Income Tax Relief Under The American Rescue Plan Act

The American Rescue Plan Act of 2021 provided additional relief to middle- and lower-income taxpayers by waiving federal income taxes on the first $10,200 of unemployment benefits received in 2020. This relief applied to benefits received through both state and federal unemployment programs for individuals or couples with an adjusted gross income of $150,000 or less in 2020.

Though many states have decided to mirror the federal exemption, CNBC reports that some are offering partial relief while others have decided to tax unemployment benefits. Check with your state tax authority to find out how it plans to treat unemployment benefits in regard to state taxes.

The Pandemic Emergency Unemployment Compensation , Pandemic Unemployment Assistance , Extended Benefits , $300 Federal Pandemic Unemployment Compensation , and $100 Mixed Earner Unemployment Compensation programs all expired on September 5, 2021.

What Was Pandemic Emergency Unemployment Compensation

Pandemic Emergency Unemployment Compensation was an emergency program designed to help Americans affected by the COVID-19 pandemic. It was established by the Coronavirus Aid, Relief, and Economic Security Act, a $2 trillion coronavirus emergency stimulus package signed into law by former President Trump on March 27, 2020. After a series of extensions, the program expired on September 5, 2021.

Benefits under the PEUC program were due to expire on Dec. 31, 2020 however, the PEUC was extended to March 14, 2021, and the number of weeks that an individual could claim PEUC benefits was increased from 13 to 24 by the Consolidated Appropriations Act , 2021. The American Rescue Plan Act of 2021 further extended the PEUC 29 weeks for up to 53 weeks through Sept. 5, 2021.

In other words, an additional 40 weeks were added to the original 13 weeks of extended benefits. Check with your state to determine your eligibility for federal benefits.

Work Search Requirement Reinstated

On Sunday, July 4, Maryland LABOR reinstated the standard active search for work requirement for all claimants receiving regular unemployment insurance benefits. Claimants receiving benefits under the Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation federal programs must meet the active search for work requirement beginning Sunday, July 18, 2021.

All claimants must actively search for work by completing at least three valid reemployment activities each week, which must include at least one job contact. Claimants must satisfy the active search for work requirement to maintain their eligibility for UI benefits.

Valid reemployment activities are intended to help a claimant become reemployed and remove potential barriers to employment. Qualifying activities include, but are not limited to: activities completed through the Maryland Workforce Exchange , such as setting up a virtual recruiter or completing a skills self-assessment attending networking events creating a résumé in MWE and attending employment events held by the Maryland Division of Workforce Development and Adult Learning . Job contacts refer to actions a claimant takes to contact employers in an attempt to secure employment. Acceptable job contacts include: submitting a job application to an employer interviewing for a job or completing a pre-screening for a job interview among other actions.

What Qualifies You For Meuc

To be eligible for MEUC, individuals must have received at least $5,000 of self-employment income in the most recent taxable year ending prior to the individual’s application for regular UI. This is provided in addition to the $300 Federal Pandemic Unemployment Compensation payment.

Payments Could Take Several Weeks To Arrive

States that opted in to providing MEUC by the Labor Department’s Jan. 2 deadline will provide workers with the full 11 weeks of extra payments.

New states can sign on to the agreement and cover weeks from that point through March 14.

With that said, it could take several more weeks for workers to see the boost.

“We need to be clear it is unlikely that eligible claimants will immediately begin seeing these benefits,” said Assistant Secretary of Labor for Employment and Training John Pallasch in a statement. “Any time Congress creates a new program such as MEUC, the states must work with the Department to ensure they are standing up and operating the new program with integrity. To this end, the Department stands ready to help states implement them in a rapid manner to ensure the timely payment of benefits.”

States are expected to announce in the coming days what type of documentation they’ll require in order for workers to prove their eligibility.

DETR anticipates tens of thousands or even hundreds of thousands of applications being submitted likely all at once. We will have staff trained and ready to start processing these applications. Each claim requires a review for each week of PUA eligibility and will take some time. The Division recommends checking the website and your PUA account for any current/updated changes. During the application process, you will have the option to choose between direct deposit, which will process more quickly, or you may choose to receive a new debit card which will not be sent until a benefit week is paid.

How Do I Participate In Work Search Activities

A work search is a good faith effort to find work and claimants are expected to use reasonable methods and conduct work search activities normal to their occupation. DETR has a number of programs and partners to help claimants with this process that includes training for a new high demand career, adult education and literacy programs, virtual support at Nevada JobConnect and in person support through Nevadaworks in Northern Nevada, and Workforce Connections in Southern Nevada.

What Is Mixed Earner Unemployment Compensation

Mixed Earner Unemployment Compensation is a $100 supplement to weekly Unemployment Insurance payments, only available if you worked a W-2 job and earned at least $5,000 through a side gig or self employment during the tax year used to make your initial unemployment claim.

If you are eligible for the $100 MEUC supplement, you are automatically eligible for the $300 FPUC enhancement, too.

The Mixed Earner Unemployment Compensation benefit is designed to provide financial assistance to gig workers, freelancers, and other self-employed individuals who were unintentionally left out of the federal Pandemic Unemployment Assistance program due to technically qualifying for traditional state unemployment, according to MixedIncome.org.

In other words, as a mixed income earner, your state may have approved you for traditional Unemployment Insurance based on the earnings of only your W-2 job not accounting for your side hustle income. The MEUC program seeks to remedy that scenario.

According to MixedIncome.org, 47 states have agreed to provide $100 MEUC benefits. The three states that have not opted into the program are Idaho, Mississippi and South Dakota.

Both FPUC and MEUC payments are available weekly between Dec. 26, 2020, and March 14, 2021. Both benefits are available retroactively for a total of 11 weeks.

To receive MEUC benefits, you must submit income documentation to your states labor department.

The Two Pandemic Unemployment Tracks

An enormous amount of federal aid has been pushed out to unemployed workers through the unemployment insurance system since the end of March. That aid has been distributed along two tracks:

  • Workers who are paid through a W-2 payroll system, and who met the income and duration eligibility requirements for unemployment insurance were put on the traditional unemployment insurance track, and receive first UI, then PEUC, then Extended Benefits.
  • Workers who are self-employed, who report their income on Schedule C, or whose earning and employment history did not make them eligible for unemployment insurance, were offered a brand new and temporary program called Pandemic Unemployment Assistance.

Both traditional UI and PUA participants were eligible for the $600 Federal Pandemic Unemployment Compensation top-up through July and the $300 top-up beginning in December and scheduled to run through March.

About The Peuc Extension

Pandemic Emergency Unemployment Compensation provided up to 53 additional weeks of payments if youve used all of your available unemployment benefits.

  • The first 13 weeks were available from March 29, 2020 to September 4, 2021. In UI Online, your claim type displays as PEUC.
  • After collecting the first 13 weeks, an additional 11 weeks were available beginning on or after December 27, 2020 to September 4, 2021. Your claim type displays as Extension Tier 2 in UI Online.
  • After collecting the first 24 weeks, an additional 29 weeks were available beginning on or after March 14, 2021 to September 4, 2021. Your claim type displays as Extension Tier 2 in UI Online.

To have qualified for a PEUC extension, your regular UI claim must have started on July 8, 2018, or after.

If you ran out of benefits within your benefit yearâ¦

  • If you ran out of benefits within your benefit year, we automatically filed your PEUC extension on your regular unemployment claim.
  • If you were collecting on a FED-ED extension, you continued to collect it until it was exhausted. We filed the additional weeks of the PEUC extension after you used all FED-ED benefits.

If your benefit year endedâ¦

  • If you didnt qualify for a new claim after the benefit year ended, two things happened.
  • First, you received a $0 award notice in the mail saying there were not enough wages for a new claim.

    Because states and businesses have shuttered due to the COVID-19 crisis, millions of laid-off workers in the U.S. continue to depend on unemployment insurance to help cover rent, groceries, and other expenses. But what if you are already unemployed and your benefits have run out?

    The CARES Act established the Pandemic Emergency Unemployment Compensation program to allow people who had exhausted their unemployment compensation benefits to receive up to 13 additional weeks of benefits, provided they “are able to work, available to work, and actively seeking work.”

    As stated earlier, benefits under the PEUC program were due to expire Dec. 31, 2020, but were extended through Sept. 5, 2021, first as a result of the Consolidated Appropriations Act , 2021, and then by the American Rescue Plan. Currently, individuals could collect unemployment benefits for a total of 53 weeks . The plan expired on September 5, 2021.

    Previously, 26 states elected to end the $300 federal supplement early. The best way to confirm the status of your unemployment benefits is to check with your state’s unemployment office. The Department of Labor lists the contact information for all fifty states’ labor offices on its website.

    Stimulus checks and other benefits for qualified individuals passed as part of the Consolidated Appropriations and American Rescue Plan Acts are not unemployment benefits and are administered by the U.S. Treasury Department.

    How Does Meuc Work

    Now that applications are available in many states, the design of the program is fairly simple. To qualify for MEUC, you must:

    • be enrolled on the traditional unemployment insurance track PUA recipients are categorically ineligible
    • have earned $5,000 or more in self-employment income in the calendar year preceding the year your unemployment benefits began.

    MEUC benefits are $100 per week, are added to your UI benefit, and are in addition to the current $300 FPUC top-up .

    The program is currently authorized to pay benefits for the 11 weeks ending January 2 through March 13 , for a total of $1,100 to those eligible the entire time. The program was slow to roll out, but once you apply and are approved, benefits are retroactive to your first week of eligibility.

    While Im sure it was hell to implement for our noble unemployment insurance software engineers, the design of the program itself is straightforward, with two big red flags:

    The CARES Act provides for a temporary federal program called Pandemic Emergency Unemployment Compensation . This program provides up to 13 weeks of regular Unemployment Insurance for eligible claimants whose claims have been exhausted . PEUC is payable effective March 29, 2020 through December 31, 2020. This program has been implemented effective May 10, 2020. As of March 11, 2021, an additional 25 weeks have been authorized to eligible claimants, through week ending September 4, 2021.

    PUA is separate from unemployment insurance and provides coverage only to individuals who are not eligible for regular unemployment insurance.
