Admits Bribery Wire Fraud And Aggravated Identity Theft

Tacoma A former employee of Washington States Employment Security Department pleaded guilty today in U.S. District Court in Tacoma to three federal felonies for his scheme to exploit his employment for personal enrichment and to fraudulently distribute at least $360,000 in pandemic-related unemployment benefits, announced U.S. Attorney Nick Brown. Reyes De La Cruz, III, 48, of Moses Lake, Washington, personally enriched himself by at least $130,000 with his scheme. De La Cruz was arrested September 24, 2021, in Moses Lake and has been in federal custody since his arrest.

We remain committed to working with our law enforcement partners to prosecute those who used the cover of the pandemic to unlawfully enrich themselves, said U.S. Attorney Brown. In this case, De La Cruzs betrayal of public trust during a time of national crisis is particularly egregious.

According to records filed in the case, De La Cruz was hired as an intake agent in April 2020 to help the Employment Security Department deal with the crush of filings for pandemic unemployment benefits. De La Cruz had previously worked for ESD, from 1996 to 2003.

In some instances, when claimants refused or resisted paying De La Cruz, he threatened to terminate the claim if they did not pay him.

Under the terms of the plea agreement, prosecutors will ask for no more than 75 months in prison when De La Cruz is sentenced on September 16, 2022.

To qualify for unemployment benefits in the state of Washington, a claimant must satisfy several requirements. But new tax increases arent expected because the states finances didnt suffer as much as predicted during the pandemic, said state Sen. Karen Keiser, chair of the Senate Labor, Commerce & Tribal Affairs Committee.

The unemployment trust fund, which initially was projected to have a $200 million deficit by the end 2021, already has a total of $1.9 billion and its growing now because the high-wage earners and their employers are paying into the trust fund, Keiser said. More Money Coming To Some Unemployed Workers In Washington Thanks To A Quirk

In a perverse twist of the pandemic economy, Washington is boosting the weekly benefit for some jobless workers by nearly 50% starting next month the largest increase on record, the Employment Security Department announced Tuesday.

And employers might not need to endure another tax increase to pay for it.

The benefit increase stems from a state policy that ties jobless benefits to the states average wage, which thanks to a grim statistical quirk increased during the pandemic even as tens of thousands of workers lost their jobs.

As a result, the minimum weekly unemployment benefit will increase by $94, to $295, for workers who file their first jobless claim on or after July 4. Thats the biggest increase since the ESD began tracking such data, during the Great Recession, said Paul Turek, ESDs state economist.

The maximum weekly benefit for new claims also will increase by $85, to $929.

Coupled with the $300 federal pandemic benefit, the states total weekly benefits will range from $595 to $1,229. That federal benefit ends in September.

Around 17% of workers filing claims receive the minimum weekly benefit and roughly the same percentage get the maximum benefit amount, ESD officials said.

The sharp increases reflect the pandemics disproportionately heavy effect on lower-wage workers, as well as lawmakers earlier efforts to soften that blow.

New Unemployment Claims Dip In Washington State

New unemployment claims in Washington fell last week and the states unemployment rate dipped even as the nation as a whole saw a modest increase in the number of people seeking jobless benefits.

Washingtonians filed 12,958 new, or initial, claims last week, a 7.7% decrease from the previous week, the state Employment Security Department reported Thursday.

Nationally, new jobless claims rose 1.2% to 745,000, the U.S. Labor Department reported.

Washingtons unemployment rate fell to 6% in January, down from 7.1% in December, the ESD reported this week. The U.S. unemployment rate was 6.3% in January, down from 6.7% in December.

Still, the number of new claims filed in Washington was more than twice the level during the same week last year as the pandemic and related business restrictions continue to spur higher-than-normal layoffs.

Among the business sectors in the state that saw the largest number of new claims last week were construction, retail, accommodation and food services, and health care and social assistance.

The total number of weekly, or continuing, claims filed in Washington last week fell 0.4% from the prior week, to 440,927.

Last week, the ESD paid benefits on 315,399 individual claims, which was almost unchanged from the prior week. Because individuals can have multiple claims, the number of claims is often slightly higher than the number of individual claimants.
