Pandemic Emergency Unemployment Compensation

How to apply for unemployment a second time

States provide benefits for up to 26 weeks , but what if you exhaust your unemployment benefits?

Under the Pandemic Emergency Unemployment Compensation program, you were eligible for an extra 13 weeks of UI under the CARES Act. However, you had to be “able to work, available to work, and actively seeking work.” States were required to offer flexibility to applicants in meeting PEUC eligibility requirements related to “actively seeking work” if an applicant’s ability to find work was affected by COVID-19.

That 13-week period was extended to 24 weeks when the CAA was signed in December 2020. President Joe Biden’s American Rescue Plan added an additional 29 weeks for a total of 53 weeks for the PEUC program. The PEUC program expired on Sept. 6, 2021.

How to File for Unemployment Benefits

Before you start receiving EI benefits, there is one week for which you will not be paid. This is what we call the “waiting period.” The waiting period is like the deductible that you must pay for other types of insurance.

You usually serve the waiting period at the very beginning of a benefit period, unless you receive earnings during this one-week period. In that case, the waiting period will start during the first week for which you would otherwise be entitled to benefits.

Need more information on earnings received during the waiting period? See Section 3.

If you received EI benefits in the last 52 weeks and you have reactivated your claim having already served the one-week waiting period, you do not need to serve an additional waiting period on the existing claim.

Need more information on reactivating a claim? See Section 1.

Warning: If You Are Offered Your Old Job Back

Some people may be tempted to stay on unemployment instead of returning to workat least through the period where FPUC provided that extra $300 per week, in addition to each state’s regular unemployment payment. Be wary of following that approach. And remember, the benefits are only available until early September 2021.

Businesses who received loan forgiveness under the Paycheck Protection Program have been pushing for an answer to whether they would lose loan forgiveness if laid-off employees refuse to return when offered their old jobs back . The Treasury Department issued an FAQ saying this would not happen if they make a good-faith, written offer to rehire a laid-off employee and have documented evidence of being turned down by the employee.

But here’s what that FAQ also said: “Employees and employers should be aware that employees who reject offers of re-employment may forfeit eligibility for continued unemployment compensation.” In other words: Refuse to go back, and you could lose your unemployment insurance.

The amount of DIS-COLL is calculated using the same method as NASpI but is provided for a number of weeks equal to half the number of weeks of contributions paid in the last working year.

To receive unemployment benefits, you must submit a claim to the INPS electronically within 68 days from the end of the working relationship and sign an ‘Immediate Availability Declaration’ for work or request enrolment in a training course, both of which must be submitted to the competent Job Centre .

ISCRO amounts to 25% of income earned in the previous year with a ceiling of EUR 800 per month, is paid for six months and is not subject to taxation.
