unemployment Assistance program, established by the CARES Act. Since these types of workers dont pay state unemployment insurance taxes and they dont have employers who pay into the unemployment system, they arent normally eligible for unemployment benefits.

But how you apply for PUA benefits isnt the same across the board. Different states have different procedures and rules on who qualifies for benefits, says Daniel Kalish, managing partner at the national employment law firm HKM Employment Attorneys. The stimulus package included language saying states should be more lenient with who gets extra benefits, but didnt spell out exactly how, says Kalish.

Because there is so much confusion right now surrounding qualification, Kalish has this straightforward advice: If you have had any reduction of your take-home compensation at all, you should apply for unemployment benefits, even if youre unsure whether you qualify. As long as you are honest in your application, there is no negative repercussion for applying. All they can say is no, he says.

Letter #2 Approval Or Denial

Approval – If you have certified, your waiting week was served, and you receive a letter of approval, money should be deposited in your bank account within 72 hours.

Denial – If you do not agree with the agencys decision, you may file an appeal. Do so by logging into Jobs4TN, selecting the determination you wish to appeal, and clicking File Appeal within the left navigation’s Services for Individuals, then Unemployment Services.

Your last payment issued and claim balance appear at the bottom of the homepage in the Claim Summary section. To view other payments made, select View Payment Activity to see:

I Receive A 1099 For The Job I Do As An Independent Contractor Am I Eligible For Regular Ui

You may be eligible for regular unemployment insurance, as a 1099 employee is not synonymous with independent contractor as defined by the Unemployment Insurance Act.In Illinois, every individual who is unemployed or underemployed should file a claim for unemployment benefits, even if they have been told they’re not covered by the states regular unemployment insurance program – because theyre an independent contractor, part of the gig economy, or for some other reason. End Of Pandemic Unemployment Benefits And $300 Payment

All states, including those who announced an early end to one of more of the pandemic unemployment programs, are no longer paying benefit weeks after September 6th. If you are waiting for your benefit payments for weeks covered after September 6th, even if you have a balance or weeks remaining, you wonât be getting these since the federal funding provisions are no longer available.

Retroactive claims prior to September 6th would still be paid subject to adjudication and validity of your back dated claim. But this will vary on a state-by-state basis and could take some time to process.

Other Options

The above points are not exhaustive and there are many states who are just behind advancing claims or responding to issues due to antiquated systems or resource constraints which have resulted in claim processing delays through no fault of the claimant.

Also in many cases many claimants think they are eligible for payments but have not carefully read the eligibility criteria and when they apply or asked to reapply for an extension their claim gets denied. They assume it is stuck, but being denied or deemed ineligible is a different issue. However the solutions below may work for cancelled claims as well.
