Like its top competitors, Jackson Hewitt promotes no-fee, 0% APR refund-advance loans that are repaid from your federal refund. Loan amounts are offered from $500-$3,500 loans are available through Jan. 15. The loan, called the No Fee Refund Advance, is open to customers who file their taxes through Jackson Hewitt. The American Rescue Plan’s unemployment tax break is welcome relief but it cropped up in the middle of tax season. Millions of people who already filed and reported unemployment compensation were left wondering whether they missed out on the exclusion all together.

IRS Commissioner Charles Rettig urged taxpayers not to file an amended return. Instead, the agency is aiming to review already processed returns to determine who qualifies for the exclusion and issue refunds for taxes paid on up to $10,200 of benefits.

“We believe we will be able to automatically issue refunds associated with the $10,200,” Rettig told the House Ways and Means Committee on March 18. He expects to make a formal announcement “in the near future.”

The first big question to tackle is to see if you qualify for unemployment benefits. Though the Department of Labor administers the guidelines, each state has its own separate requirements to qualify.

There are generally two requirements youll have to meet:

    Exclusion Of Up To $10200 In Unemployment Benefits

    The American Rescue Plan excludes from federal taxation the first $10,200 in unemployment benefits collected in 2020. People with modified adjusted gross incomes of under $150,000 for all filing statuses are eligible for the exclusion. Couples can exclude up to $20,400 total.

    Tax-preparation companies, including H& R Block and TurboTax, are working to update their software to help taxpayers claim this relief. You can also find instructions for claiming the exclusion on the IRS website.

    As for people who already filed 2020 returns and paid taxes on the first $10,200 in benefits, IRS Commissioner Charles Rettig said the agency is taking steps to issue automatic refunds.

    Even if you suspect your identity has been stolen to claim unemployment benefits, you don’t need to file an Identity Theft Affidavit, Form 14039, unless you e-file your federal return and it’s rejected by the IRS because a return using your Social Security number has already been filed.

    What To Do If You Get A 1099

    Don’t report any unemployment benefits as income if you didn’t receive them for a valid claim you filed. If you did get benefits for a period of time, double check that the amount reported on Form 1099-G is accurate.

    In guidance released January 28, the IRS advised anyone who receives an inaccurate 1099-G to contact their state agency not the IRS to request a corrected form, including if the amount is $0. Here’s a list of the agencies in each state that handle taxes and unemployment benefits.

    If your state agency doesn’t respond in a timely manner, you should still file a federal tax return by the May 17 deadline and report only the income you did receive . A corrected form will also be sent to the IRS, so you don’t need to notify the agency yourself.

    Advance Child Tax Credit Payments

    When the American Rescue Plan went into effect in March 2021, it provided financial relief to millions of families, increasing the 2021 child tax credit from $2,000 to $3,000 per child age 17 and under and adding an extra $600 for children under six years old.

    Anecdotally, this has been a major reason why many Americans are disappointed by their tax refunds this year. Eric Bronnenkant, Head of Tax at Betterment, discusses the different scenarios many people are now finding themselves in.

    “The advance of child tax credits during the year may end up reducing an individual’s refund when they file,” Bronnenkant tells Select. “Other people may have received too much of an advance credit but not qualifying at all when filing their tax return, which resulted in a significant decrease in their refund.”

    Consider the following example: if you had a $3,600 child tax credit write-off but received $1,800 as an advance last year, you’re only allowed to write off $1,800. Only being able to write off this smaller amount leads to having a smaller refund.

    It’s also likely many Americans have been reporting incorrect numbers because of the advance. TurboTax CPA and tax expert Lisa Greene-Lewis tells Select that if tax filers don’t report this information correctly, they could “see an adjustment in their return” from the IRS. She urges consumers to refer to their Child Tax Credit Letter 6419 to verify how much they actually received in 2021 so they’ll know exactly how much to claim.
