Veterans Administration disability benefits are available to veterans who were injured or became sick while serving in the military. Benefits are also available when a condition that existed before military service began was made worse because of military service.
Benefits consist of health care and disability compensation. Compensation is based on the veterans disability rating a measurement of the degree to which a physical or mental impairment is disabling. Disabilities need not be caused by war wounds. Chronic back pain, hearing loss, and post-traumatic stress disorder are examples of disabilities for which benefits might be paid if they were caused by military service.
Disability ratings are assigned in increments of 10%. In 2022, compensation for a 10% disability rating is $152.64 per month. Monthly compensation for a 20% disability rating is $301.74.
Compensation becomes more significant when a veterans disability rating reaches 30%. Veterans with a 30% or more disability rating receive additional compensation when they have dependents, including a spouse, children, and parents. Compensation payments can vary widely depending on the veterans disability rating and the number of dependents the veteran has.
Do You Qualify For Theveterans Affairs Individual Unemployability Benefit
VA veteran who is unable to obtain and maintain substantially gainful employment due to one or more service-connected disabilities are entitled to a TDIU. A TDIU provides compensation equal to a total disability rating, even though the ratings for VA service-connected disabilities might combine to less than 100 percent.
To qualify, a veterans claim or appeal must show that he or sheis unable to obtain or maintain a substantially gainful occupation because of the physical or mental impairments caused by service-connected disabilities.
There are two important parts to this analysis: whether the veteran can get and keep work, and even if the veteran can or does work, whether that work is considered substantially gainful.
In determining a veterans ability to get or keep a job, VA must consider not only the veterans functional impairments due to service-connected disabilities, but also the particular veterans education, training, work history, and expertise. The veterans age is not a factorthus even a disabled veteran who is retirement age can obtain TDIU if, regardless of their age, their service-connected disabilities would still prevent them from working a substantially gainful job.
A job that a veteran can keep only because of significant accommodations by the employer is in a protected environment. If a veteran could not obtain or keep a substantially gainful job outside of a protected environment, then he or she may be entitled to a TDIU.
Submit The Va Form 21
The DRO or rating claim officer will automatically deny a claim of a file without the TDIU form. While this doesn’t seem right, it’s the reality of how most VA regional offices approach TDIU claims. Va Disability Rating For Tdiu
The zero to 100 percent ratings are assigned in 10 percent intervals for each service-connected condition. Each disability may be rated at zero percent , or anywhere from 10 percent to 100 percent, depending on the severity of the symptoms of that disability.
One important thing to keep in mind, however, is that VA uses a formula to determine a veterans overall disability rating. For example, a 30 percent rating and a 20 percent rating generally combine to receive a total rating of 40 percent, rather than the 50 percent that would be awarded if conditions were simply added together.
The disability ratings assigned by VA are part of a very old system called a rating schedule, which was designed many years ago to compensate veterans based on the average loss of earnings a condition has on employment. Even though many of the ratings do not make sense by todays standards, that is still the way that VA rates disabilities overall. Fortunately, some of the disabilities have recently received updated rating criteria.
Schedular Rating
Qualifying for schedular TDIU disability benefits makes it easier to obtain an award of TDIU compensation. This is because the VA is more likely to approve an applicant who meets the basic minimum requirements for schedular TDIU rather than having to complete certain additional steps.

Will I Get Back Pay For Tdiu
Once you submit your Individual Unemployability claim, it can take months or years before your claim is resolved. If VA grants the TDIU rating, what about all that time you were waiting and received no benefits at all? This can add up to many thousands of dollars.
VA does reimburse this and the payment is referred to as TDIU back pay, or retroactive pay. Usually, the VA pays this as a lump sum. The number one thing you need to do is make sure VA dated this back pay amount correctly.
The correct date the TDIU retroactive payments should begin is the effective date and not the date you applied for benefits. Remember, the effective date is the date you were found to first be unemployable. The difference can be years before you ever filed your application to VA.
Individual Unemployability: Understanding The Basics
As a VA claims processor, Veterans often ask me about Individual Unemployability , also called Total Disability based on Individual Unemployability . The following is a more formal version of what I tell them.
What is IU?
Individual Unemployability allows VA to pay certain Veterans at the 100-percent disability rate even though their service-connected disabilities are not rated as 100-percent disabling. Veterans may be eligible for this rating increase if they are either unemployed or unable to maintain substantially gainful employment as a result of their service-connected disability .
What is substantially gainful employment?
Substantially gainful employment is simply full-time employment that provides a wage greater than the poverty level. For instance, if a Veteran has been trained to drive a truck, but cant work because of service-connected back and stomach conditions, he or she may qualify for IU.
Are there any other eligibility requirements?
In order to qualify for IU, you must have one of the following:
1) a 60-percent or more disability evaluation based on a single service-connected disability or,
2) a 70-percent combined disability evaluation based on multiple service-connected disabilities, with at least one disability rated at 40 percent or more.
Since the Veteran has only two service-connected disabilities, both the Veterans PTSD and IBS have to be evaluated at a higher combined rate and be the reason he cant work to receive IU.

Medical Evidence To Include
Medical evidence can support your TDIU claim by showing how your service-connected disabilities prevent you from obtaining and sustaining substantially gainful employment. Some medical evidence can include the following:
- Medical Diagnoses
- Dates of treatment and hospitalization
- Medical opinion or letter from your doctor
- Other Documentation from your doctor appointments that supports your inability to hold a job.

How Do I Get A Tdiu Rating
In order to receive a TDIU rating, you must have served in the U.S. military and have at least one service-related disability . As an alternative to the second condition, you must have two or more service-related injuries . The idea is that you are unable to keep gainful employment, which does not include odd jobs or marginal employment.

Can The Va Reduce Or Terminate My Tdiu Benefits
The VA can terminate your TDIU benefits if it determines that your condition has improved to the point that you are able to maintain substantially gainful employment. Your TDIU rating may also be reduced if you are able to maintain substantially gainful employment for 12 consecutive months.
However, this rule does not apply to veterans who are working in what is known as a protected work environment. This designation usually applies to a situation where some special accommodation is made for the veteran.

Paperwork In The Mail
A former servicemember who has been approved for TDIU would receive a copy of a rating decision in the mail, which formally awards disability benefits. That rating decision would explain the effective date of the award, meaning what date the TDIU was assigned, as well as the dollar amount the veteran will receive. Veterans may appeal the effective date assigned, and since VA often assigns an incorrect effective date, it is a good idea to have an attorney review the decision for accuracy.
The rating decision will also indicate the total amount of back pay or retroactive pay that the former servicemember will receive along with paperwork explaining the necessary appeal rights. The only thing that the veteran would want to appeal at this point would be the effective date assigned for the TDIU, and the paperwork would explain how to do that.

Employment Rules For Tdiu Veterans
A veteran cannot have substantially gainful employment and receive TDIU, however, marginal employment is not considered substantially gainful employment. Generally, employment is considered marginal when the veterans earned annual income is lower than the poverty threshold established by the U.S. Department of Commerce, Census Bureau. But the VA may also award TDIU if the veterans income is above the poverty threshold based on the totality of facts. For example, employment may be considered marginal if the employment takes place in a protected work environment such as a family business, the veteran may be eligible for TDIU. 38 CFR 4.16
Is Va Unemployability The Same As 100% Disability
Unemployability allows a veteran who is unable to work, to receive compensation at the 100% level even though their service-connected condition does not meet the 100% rating criteria. On the other hand,with a 100% disability rating, there are not the same restrictions on work activity as with unemployability.

How Do I Receive Tdiu
To receive TDIU benefits, the veteran must apply for disability compensation and fill out two additional forms:
- Veterans Application for Increased Compensation Based on Unemployability
- Request for Employment Information in Connection with Claim for Disability Benefits
