What Are The Unemployment Tax Rules For 2021

In March 2021, President Joe Biden signed into law a massive relief bill called the American Rescue Plan Act . One of the things it did was allow the first $10,200 in unemployment benefits collected in 2020 to be waived from federal income taxes for those with household incomes of as much as $150,000.

However, there’s been no sign that a similar tax break might be offered for the 2021 tax year.”No unemployment compensation exclusion is on the books for tax year 2021,” says Angela Anderson, a certified public accountant who provides professional advice through the online question-and-answer service JustAnswer. “However, just because that is the case now, does not mean that the situation will not change.”

Quick tip: When applying for unemployment benefits, you can file Form W-4V to request withholdings to pay for income taxes. Unemployment withholdings have a standardized rate of 10%.

Note On Special Benefits

The EI repayment requirement only applies to regular benefits, including regular fishing benefits.

It does not affect special benefits such as those for:

  • Maternity
  • Sickness
  • Parents of critically ill children

If you receive only special benefits, you do not have to worry about repaying benefits if your net income surpasses the threshold. Similarly, special benefits received in the previous decade do not trigger the repayment requirement.

If you receive both special benefits and regular EI benefits in the same year, you may be required to repay a portion of your regular benefits.

For example, if you received both unemployment and maternity benefits in 2019, your net income for that year was over $66,375 and you received regular EI benefits in one of the 10 previous years, you would be required to repay a portion of your benefits. However, you would only be required to repay regular benefits rather than special maternity benefits.

Some Exceptions To The Rule

A few slim loopholes exist to the rules regarding what compensation is taxable. According to the IRS, your benefits arent taxable if you contributed to a government unemployment program, and you received no tax break in return. You paid in with after-tax dollars, and you didn’t claim a tax deduction for the sum.

The same rule applies to private, nonunion compensation funds and to special union funds. Benefits received up to the amount of your contributions are tax free, but theyre included in your taxable income otherwise.

Benefits received from a fund financed by your employer are also taxable. This isnt considered unemployment compensation, although it is income, so its subject to income tax, Social Security tax, and Medicare tax, just as regular wages would be.

You add your total unemployment payments to any other income you received during the year and pay tax on the total. However, nine states have no income tax: Alaska, Florida, Nevada, New Hampshire, South Dakota, Tennessee, Texas, Washington, and Wyoming. Residents there will only owe federal income tax on their unemployment benefits.

Each state has its own unemployment criteria and rules. Unemployment programs typically require you to be unemployed through no fault of your own and meet work and wage requirements. If you quit or were fired for cause, you usually don’t qualify for unemployment. Self-employed people and contract workers usually aren’t eligible for unemployment benefits, but the CARES Act allowed states to extend unemployment benefits to these individuals.

Requesting A Duplicate 1099

If you do not receive your Form 1099-G by February 1, and you received unemployment benefits during the prior calendar year, you may request a duplicate 1099-G form by phone:

  • Call Tele-Serv at 800-558-8321.
  • Select option 2 and follow the prompts.
  • We cannot process requests for duplicate 1099-G forms until after February 1 because throughout January we are still mailing the original forms.

    You do not need a paper copy of Form 1099-G to file your federal tax return the IRS only needs the total amount of benefits TWC paid you during the previous calendar year and the amount of taxes withheld.

    What Do I Do If I Received A 1099

    If you received a 1099-G and never filed for unemployment, first double check the amount on the 1099-G wasnt your state tax refund. State tax refunds also go on 1099-G.

    If the 1099-G is for unemployment benefits, this may be a case of identity theft. Immediately contact the unemployment office so they dont hold you responsible for the fraud. You may want to take other steps to protect your identity like checking your credit report.

    The IRS will automatically refund money to eligible people who filed their tax return reporting unemployment compensation before the recent changes made by the American Rescue Plan. These refunds are expected to begin in May and continue into the summer.

    Knowing that you may have to pay income taxes on your unemployment benefits, you can choose from several options to help make the payments more manageable.

    • Request tax withholdings. When you were working, your company may have withheld money for taxes and made those payments on your behalf. You can also ask your state to do the same with your weekly unemployment benefits. It will withhold 10% of your unemployment pay, which it will send to the IRS. You may also request state or local tax withholdings if they apply to you.
    • Pay estimated taxes. Another option is to make estimated tax payments to the IRS and your state tax agency every quarter. Depending on how much unemployment you collect, and what other sources of income you have throughout the year, you may want to do this even if you have money withheld from your benefits. If you wind up owing more than $1,000 in income taxes, you may have to pay an additional underpayment penalty.
    • Set money aside. You could choose to keep all your unemployment benefits if you don’t expect to owe any taxes. Or, even if you expect to owe a little, you could still keep the money and set a portion aside in a savings account in case there’s an emergency in the interim. You claimed the exclusion when filing your 2020 tax return in the spring of 2021.

    The IRS recalculated tax returns that were filed prior to the March 2021 ruling. It then issued refunds to any taxpayers who overpaid before ARPA went into effect.

    If you collected unemployment in 2020, theres a chance you were paid benefits in January 2021 because they accrued late. This means you have to include that income in your 2021 tax return, despite that the money is technically for the unemployment period in 2020. The ARPA exemption does not apply to unemployment income received in 2021. The key ARPA words are unemployment compensation paid in 2020.

    What Do I Do If I Forgot To Include My Unemployment Income On My Tax Return

    If you forgot to include your unemployment income when you filed, youll generally want to file an amended tax return. An amended return is submitting a new, corrected tax return.

    Youll also usually need to include a payment for the additional tax owed. If you were expecting a refund, you shouldnt expect the extra taxes to come out of your refund. The IRS takes a long time to process amended tax returns and will usually issue your refund before it gets to your amended return.
