    To calculate the amount of the benefit you are entitled to, the state of New York unemployment process uses one of two possible base periods. Base periods are divided into calendar quarters and the quarter you were paid the highest amount of wages determines the amount of your New York unemployment weekly claims. While you can determine ahead of time how much New York unemployment compensation you receive, you will be formally notified before your benefits begin.

    New Yorks Basic Base Period is the first four of the last five completed calendar quarters prior to the beginning date of the UI claim. If you have earned enough wages in your Basic Base Period, those wages will be used to calculate your benefit amount.

    If you do not have enough wages in the Basic Base Period to establish a claim, you may be able to use an Alternate Base Period. It is the last four completed calendar quarters prior to the beginning of the claim.

    If you have enough wages in the Basic Base Period, the state will not automatically check to see if your benefit amount would be higher in the Alternate Base Period. If you think your New York unemployment amount would be higher, you can request that the state use your Alternate Base Period instead.

    Income Tax Relief Under The American Rescue Plan Act

    The American Rescue Plan Act of 2021 provided additional relief to middle- and lower-income taxpayers by waiving federal income taxes on the first $10,200 of unemployment benefits received in 2020. This relief applied to benefits received through both state and federal unemployment programs for individuals or couples with an adjusted gross income of $150,000 or less in 2020.

    Though many states have decided to mirror the federal exemption, CNBC reports that some are offering partial relief while others have decided to tax unemployment benefits. Check with your state tax authority to find out how it plans to treat unemployment benefits in regard to state taxes.

    How To File An Unemployment Claim In New York

    New Yorkers who lose their job to covid can receive benefits for ninety-nine weeks. This number is based on the twenty-six weeks provided by the state and an additional fifty-three weeks of benefits funded by the federal government.

For those who receive a debit card, the funds can be withdrawn from an ATM or point of sale terminal. Once your application has been approved, the Department of Labor will send a Monetary Determination with information on your weekly benefit amount.

    Ny Dol 2021 Employment Extensions Payout Update

    In New York, PUA is now available through March 14, 2021 or for 57 total weeks of eligibility, whichever comes first. PEUC is now available through March 14, 2021 or for 24 total weeks of eligibility, whichever comes first. State Extended Benefits offers either 13 or 20 weeks of additional benefits on top of the weeks of PEUC benefits, depending on New York States unemployment rate. That means New Yorkers may be eligible for a total of 63 or 70 weeks of Unemployment Insurance benefits, depending on when they filed their claim and if the federal government considers New York to have high unemployment or extremely high unemployment. As of January 2021, New Yorkers qualify for 20 additional weeks of Extended Benefits.

    Claimants currently receiving benefits through the Extended Benefits program must finish all 20 weeks of EB before receiving additional weeks of PEUC. Claimants who have established PUA or PEUC claims on or before 3/14/21 and are still eligible for additional weeks may continue to claim benefits until they have collected the maximum number of weeks OR reach the week beginning 4/5/21, whichever comes first.

    Expanded Unemployment In New York During The Covid

    On March 11, 2021, President Biden signed into law a $1.9 trillion COVID-19 relief bill known as the American Rescue Plan .

    Under ARP, the $300 per week federal unemployment supplement is extended until September 6, 2021.

    The law also extends two unemployment programs originally created by the CARES Act in March 2020: Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation .

    Under the PUA program, self-employed workersusually excluded from unemployment benefitsare entitled to unemployment if they meet certain criteria. ARP makes PUA benefits available through Labor Day 2021, and increases the maximum duration of these benefits from 50 to 79 weeks.

    The PEUC program provides for a federally-funded extension of benefits when state unemployment benefits expire. ARP increases the maximum duration of PEUC benefits from 24 to 53 weeks, with an expiry date of September 4, 2021.
