How Can I Apply

It takes about four weeks from the date you apply to know if youre eligible for Texas unemployment benefits, so its probably a good idea to apply as soon as you become unemployed or underemployed. You can check your claim status on the TWC website or by phone. TWC will notify you by mail to let you know if youre eligible and your potential benefit amount.

Heres an overview of the process when filing for Texas unemployment benefits.

I Was Already Receiving Benefits Before Covid

Yes. The federal stimulus bill will give you 13 additional weeks of unemployment. This is called Pandemic Emergency Unemployment Compensation . You do not need to reapply if you ran out of benefits on or after July 1, 2019. Just keep requesting payments every two weeks. You are probably eligible if:

• Your original claim was dated on or after July 8, 2018

• You exhausted all entitlement to regularUIbenefits

• You are not eligible for benefits in any other state or territory

• You will run out of your current benefits at any point before December 20, 2020

• You are not receiving compensation under the UC laws of Canada and

• You are able to work and available for work.

If you meet the above criteria, the TWC will notify you by mail or electronic correspondence, and you should not attempt to apply for benefits again. If you submit another application, you may delay TWCs processing of your application.

After you exhaust those 13 weeks under the federal stimulus bill, you may then qualify for another 13 weeks under Texas law. This is called Extended Benefits. You do not need to reapply. Just keep requesting payments very two weeks. The TWC should automatically review your claim to see if you are eligible for additional weeks of benefits. But if they do not or say you cannot keep receiving benefits, you may need to call them to ask them to review your claim for Extended Benefits.

On December 27, 2020, a new pandemic relief bill was signed into law.

I Need Help To File My Claim

If you are disabled or unable to file the claim yourself, you may seek help from a trusted person. You do not have to file your claim yourself. However, no matter how much you trust the person you choose to aid you, we strongly recommend that you be present each time they help you and use your PIN.

Also, do keep in mind that you will be held responsible for the actions of your helper. Furthermore, you will be subject to penalties, and you may even forfeit your benefits if you are NOT PRESENT when a helper aids you.

How Do I Report And Prove My Work Search Activities

When you request your payments every two weeks, you must report the number of work search contacts you made and if you turned down any job offers.

The TWC will not ask you for documentation of your work search activities every time, but they may randomly ask you to provide documents to prove your work search activities, so keep detailed records.

The TWC has a form you can use to document your work search activities here . You do not have to use this form, though, as long as you keep a record in some way of the required proof of your work search activities..

The TWC requires the following to prove your work search activities:

• Date of the work search activity

• What you did

• Type of job you are seeking

• Employer names, addresses and phone numbers including area codes

• Name of the person you contacted, if applicable, and the method of contact

Do I Have To Look For Other Work

Normally, people collecting unemployment compensation must prove that theyre looking for other work while theyre collecting benefits, but that is not the case with unemployment compensation under the PUA. You will, however, have to prove that you cant work due to the COVID-19 pandemic, but if youre able to do that, especially if its for health reasons, you most likely wont be asked to look for other work.

Even though looking for work isnt required, its always a good idea to do so because its a fact that unemployment benefits will eventually run out. We hope the COVID crisis will end soon and rideshare business will boom once again, but no one knows when that might happen.

When To Apply

Apply for benefits as soon as you are unemployed because your claim starts the week you complete the application. However, you may not apply until after your last work day. We cannot pay benefits for weeks before your claim effective date. The effective date is the Sunday of the week in which you apply.

Apply for benefits with the state where you worked during your base period. If you worked in more than one state, see If You Earned Wages in More than One State.

If your last job was for a temporary agency or staff leasing company, you have additional requirements:

• If your last job was for a temporary agency, you must immediately contact the temporary agency for a new assignment and wait three business days after your assignment ended before applying for benefits. The agency has three business days to offer you a new assignment.
• If your last job was for a staff leasing company, you must immediately contact the staff leasing company for a new assignment.

Who Is It For

• People who dont have a lot of money as long as they meet program rules.
• Most adults age 18 to 49 with no children in the home can get SNAP for only 3 months in a 3-year period. The benefit period might be longer if the person works at least 20 hours a week or is in a job or training program. Some adults might not have to work to get benefits, such as those who have a disability or are pregnant.

What Other Aid Is Out There

While a fourth stimulus check is improbable, more direct payments to Americans have already been signed into law. Up until Labor Day, the jobless received extended unemployment benefits. The American Rescue Plan also includes an advance Child Tax Credit.

Under the revised Child Tax Credit, the Internal Revenue Service is paying out $3,600 per year for each child up to five years old and $3,000 per year for each child ages six through 17. Monthly payments of up to $300 per child started July 15 and will continue through December of 2021. The remainder is to be issued when the recipient files their 2021 taxes. The benefit does not depend on the recipients current tax burden. In other words, qualifying families will receive the full amount, regardless of how much or little they owe in taxes. Payments start to phase out beyond a $75,000 annual income for individuals and beyond $150,000 for married couples. The more generous credit will apply only for 2021, though Biden has stated his interest in extending it through 2025.

How Do I File For Unemployment Benefits

Apply to the Texas Workforce Commission online at Applying for Unemployment Benefits, or by calling 939-6631 weekdays from 7 a.m. to 6 p.m. You will need:

• Your last employers business name, address and phone number.
• The first and last dates you worked for your last employer. If you worked for that employer on more than one occasion, give the most recent dates.
• The number of hours worked and your pay rate if you worked the same week you are applying for benefits.
• Information about the normal wage for the job you are seeking.
• Alien Registration number .

Be prepared to explain how you became unemployed. The TWC will contact your last employer and ask about your job separation. If you and your employer disagree on why you lost your job, you will have a chance to explain your side of the story. An initial decision to grant or deny benefits will be mailed to you and your former employer.

My Boss Told Me I Needed To Come Back To Work But I Am Considered High

The TWC has said that workers can refuse an offer to return to work and still receive unemployment benefits in the following situations:

• They or someone they live with is 65 years or older.

• They have a medical issue, like heart disease, diabetes, cancer, or a weakened immune system, or are at a higher risk for getting very sick from COVID19 .

• They live with someone who is at a higher risk of getting very sick from COVID-19 .

• They have tested positive for COVID-19 by a source authorized by the State of Texas and have not recovered.

• They live with someone who tested positive for COVID-19 by a source authorized by the State of Texas and that person has not recovered and 14 days have not yet passed.

• They were exposed to COVID-19 through close contact and are quarantining for 14 days.

• They are the primary caregiver for a child they live with, and that childs school or daycare has closed and there are no alternatives.

The TWC has said that any other situation would be looked at on a case-by-case basis. Houston resident Kimberly Lantz suggests calling your local representatives office. After she was laid off from her job as a hotel sales manager in March, she filed for unemployment right away, but the TWC denied her claim for regular benefits because of an issue with her recent work history.

For the next seven months, she would try in bursts to get in touch with the workforce commission to find out whether she qualified for pandemic assistance. But she could never get through. It wasnt until she called state Rep. Ed Thompsons office in October to discuss her situation that she got an answer from the TWC. Within a week, $20,000 of backpay was deposited into her account.

Use the internet when possible. Melissa Jacobs, an attorney with Texas RioGrande Legal Aid, recommends filing your claim online and getting in the habit of checking your account regularly to stay on top of notices from the TWC. The TWC offers instructions on how to:

If you dont have access to the internet or need to talk to someone, you can try calling 800-939-6631, the TWCs main line for unemployment claims. But be prepared to wait anywhere from a few minutes to several hours. Jacobs recommends calling your local workforce office first and asking to be put into the hold queue for unemployment benefits if the call taker cant help you. Some Texans, like Ozona resident Sean Sanchez, 52, have had luck in recent months calling TWCs main line first thing in the morning. Start calling at 7 a.m. on the dot, Sanchez advised.

Request a call through the live chat function on the TWC website. At the bottom of the homepage, a virtual assistant can help answer common questions about TWC services. Check back in if you dont receive a call within a couple of days. Some people say they never heard back. NOTE: If you request a call, the TWC may try to get in touch with you from a number you dont recognize or that appears on your phone as unknown. The agency also recommends making sure your voicemail inbox is not full.

You do not have to search for traditional employment, but you have to take steps to reopen your business. If you do not intend to reopen your business or return to the type of work you previously did you must search for traditional employment.

You must report the number of hours a week you spend taking steps to reopen your business. The TWC has not said what the minimum number of hours is.

These are steps to reopen your business that should qualify to meet the work search requirements:

• Let your customers or clients know youre reopening by posting on your social media platforms

• Contact past customers or clients

• Advertise

• Pass out business cards and flyers

• Reach out to potential clients

• Make sure any required licenses or permits are current and renew them if they arent

• Obtain required permits or licenses if you dont already have them

• Review current contracts and research new ones

• Prepare a bid on contract

• Submit a bid on a contract

• Research and prepare for a specific contract

• Check your inventory

Amount And Duration Of Unemployment Benefits In Texas

As explained above, the Texas Workforce Commission determines your weekly unemployment benefit amount by dividing your earnings for the highest paid quarter of the base period by 25, up to a maximum of $535 per week.

Benefits are available for up to 26 weeks. If you are still unemployed when your regular state benefits run out, you may be eligible for extended benefits under state or federal law.
