Yes, depending on how your state chooses to implement the CARES Act. The new law creates the Federal Pandemic Unemployment Compensation program , which provides an additional $600 per week to individuals who are collecting regular UC and Unemployment Compensation for Ex-Servicemembers , PEUC, PUA, Extended Benefits , Short Time Compensation , Trade Readjustment Allowances , Disaster Unemployment Assistance , and payments under the Self Employment Assistance program). What Is An Offer Of Suitable Employment And How Is It Connected To Unemployment Insurance Eligibility

Most state unemployment insurance laws include language defining suitable employment. Typically, suitable employment is connected to the previous jobs wage level, type of work, and the claimants skills.

Refusing an offer of suitable employment without good cause will often disqualify individuals from continued eligibility for unemployment compensation.

For example, if an individuals former employer calls the individual back to work after having temporarily laid the individual off for reasons related to COVID-19, the individual would very likely have to accept the offer to return to work, or jeopardize his or her eligibility for unemployment insurance benefits, absent some extenuating circumstance, such as if the individual tested positive for COVID-19. The job an individual held before the spread of COVID-19 will constitute, in the vast majority of cases, suitable employment for purposes of unemployment insurance eligibility.

How To File An Unemployment Claim In New York

New Yorkers who lose their job to covid can receive benefits for ninety-nine weeks. This number is based on the twenty-six weeks provided by the state and an additional fifty-three weeks of benefits funded by the federal government.

Claims can be filed through the Department of Labors website. Unemployed workers must claim benefits for all weeks they would like to receive benefits. Typically, there is a waiting period between when a claimant files unemployment and when they receive their first payment. However, for those requesting benefits because of a loss of work due to the pandemic, the waiting period has been waved.

Each week, those requesting payments must provide information to demonstrate that they are eligible. If the benefits are approved, recipients will receive their payments through a pre-paid debit card or direct deposit. For those who receive a debit card, the funds can be withdrawn from an ATM or point of sale terminal. For those with access to a bank account that allows for direct deposit, account information can be provided to the Department of Labor, and the benefits will be deposited as claims are approved. Once your application has been approved, the Department of Labor will send a Monetary Determination with information on your weekly benefit amount.

I Had To Quit My Job After My Daughter Was Diagnosed With Cancer Can I Get Unemployment Benefits

It depends on your state’s eligibility rules. In every state, an employee who quits a job voluntarily, without good cause, won’t be allowed to collect unemployment. But each state has its own definition of good cause for quitting. In some states, employees may collect unemployment only if they quit for reasons related to the job, such as intolerable working conditions or a medical condition caused or aggravated by the job. Other states allow employees to collect unemployment if they quit for compelling personal reasons, such as domestic violence or serious illness in the family. Guidelines For Qualifying For Unemployment Benefits

    Unemployment Benefits

How can you tell if you’re eligible to receive unemployment? Each state sets guidelines that determine whether an individual will be eligible for unemployment benefits, and how much compensation they will receive.

There are eligibility requirements to qualify for unemployment benefits, including having worked a certain number of weeks for a certain number of hours each week. Those guidelines also determine how many weeks of benefits an unemployed worker can collect.

You’ll find detailed information regarding eligibility criteria on your state unemployment website. In most states, you will need to have worked for a certain period of time, met minimum earnings requirements, and have lost your job through no fault of your own. If your claim is denied or contested by your employer, you can appeal the denial.

But even if youve been terminated for cause, dont assume youre out of luck. You may be able to collect, depending on the circumstances, and whether or not the termination was justified. Its worth it to learn about your rightsincluding your right to appeal a denial of your unemployment claimsbefore you give up on the idea of filing for benefits.

Check with your state unemployment department for information on qualifying for and collecting unemployment compensation in your location.

How Is The Unemployment Waiver Calculated For Married Couples

The American Rescue Plan waived federal tax on up to $10,200 of unemployment compensation received in 2020 per person for those that earned less than $150,000, that rule also applies for married couples filing jointly. Although the couple could receive up to $20,400 if both collected jobless aid in 2020, only half that amount could be applied to each.

The IRS gives the example of one spouse having received $5,000 of benefits and the other getting $20,000. The total amount is $25,000 but the couple would not be entitled to the full $20,400 waiver but only $15,200. The spouse that got $5,000 in compensation gets the whole amount waived, but the second spouse only gets $10,200 of the $20,000.

In order for the IRS to make the adjustments it’s likely that the agency will need to cross-reference the 1099 tax forms for unemployment income sent by state labor bureaus to verify how much each spouse received in jobless aid according to Janet Holtzblatt, a senior fellow at the Urban-Brookings Tax Policy Center talking with CNBC. But she added that the exact method the IRS will use is unclear.

The IRS says that when it has finished the first phase it will begin work on the more complex corrections but the agency gives no expected date when that will be.

If I Am Eligible For Pandemic Unemployment Assistance Do I Need To First Apply For Unemployment Insurance

States must have a process for determining that Pandemic Unemployment Assistance applicants are ineligible for regular unemployment benefits, which may not include filing a regular claim as a first step. States are not required to take and adjudicate a full claim for regular unemployment insurance benefits to meet this requirement. While states are not prohibited from taking a full claim, to facilitate expedited claims processing the U.S. Department of Labor has discouraged states from doing so. Individuals should apply using the states PUA application process and, in states that have not yet established that process, must wait until it is established.

Find Out If You Might Qualify For Unemployment Benefits In Your State

Each state sets its own guidelines for eligibility for unemployment benefits, but you usually qualify if you:

    • Are unemployed through no fault of your own. In most states, this means you have to have separated from your last job due to a lack of available work.
    • Meet work and wage requirements. You must meet your states requirements for wages earned or time worked during an established period of time referred to as a “base period.”
    • Meet additional state requirements. Find details of your own states program by selecting your state below.

In March 2020, new federal law greatly expanded unemployment insurance. Many workers who were not previously covered are now eligible. You may now be eligible if any of the following are true:

    • Your employer reduced your work hours due to coronavirus measures
    • You are self-employed and have lost income due to coronavirus measures
    • Youre quarantined and cant work due to coronavirus
    • Youre unable to work due to a risk of exposure to coronavirus

When Can Newly Eligible Workers Start Filing For Unemployment

While the CARES Act makes these federal funds available to unemployed workers, states still have to individually sign on to the agreement and set up the infrastructure to accept new unemployment claims and pay out increased unemployment benefits.

“What happens now is the U.S. Department of Labor has to issue guidance for states on how to set up these Pandemic Unemployment Assistance benefits,” says Michele Evermore, senior researcher and policy analyst at the National Employment Law Project. That said, “I can’t imaging a state not wanting to enter into an agreement with federal agency to get these benefits out.”

Evermore adds it generally takes two to three weeks once someone has applied to actually get approved and start receiving payment. However, given the surge in unemployment claims, “I’d imagine it taking at least three to four weeks now,” she tells CNBC Make It. “Some states may surprise us and get benefits out the door before that.”

New York’s Department of Labor website already has instructions for newly eligible workers to get organized and file for Pandemic Unemployment Assistance once it becomes available. This week, Michigan Gov. Gretchen Whitmer signed on to create new state assistance programs under the CARESAct guidance around new eligibility and increased benefits will be announced “in the coming days.”
