If you live in a state that has a state income tax, you may need to pay state income taxes on your unemployment benefits in addition to federal income taxes.

For states that dont have a state income tax or dont consider unemployment benefits taxable income, you wont need to pay state income taxes on your unemployment benefits. These are 17 states that dont tax unemployment benefits:

States that dont have any income taxes Alaska, Florida, Nevada, South Dakota, Texas, Washington, and Wyoming
States that only have income taxes for investment income New Hampshire and Tennessee

Why Withholding Makes Senseand How To Do It

You’re not required to have taxes withheld from your unemployment benefits check. But experts say it’s a good idea to go ahead and do so. Taking a hit upfront is better than finding out you owe the IRS at the end of the year. “I know people really need their money, but so there are no surprises at tax time, I would say request to withhold some of the money,” says Lisa Greene-Lewis, a certified public accountant and TurboTax tax expert.

This is especially important if you’ve earned income already for the year or expect to be employed again, because then you’re likely to be in a higher tax bracket and may not qualify for as many credits to offset your earnings.

“Usually unemployment benefits are only a couple hundred bucks a week,” says Andrew Stettner, a senior fellow at the Century Foundation and a leading unemployment expert. It might feel easy to rationalize taking the money now and increasing your deductions when you get back to work. But with these generous unemployment benefits, that mindset could be a substantial liability, he says.

It depends. However, even though you do not live in California, you still must pay tax on income earned in California as a nonresident. Therefore, depending on your total income, you may have made enough money in California for them to have taxed you through the year. It is true that in Nevada you do not pay tax on that income, but California can tax you.

Reporting Unemployment Benefits At The State And Local Level

If your state, county, or city collects income tax on your unemployment benefits, keep your Form 1099-G for reference. You may have to attach it to your state, county, or local income tax return. If so, keep a copy for yourself.

Last, you can wait until tax day to make your full tax payment. But if you received unemployment for much of the year, you may be subject to penalties for not paying enough tax during the year through withholding or estimated payments. The short answer is yes, unemployment income is taxable. Since unemployment income is treated as normal income, the amount is taxable.

Should I Wait To File My Taxes To Claim The Waver

Many out-of-work Americans rushed to complete their taxes to get a possible refund to help make ends meet. The tax break is becoming law after 55.7 million tax returns were already filed by Americans with the IRS, as of March 5.

Some filers may consider waiting to file their taxes until the IRS issues new guidance to claim the new $10,200 waiver, experts say.

To be sure, the stimulus package also offers $1,400 stimulus checks to individuals who earned up to $75,000, and married couples with incomes up to $150,000. Payments would decline for incomes above those thresholds, phasing out above $80,000 for individuals and $160,000 for married couples.

Some taxpayers may opt to file their taxes sooner to get the latest stimulus check, particularly if their 2020 income was lower than in 2019.

How The Unemployment Landscape Changed

With the U.S. experiencing unemployment rates last year that have not been seen since the Great Depression, Congress had to act quickly to mitigate the effects. To help Americans cope, lawmakers passed the CARES Act, a $2 trillion coronavirus relief package, that boosted unemployment benefits by $600 a week.

The CARES Act also created the Pandemic Unemployment Assistance program, which expanded the eligibility for benefits to include gig workers, independent contractors, self-employed Americans and those who would not traditionally qualify for assistance.

After the initial $600 enhanced unemployment benefits ended in July, an additional $300 boost was granted in August and later extended by lawmakers in December. The $900 billion relief package passed in December extended the program through March 14, as well as the Pandemic Emergency Unemployment Compensation and PUA programs, both of which were set to expire at the end of 2020.

Unemployment benefits replaced about 45% of a worker’s pay nationally in 2019, according the Department of Labor. In terms of dollars, the Brookings Institution estimates that the national average weekly payment was $387 prior to the coronavirus pandemic. But that varies widely by state. Mississippi, for example, paid an average of $215 per week, while those in Massachusetts received $550 per week, on average.

What If I Suspect Unemployment Fraud

If you received a 1099-G form showing unemployment benefits were dispersed to you, but you didn’t receive the money, Rigney suggests reaching out to the Employment Development Department for a corrected form.

“You don’t know when they’ll be able to issue that, and you’re going to have to go through some effort to get the corrected 1099-G,” he said, adding you should still file taxes.

The IRS has said filers should not include the fraudulent income in their federal return, Rigney said. As for the state return, he said they’re still waiting on guidance.
