Court Rejects Lawsuit Attempting To Reinstate Federal Unemployment Benefits

JACKSONVILLE, Fla. A court in Leon County rejected a lawsuit that sought to reinstate federal unemployment benefits in Florida, which ended in June.

A judge in Tallahassee heard arguments last week regarding the suit, which was originally filed in Broward County.

The lawsuit alleges the premature end to federal CARES Act benefits, which provide an additional $300 in weekly unemployment, was done “for purely partisan and political purposes.”

Leon County Circuit Judge Layne Smith denied the plaintiff’s motion for a temporary injunction. In the ruling, Judge Smith stated:

    • The defendants, including Gov. Rob DeSantis, did not violate Chapter 443 concerning reemployment assistance and
    • The motion was filed too late, as the FPUC program would end by the time Florida could opt back into it

The plaintiffs can still appeal Judge Smith’s ruling.

The Department of Economic Opportunity released the following statement on the ruling:

“The court ruling issued today affirms that the State of Floridas successful Return to Work Initiative and subsequent withdrawing participation from the Federal Pandemic Unemployment Compensation program was the right decision legally and has proven to increase employment and workforce participation.

The $300 Federal Pandemic Unemployment Assistance payments were discontinued in June, leaving unemployed Floridians living off a maximum of $275 per week.

Florida Unemployment Lawsuit Transferred To Tallahassee

FORT LAUDERDALE, Fla. â A South Florida judge ruled Tuesday to move a Florida unemployment lawsuit to Tallahassee.

    What You Need To Know

    • Broward County judge rules to move Florida unemployment lawsuit to Tallahassee
    • Original lawsuit filed seeks to order the state to restore the FPUC benefits
    • Plaintiffs argue they face irreparable harm after state ended federal extended unemployment benefits

Attorney Benjamin Gibson of Shutts and Bowen represents the state. He argued because Tallahassee is the state capital, where state leaders have their principal offices, that is where the lawsuit should be heard.Gibson told Judge Tuter transferring the case to Leon County would also speed up the process for the case to being resolved.âThis policy decision that was made by the State of Florida was announced on May 24, the plaintiffs went ahead and filed their initial complaint on July 25, the amended complaint on July 28,â Gibson said. âThese benefits are set to expire September 6, at the federal level theyâve already expired as of June 26, so we do note there has been a bit of a delay in bringing this case. That being said, the department, the governor, the secretary, weâre not trying to delay this case at all. We are happy to move forward as expeditiously as your honor would prefer, with caveat we believe weâre in front of the wrong court.â

What To Wait For After You File Your Unemployment Claim

Election poll volunteer loses Florida unemployment benefits after working for 4 hours

About a week after applying, you will obtain a letter stating if you are eligible and, if so, how much you will collect weekly as your benefit. In case you do not qualify for benefits, the letter will clarify why and tell you what you must do if you wish to appeal the verdict.

Once you have qualified to collect benefits, you must claim your weekly benefits every 2 weeks. The initial letter you obtain will give you a date on which you must call or go online and answer a few questions about your continued eligibility. Failure to reclaim your benefits every two weeks will hold up the payment of benefits to you.

Moreover, in the state of Florida, the first week of unemployment is not considered eligible for unemployment benefits. As such, your first date to claim your weekly benefits will be 3weeks after you initially claimed unemployment benefits, and then the benefits paid out will only be for 2 weeks.

What Is An Offer Of Suitable Employment

To keep collecting unemployment benefits, you need to demonstrate that youre unable to work. That means you usually cant keep collecting if you refuse a suitable job that offered you pay. That doesnt mean you have to take just any job, however. A suitable job usually means its safe for you to do that work and is reasonably accessible to you. You may have the option to turn down jobs that pay far less than you used to make, if theyre outside your career field and below your level of experience, if you can reasonably expect to find work in your field again. Check with your local unemployment office to confirm if you can turn down a particular job and still continue your benefits.

    Note All Work And Earnings

When you claim your benefits, you will have to report any work you have done in the weeks being claimed as well as the gross earnings . Even if you have not received payment from the employer yet, the earnings must still be reported over the time worked. Failure to report work and earnings is a crime and can carry severe penalties.
