Tax filers will be able to choose whether they want to use either their 2019 or 2020 earned income to calculate the Earned Income Tax Credit on their 2020 income tax returns, thanks to a one-time lookback provision. The lookback will help financially challenged people qualify for the refundable portion of the Child Tax Credit, which is allowed even if you do not owe any tax.

Unemployment compensation is taxable income. Since many did not have taxes withheld, they could face a tax bill. A generous payout for the earned income credit could offset some taxes that will be owed and even contribute to a tax refund.

The earned income credit will vary. The maximum credit is $6,660 for those filing a 2020 tax return but applies only to tax filers who have three or more qualifying children. By contrast, the maximum credit is $538 for someone who has a limited earned income but no children.

The maximum adjusted gross income allowed to obtain the earned income credit is up to $15,820 for those who are single with no children.

The highest cutoff is $56,844 for married couples filing a joint return with three or more qualifying children. The cutoff is an adjusted gross income of $41,756 for those who are single, widowed or head of household with one child.

Eligibility For Unemployment Benefits

The first big question to tackle is to see if you qualify for unemployment benefits. Though the Department of Labor administers the guidelines, each state has its own separate requirements to qualify.

There are generally two requirements youll have to meet:

  • The state will look at whether youve been working for a certain period of time called a base period.
  • The unemployment must have happened without any fault of your own.
  • Contact your State Unemployment Insurance agency to look at the other requirements and also to file a claim.

    More importantly, in 2020, the federal government kicked in extra unemployment benefits and some recipients found the extra money jeopardized their earned income credits, causing them to owe money when they didnt expect it.

    Also, many people filing for unemployment did not withhold taxes because their financial situations were dire and they needed all the money they could get at the time. This either will eliminate a tax burden or significantly reduce it for many of those people.

    How Do Withholdings Work With Unemployment Income

    “You arent required to take any tax withholdings from your unemployment,” said Spivey but you could have opted in to a flat 10% withholding previously.

    Spivey said most people shes seen through her work havent had withholdings on their unemployment benefits. “I had expected that this was going to be a big problem for the 2020 tax filing season,” said Spivey, “but ultimately, I dont think its been much of an issue.”

    She attributed that to the exemption thresholds put in through the American Rescue Plan.

    Get A Start Up Period

    You may be eligible for a 12 month start up period if youre self-employed. Your work coach can tell you if you can get a start up period for your business.

    During your start up period your monthly earnings are used to work out your Universal Credit and the minimum income floor does not apply. Youll also receive support from a work coach whos trained to work with the self-employed.

    Youll need to attend quarterly appointments with your work coach, providing evidence to show that youre still gainfully self-employed and actively taking steps to build your business.

    Youre only entitled to one start up period, unless it has been more than 5 years since your previous one, and youve started a completely different type of self-employment.

    Will I Owe Taxes On Stimulus Checks

    No, stimulus checks aren’t considered income by the IRS. They are prepaid tax credits for your 2020 tax return, authorized by two relief bills passed last year that aimed at stabilizing the struggling U.S. economy in the wake of the pandemic. Because the stimulus payments arent considered income by the tax agency, it wont impact your refund by increasing your adjusted gross income or putting you in a higher tax bracket, for instance.

    When it comes to getting paperwork ready, you’ll want to dig up the IRS Notice 1444 for the stimulus payment amount you were issued in 2020. And the second round of payments would be outlined in Notice 1444-B.

    At the local and state level, the options to pay for your state and local taxes may differ depending on where you live. Contact your state, county, or local unemployment office to learn about the different options to pay your taxes. These options may include:

    2. Making quarterly estimated payments. The due dates for estimated payments at the state and local level may differ from federal due dates.

    How To Claim Unemployment Benefits

    Each state has its own guidelines for how to claim unemployment benefits. There are also, typically, requirements you must follow to continue receiving the benefits.

    The first thing to do is gather the documents you will need to file your claim. This is because when you file a claim, your states unemployment insurance agency will ask you for details around your former employment, such as addresses and dates. You should take the time to provide the most complete and accurate information you can, as it lessens the chances of your claim being delayed.

    Second, you should contact your State Unemployment Insurance agency as soon as possible after you become unemployed. You dont always have to walk into an office because in some states it is now possible to file a claim by telephone or over the Internet.

    A general tip is that you should file your claim with the state where you worked. However, if you lived in one state but worked in another or you worked in multiple states, the unemployment insurance agency of the state where you live now can help you with information on how to file your claims with the other states.

    Usually, youll get your first benefit check about two to three weeks after youve filed your claim if you qualify.

    Repayment Of Employment Benefits

    • For the 2020 tax year, if you received EI payments and your net income was greater than $67,750, the Canada Revenue Agency requires you to repay 30 percent of your net income over the threshold.
    • However, if that amount exceeds the total amount of benefits you earned, you only need to repay the amount of benefits you received.

    For example:

    • If your net income was $77,750 in 2020 and you resceived EI benefits that year, you earned $10,000 over the threshold. As a result, you must repay $3,000, or 30% of $10,000.
    • But if you only received $2,000 in benefits, you would only repay $2,000.

    When To Expect A Refund For Your $10200 Unemployment Tax Break

    If you claimed unemployment last year but filed your taxes before the new $10,200 unemployment tax break was announced, the IRS says you can expect an automatic refund starting in May, if you qualify. The tax waiver led to some confusion, given it was announced in the middle of tax season, prompting the IRS to offer additional guidance on how to claim iteven if filed your 2020 tax return before the provision passed into law.

    I Received Unemployment Benefits In 2020 How Are They Taxed

    Unemployment benefits are subject to federal taxes, but the American Rescue Plan created new thresholds for whats taxable in this case.

    If your modified adjusted gross income is less than $150,000, for singles or married people filing separately, you dont have to pay taxes on the first $10,200 of 2020 unemployment benefits you earned. For married people filing jointly, if each spouse received unemployment, this exemption applies to the first $10,200 worth of benefits for both individuals. If your modified AGI is $150,000 or more, this exemption does not apply to you. And the threshold stays the same for all statuses it will not double to $300, 000 if you are married and filing a joint return, for example.

    If you file a Form 1040-NR , the IRS says your spouse isnt eligible for the tax break on the first $10,200 worth of benefits.

    According to the Employment Development Department , Pandemic Additional Compensation that extra $600 federal benefit bump people got from March until late July, and the extra $300 federal benefit bump people started getting in late December is taxable and must be included in your gross income. However, dont confuse this money with one-off stimulus checks from the U.S. government , which are not taxable.     What To Do If You Have Filed Already

    If you collected unemployment insurance in 2020 but you already filed your tax return, you are still eligible for the exemption under the American Rescue Plan. You do not need to take any action to claim the money youre owed. Instead, the IRS will automatically refund the money.

    The first round of payments will begin in May and continue over the summer, according to the IRS. Youll either receive a refund or the amount will be deducted from your taxes owed.

    There is no need for taxpayers to file an amended return unless the calculations make the taxpayer newly eligible for additional federal credits and deductions not already included on the original tax return, the agency noted in a recent release.

    This includes, for example, taxpayers who claimed the Earned Income Tax Credit but are eligible for an increased credit under the new exemption. While youll automatically get a refund for the exemption, youll need to file an amended return to get a larger credit.

    If you had any unemployment income last year, it is subject to taxes and needs to be reported on your 2020 income tax return. In January, those who had unemployment income should have received a Form 1099-G that spells out the amount of money paid out during the year.

    Federal income taxes apply to these benefits whether it’s state unemployment insurance or the pandemic unemployment compensation disbursed under the CARES Act.

    The catch is that withholding the appropriate amount of income tax is voluntary. You can opt to have a flat 10% of your benefits withheld to cover the tax liability.

    In order to do this, you’d have to file Form W-V4 with the state agency administering your unemployment.

    You can also choose to make quarterly estimated tax payments to the IRS.

    Uncle Sam isn’t the only entity seeking a slice of your unemployment income. Most states will tax these benefits, too.

    A handful of states Alabama, California, Montana, New Jersey, Pennsylvania and Virginia don’t tax these payments. Indiana and Wisconsin offer a partial exclusion of unemployment income, according to Andy Phillips, director at the Tax Institute at H& R Block.

    “Some states have withholding, and others require it in order to alleviate surprises when tax time comes around,” said Jared Walczak, vice president of state projects at the Tax Foundation.
