I have the exact same problem. I’ve been receiving unemployment benefits for a few weeks now because of the full-time job I lost last month. I just received payment for freelance services performed last month which are entirely separate from that full-time job. Do I just skip a week of claiming and start reclaiming after? I have the impression this is what I’m suppose to do but then how will I claim the money I made? One sentence tells me I can’t claim benefits if I made more than the max amount but another tells me I have to report any money made?! All over the web and NY Labor website it says “Report all work!!!” but HOW? I can’t get through the telephone lines and there are no forms online. It’s amazing to me that such a simple thing has been so complicated. Will this stop my benefits? It’s was a TEMPORARY freelance gig that lasted one day. I don’t do this full-time. I see accounts all over the web where people have had unemployment put on hold for taking freelance work. This is crazy to me! Why would they discourage people taking work when it’s not full-time?BTW, I’m an independent contractor. Freelance work was for a company I’m not an employee of.

A valuable tax exemption emerging during the heart of tax season is a potential windfall and a new curveball for people trying to get back on their feet after a financially devastating year.

Even though jobless benefits count as income for tax purposes, the newly-signed $1.9 trillion American Rescue Plan will not impose federal income tax on the first $10,200 in unemployment benefits a person received last year.

The exemption applies for households with adjusted gross incomes below $150,000.

Here is the windfall first: The provision could result in individual household tax savings between $1,000 and $2,000, depending on some different estimates.

Here is the curveball: The provision is becoming law after Americans have already filed 55.7 million tax returns with the Internal Revenue Service as of March 5.

Its safe to say at least some of these returns came from people racing for a badly-needed tax refund after a tough 2020 that sent them to the unemployment line. Now, they have filed their taxes before accessing an exemption meant to help people like them.

Taxpayers who received jobless benefits and have not filed their income taxes should try to wait a little longer, experts told MarketWatch.

Taxpayers who have already filed should also wait, they say. But these people should be prepared to possibly file an amended income tax return that will claim the exemption, the observers added. Thats accomplished with the Form 1040-X.

Weekly Claim Filing Instructions

You must file weekly claims to receive benefits. To file a weekly claim, you will need your Social Security Number and PIN. The unemployment claim week begins on Sunday and ends on Saturday at midnight. We encourage you to file your claim on Sunday or as soon as possible after the Saturday week-ending date. You can file your weekly claim online at, select âSign Inâ then âmy Unemploymentâ and then choose âFile Weekly Claim.â

What To Expect With Partial Unemployment

With partial unemployment, claimants still need to certify their benefits each week with their states unemployment office, including reporting the number of days/hours worked in the previous week, Tayne said.

Your unemployment benefit amount is determined by the state you live in and is typically based on how much you earn or have earned and how many hours you work. The state will typically determine a reasonable weekly value and then subtract the amount you make from work each week.

Each state is different, and in New York, for example, the individual working part time must make $504 or less and work no more than 30 hours to be eligible for partial benefits, Tayne said. Benefits are reduced by how many hours the individual worked in a week. So a person working 11 to 20 hours in a week will have benefits decreased by 50%.

If you fail to certify your gross weekly pay, the benefits will be discontinued. Also, you cant certify in advance because your certification is for the previous week. For the week of Sunday, March 7 through Saturday, March 13, for example, the earliest you could certify is on Sunday, March 14. If you end up collecting more unemployment benefits than you are eligible for because you did not report earnings, there are severe penalties, as you could be committing fraud.
