No, typically that employee would not be eligible for regular unemployment compensation or PUA. Eligibility for regular unemployment compensation varies by state but generally does not include those who voluntarily leave employment. What Other Legal Issues Are At Play

The key question lawyers are confronting is whether employer-mandated vaccinations are a reasonable workplace policy in the first place. Can the government, either state or federal, mandate private employers to set vaccine requirements for their employees? What about for public employees?

Some lawmakers, economists and advocates have spent months making the case to extend pandemic UI as the delta variant caused Covid caseloads to rise and job market recovery to slow.

But much of the grassroots advocacy that helped spur previous extensions didn’t see enough momentum make it to Congress this time around.

By August, the Biden administration called on states to use emergency coronavirus funds to provide additional benefits to millions of Americans who remain out of work across the country. But the majority of state labor departments confirmed they have no intention of extending or providing additional benefits on their own.

ExtendPUA has since added to its advocacy resources ways people can contact their state legislators to urge them to provide more financial and career support to unemployed constituents.

Many worker advocacy groups, including ExtendPUA, Unemployed Action and Unemployed Workers United are also putting pressure on policymakers to institute more long-term systemic reform to cover more workers and put in automatic stabilizers, like the unemployment rate, to trigger federal relief rather than letting lawmakers choose calendar dates. Labor organizations have also to include federal and state policies in its next reconciliation package to extend aid and strengthen UI systems overall.

The Michigan unemployment system has been a mess, and its a challenge for many residents to get their benefits, according to attorney Jennifer Lord.

Lord has been working to help those residents who are stuck. Right now, almost 350,000 Michiganders have their unemployment locked due to scams and identity thieves.

Do You Need To Look For Work

If youve filed your claim, gotten it approved and start receiving unemployment benefits, there are additional rules you need to be aware of to make sure you dont lose your benefits before you get a new job.

Most states require people who are receiving unemployment benefits be not only willing to work but actively looking for work. That requirement was waived by essentially every state at the start of the pandemic, but a number of them have now reimposed it.

However, as weve noted many times, every state is different, and also the definitions of actively looking for work vary from state to state. So if you arent sure if your state requires you to be currently looking for work, or what you need to do to prove that youre looking for work, double-check its unemployment website to find out.

What Is Unemployment Insurance

Unemployment Insurance provides unemployment benefits, usually in the form of weekly payments, to eligible workers who become unemployed through no fault of their own, and meet certain other eligibility requirements. UI is administered jointly by the U.S. Department of Labor and individual states.

Each state develops their own system for delivering benefits. Extended federal unemployment benefits ended on September 6, 2021. Find details at your state’s Unemployment Insurance website.

Benefit Year End Date

A regular unemployment insurance benefit year ends 12 months after the claim started.

You cannot be paid for weeks of unemployment after your benefit year ends, even if you have a balance on your claim. Continue to certify for benefits if you have weeks available within your benefit year.

You can reapply for a new claim if you earned enough wages in the last 18 months and are still unemployed or working part time. Apply online, and we will notify you when your new claim is processed. This usually takes two to three weeks.

If you served in the military, worked for a federal government agency, or worked in a state outside of California within the last 18 months, you must reapply for a new claim by phone, mail, or fax.

Find Info From Your Previous Job Or Independent Gigs

When you file, youll need to be ready to submit not only your own basic information such as name, address, phone number, Social Security number and so on but also where you were employed, your dates of employment and earnings info. If youve had more than one job in recent years, youll need the info for all of them.

Making an accurate accounting of all income for every month for the last 18 months is important, says Michele Evermore, senior researcher and policy analyst at the National Employment Law Project. That will ensure that claimants can get the maximum benefit.

If youre a gig worker or independent contractor, youll need to prove your previous income to be eligible for the PUA program. That could be tricky if youve had irregular earnings.

Some states base benefits on the highest quarter of income, which may be lost when a worker only has a 1099 for the whole year for proof of income, explains Evermore. Workers should come prepared with all of the ways that they know they have been paid to establish for themselves a good high quarter of earnings.

Browder and six other employees developed the app to automate the unemployment process for all 50 states, which all have different filing systems. Some states like New York and New Jersey still require a phone call to the state unemployment office in order to process the claim, but the DoNotPay app has a service where a bot can make the phone call, remain on hold and then forward the call to the user when a representative picks up the phone.

Mailing an application can surprisingly get faster results than applying online, according to Browder.

“It’s almost like paper voting,” he said. “That idea can be applied to other areas of bureaucracy where it’s actually more secure and efficient in some strange way.”
